Reject Low Bid by Premier Construction and Award Contract to Thurnbeck Steel Fabrication, Inc.
Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 2003-049
reiectinQ low bid of Premier Construction as non-responsive and award bid for City Facilities
proiect. Bid PackaQe 2, Division 3, to Thurnbeck Steel Fabrication, Inc.
Overview.

City Council at its April 1, 2003 meeting passed resolutions awarding contracts on the City facilities
improvement project. Included in these awards was a contract for Bid Package No.2, Division 3,
Structural Steel and Metal Fabrication to Premier Construction in the amount of $195,584. Staff
has since discovered that Premier Construction did not bid the work as shown in the plans and
specifications and their bid must therefore be rejected as defective and non-responsive.
Thurnbeck Steel Fabrication, Inc. was the second low bidder, with a bid of $220,767.00, and
properly bid the work as described in the plans and specifications. Empire Corporation withdrew
their bid due to an error shortly after bid opening. Staff recommends award to Thurnbeck Steel
Fabrication, Inc.
. Primary Issues to Consider.
. Why was the Premier Construction bid non-responsive?
They did not include a factory-applied "Kynar" finish for the aluminum sun screen components in
their bid. Premier felt that the plans/specifications were not clear and expected compensation via
a change order if this special finish was required. The City disagrees - the City Attorney informed
Premier in writing of our decision to reject their bid.

Dear Mr. Thornberg:
~e purpose of this letter is to notify you that the City of Hopkins rejects your bid, dated March 25,
2003, for Bid Division Three (Structural Steel and Metal Fabrication and Supply) for the Hopkins
Public Works facility. Although your company's bid appeared to be the lowest, the bid failed to include
all necessary elements of the work and is therefore defective and not responsive. As such, the City of
Hopkins has a legal duty to reject the bid.
Based on your discussions with David Chase of Kraus Anderson, it is our understanding that you did
not believe you were required to include in your bid the cost of material finishes, specifically those
pertaining to the aluminum sunscreen and trim, as described in Section 08905 of the bid specification
documents and Addendum 2 to the Bid Documents. Both documents clearly indicate that material
finish is a required portion of the work. In addition, Bid Division Three clearly states that the work to
be bid includes all specifications as set forth in Section 08905. In reviewing Premier's bid document, it
1 fails to include any reference to Section 08905, which explains, in part, why you did not include. the
work in your bid.
Premier Construction System's bid materially differs from the specifications clearly set forth in the Bid
Documents and is, therefore, not responsive. The City of Hopkins" pursuant to its legal duty, rejects the
bid. If you have any questions, direct them to my office.

details as shown on the drawings. Comply with AS1M B 221 for extrusions and AS1M B 209 for,sheet or plate.

FABRICATION:

Dissimilar Metals: Separate dissimilar metals with zinc chromate primer, bituminous paint, or other separator that will prevent
corrosion. ..;
Continuity: Maintain accurate relation of planes and angles, with hairline fit of contacting members.
Unifonnitv of Finish: Abutting extruded aluminum members shall not have an integral color or texture variation
greater than half the range indicated in the sample pair submittal.
Flashing: Provide 26 gage pre-finished flashing as shown and as required to prohibit storm water from entering the building.
Clear Anodized Coating: Provide clear anodized Class II coating at all framing and related components that is shown to be in
a clear anodized finish: this work includes primarily the:: sunscreen.
Kvnar (Kvnar 500) XL. pigmented 3-coat svstem: 33% thermoplastic polymer ofvinylidine fluoride, 1.2 mils dry film thickness,
medium gloss per ASTM D 523. All exposed components shall have even, consistent finish throughout. Color shall be a
custom color and sheen as selected by the Architect, for all components and systems. Provide this finish at horizontal trim as
shoWn.

Whereas, the City has determined that the low bid submitted by Premier
Construction Systems, Inc. is defective and non-responsive because it did not
include all required elements of work as described in the construction plans and
specifications, and
Whereas, the second low responsive bidder is Thurnbeck Steel Fabrication, Inc.
with a bid of $220,767.00,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS,
MINNESOTA, that the bid of Premier Construction Systems, Inc. is rejected and
the contract for City Project 99-06, Bid Package No.2, Division 3 is awarded to
Thurnbeck Steel Fabrication, Inc. in the amount of $220,767.00 and the Mayor and
City Manager are hereby authorized and directed to enter into a contract with
Thurnbeck Steel Fabrication, Inc. for and on behalf of the City.
