CR 06-075 Approve Ord 06-971 Amending City Code Sect 500-75 Park Dedication Formula, 1st Reading ~ ~ June 15, 2006 Council Report 2006-075 Approve Ordinance 2006-971, Amending City Code Section 500.75, Park Dedication Formula, for first reading Proposed Action Staff recommends adoption of the following motion: Approve Ordinance 2006-971 for first reading. Overview In 2003, the City Council adopted ordinance 2003-899, which made changes to various fee schedules and renewal dates. In that ordinance, Section 500.75, Subdivision 7 was deleted and replaced with a statement that Park Dedication contributions will be established in Chapter 10 of the Hopkins City Code and set from time to time by resolution of the City Council. When Section 500.75, Subd. 7 was deleted, language on how value would be calculated to determine the Park Dedication fee on commercial, industrial, and medium/high density residential plats, was also removed form the City Code. Ordinance 2006-971 would add this language back into the Code. The Planning Department feels that the addition is a necessary explanation of how staff determines the value of a parcel. Section 500.75 of the Hopkins City Code shall be amended as follows: Subd. 2 Dedication Formula: The land dedication and/or cash in lieu of land dedication shall be based on the estimate of actual fair market value of the property to be dedicated to the city as calculated by the City Assessor, of the property as of the date of the approval of the final plat, replat, subdivision or waiver of plating. The estimate of fair market value shall include value added to the property by utilities, streets, and other public improvements serving the land, but shall exclude value added by other improvements to the land.
