CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE 2003-897 AN ORDINANCE AMENDING SECTION 1200 OF THE HOPKINS CITY CODE Whereas, the interests of establishing liquor sales rind; Hopkins City Council has determined that the the City and its residents can best be serveJ by distance requirements that would separate off-sale from sens i ti ve uses such as school s and churches Whereas, the Hopkins City Council has determined that preveIltin'J the concentration of such businesses as liquor stores, pawn shops, and adult oriented services would enhance the general welfare of the citizens; Now, therefore, the City Council of the City of Hopkins does hereby ordain: Section 1. Hopkins City Code, Section 1200.12 is hereby added to read as follows: 1200.12. No new off-sale license shall be granted for any building within 350 feet of any elementary or secondary school; daycare center; or religious institution. Furthermore, no new lJ f f - s a 1 e 1 i c en s e s h a 11 beg ran t e d for any b u i 1 din g wit hill 3 5 0 feet of any existing 1 iquor store, pawn shop, 1 icensed currency exchange, or any business licensed under Section 1160 or 116~ of the Hopkins City Code (Adult businesses.) For purposes of this ordinance, this di stance shall be a horizontal measurement 1: rom the nedrest existing property line of any church site, schuul si te, day care site, or the site of any exi st ing 1 iquor store, pawn shop, licensed currency exchange, or any business licensed under Sect ion 1160 or 1165 of the Hopkins City Code, to the nearest property line of the proposed off-sale liquor site. Section 2. The effective date of this ordinance shall bp thp date of publication.
