Overview ". The National Pollutant Discharge Elimination System (NPDES) phase II permit program is part of the Environmental Protection Agency's Clean Water Act. The Minnesota Pollution Control Agency (MPCA) is responsible for implementing and enforcing this legislation locally. On March 4, 2003 the Hopkins City Council approved the application for the general permit to be submitted to the MPCA and directed city to complete the SWPPP as required in the permit. Staff has completed the SWPPP and recommends approval of the plan and direction to submit it to the MPCA. Primary Issues To Consider . Permit application requirements . The plan details the steps the City of Hopkins will take over the permit period from March 10, 2003 to 2008 to address storm water pollution. The approved SWPPP must be submitted to the MPCA by May 9, 2003 in order to comply with the Notice of Intent, which the City submitted to the MPCA on March 10,2003. Commitment for implementation In submitting this plan the City of Hopkins is obligated to implement the Best Management Practices (BMPs) listed in the plan on the schedule detailed in the plan. The law requires that the plan be designed to minimize the discharge of pollutants from the city's storm sewer system to the maximum extent practicable. In order to meet this criterion the staff utilized the process developed in the League of Minnesota Cites Guideplan, which included a self-appraisal process to develop the S WPPP. The SWPPP identifies specific BMPs to implement. For each BMP a specific measurable goal, implementation schedule, and responsible person are identified. If applicable for the educational component of a BMP the audience and educational goal is also identified. Recommendation City staff recommends approval of the Storm Water Pollution Prevention plan and requests direction to submit it to the MPCA to comply with the NPDES phase II program. Introduction The City of Hopkins, Minnesota is a suburb in the Twin City metro area and within the urbanized area as defined in the National Pollution Discharge Elimination System (NPDES) phase II program. In being within the urbanized area and operating a Municipal Small Separate Storm Sewer System (MS4) the City of Hopkins is classified as a mandatory city required to submit a Storm Water Pollution Prevention Plan (SWPPP). The City began the process to develop a SWPPP by working with the League of Minnesota Cities (LMC) who had joined the resources of nearly 100 cities to work together with a consultant to produce a Guide Plan for completion ofthe SWPPP. The goal of LMC Guide Plan was to pool the resources of a large group to develop a reference document that would serve as a guide to assist cities in developing their individual SWPPPs. With the guide plan as reference city staff then continued the process of customizing a SWPPP to address the specific needs of the City of Hopkins. The City Council was provided background information on the permit process. The final SWPPP was reviewed and approved by the City Council on May 6, 2003. Development Process The first step in creatiop. ofthe SWPPP as outlined in the LMC guide plan was a self assessment process in which city staff listed current practices that address storm water quality. They were also asked to suggest additional or new practices they felt would provide for better water quality. In addition to the self assessment process city staff considered non storm water discharges such as foundation drains, individual residential car washing, foundation drains, etc to determine if they should be considered as significant contributors to pollution. These discharges were not considered to be significant contributors and therefore have not been incorporated into the permit. Building on the practices currently in place city staff then began assembling a list of Best Management Practices (BMPs) to include in the City's SWPPP. The goal of this list was to address storm water discharge quality to the Maximum Extent Practicable (MEP) as defined in the NPDES phase II program. Best Management Practices & Measurable Goals As the NPDES phase II permit process requires a list ofBMPs has been completed. For each BMP entry in the list a number of attributes about that BMP are also included. The BMPs are characterized into six separate Minimum Control Measures (MCM) as described in the NPDES phase II program. Those MCMs are: I. Public education and outreach 2. Public participation 3. Illicit discharge detection and elimination 4. Construction site stormwater runoff control 5. Post construction storm water management in new development and redevelopment 6. Pollution prevention and good housekeeping for municipal operations Other attributes about each BMP that are identified in the list include, a measurable goal, time frame to complete, person responsible for the BMP. Additionally if there is an educational component to the BMP the intended audience and the educational goal is listed. . Implementation and Record Keeping The NPDES phase II permit covers a 5 year period from March 10, 2003 to 2008. The . implementation of the SWPPP requires annual reporting to the MPCA on the progress to completing the measurable goals listed for each BMP. Records will be maintained by the City on all activities conducted relating to completion of the measurable goals through out the year. Quarterly reports, beginning in the third quarter of the first permit year, will be compiled by the Assistant City Engineer and submitted to the Public Works Director. An annual report will be submitted to the MPCA. The reports will summarize the activities completed related to the BMPs listed in the SWPPP. The report may also recommend modifications to the SWPPP in compliance with the guidelines set forth in the NPDES phase II program. Records will be kept for a minimum of three years past the permit period. Currently law requires a new permit application will be submitted at the end of this permit cycle. The City intends to utilize the ASIST software to maintain records on all activities completed in its SWPPP and to compile reports on those activities.
