MORATORIUM ON THE ISSUANCE OF NEW
CHARI1;' ABLE GAMBLING PREMISES PERMITS
Proposed Action
Staff recommends approval of the following motion: Move that the Hopkins City Council adopt
Resolution 2003-046 extending the moratorium on the issuance of new Lawful Gambling
premises permits.
Approval of this motion will extend the moratorium on any new premises permit applications
until September 2.
Overview
The City Council adopted a moratorium on new premises permits on April 1, 2003. The
moratorium is set to expire on June 29. Because of scheduling conflicts, a general discussion of
revisions to the policy on lawful gambling cannot take place until July 22. In order to give the
Council time to consider changes to the policy, staff is recommending that the moratorium be
extended.
City staff has sent notices ofthe July 22 meeting to:
. Organizations that currently have premises permits;
. Owners of facilities that are leasing space for lawful gambling; and
. The Hopkins Youth Hockey Association. .
Primary Issues to Consider
. Is a moratorium necessary?
Without a moratorium the Council could be faced with the need to act on an application
during the study process.
. How long will the moratorium last?
The moratorium is set to expire on September 2. The moratorium would automatically expire
if the City's policy on lawful gambling were amended prior to that date.

RESOLUTION 2003-046
WHEREAS, the City of Hopkins has an existing policy regarding Lawful Gambling; and
WHEREAS, the Hopkins City Council believes that it is prudent to review its policy dealing
with Lawful Gambling to determine whether any revision is necessary; and
WHEREAS, there is a need to restrict permits for Lawful Gambling until a study has been
completed and any modifications to the City's policy have been adopted; and
WHEREAS, the City is still in the process of completing its study and the City Council wishes to
give interested parties an opportunity to comment on the policy; and
WHEREAS, It is necessary for the City Council to extend the moratorium in order to allow the
review process to be completed.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Hopkins hereby
declares that it will not consider any application for a premises permit to conduct Lawful
Gambling until the City policy on Lawful Gambling has been revised and adopted. The
existing moratorium is extended until September 2, 2003 or upon the adoption the revised
gambling policy whichever occurs first.
