Staff recommends the following motion: Move to approve Resolution 03-51, recommending approving a preliminary/final plat at 420 Mainstreet. At the Zoning and Planning meeting, Ms. Hatcher moved and Ms. Halverson seconded a motion to approve RZ03-9, recommending approval of a preliminary/final plat at 420 Mainstreet. The motion was approved unanimously. Overview. The applicants are proposing to divide the lot at 420 Mainstreet into two lots. The Luther Company will own the west lot, and the Walser Automotive Group will own the east lot. The existing building on the lot will be razed. Walser will be applying in the next few months for an amendment to their conditional use permit to add the additional lot to their operation. At this time staff does not know the exact plans for the west parcel, but any use involving an auto sales lot will require a conditional use permit. Luther does own the building on the comer of Fifth and Mainstreet. What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The zoning of the property is B-3. The Comprehensive Plan has designated the site as Commercial. An auto sales lot is a conditional use within the B-3 zoning district. . Do the lots meet the zoning requirements? The minimum lot size in a B-3 district is 3000 square feet. The existing lot is 49,847 square feet. The proposed lots will be 24,921 and 24,926 square feet. The lots as proposed meet the lot requirements. . What are the specifics of the plat? The lot will be divided into two lots. . Does the proposed plat meet the subdivision requirements? The proposed plat meets the subdivision requirements. . Will a park dedication fee be required? A park dedication fee will be required. . What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed plat. Ms. Anderson noted that Walser had applied for a conditional use permit for the June meeting to add the additional property to their existing site to the east. Don Schilling from Walser was at the meeting. No one appeared at the public hearing regarding this item. Alternatives. 1. Approve the preliminary/final plat. By approving of the preliminary/final plat, the applicants will be able to divide the lots as proposed. 2. Deny the preliminary/final plat. By denying the preliminary/final plat, the applicants will not be able to divide the lots as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 03-51 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A PRELIMINARYIFINAL PLAT FOR LUTHERIW ALSER WHEREAS, an application for a preliminary/final plat SUBD03-2 has been made by Luther/Walser; WHEREAS, the procedural history ofthe application is as follows: 1. That an application for a preliminary/final plat was made by LutherlWalser, on May 7, 2003; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on May 27, 2003: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staffwere considered; and 4. A legal description ofthe subject property is as follows: Par 1: Tract B, except the north 19 feet of the east 50 feet as measured along the north and east lines thereof, and all of Tracts A, C, D, E, and F, Registered Land Survey No. 823, Hennepin County, Minnesota.
