Conditional Use Permit for The Blake School Campus Improvements
Proposed Action: Staff recommends the City Council approve the following motion:
• Move to adopt Resolution 2021-075, approving a conditional use permit for The Blake School
located at 110 Blake Road, subject to conditions.
Overview
The applicant, The Blake School, requests approval of a conditional use permit to allow for the
construction of an Early Learning Center (ELC), pedestrian and vehicle improvements to Campus
Drive and the construction of a Transportation and Grounds Maintenance Facility. Staff recommends
approval of this request subject to conditions.

BACKGROUND
The Blake School has proposed the construction of a 38,000 square feet Early Learning Center for pre-
k through 1st grade students and accompanying 61-stall parking lot on the south end of the campus and
a 2,572 square foot building for transportation and grounds maintenance on the northeast corner of the
site. The applicant also proposes the reconstruction of Campus drive to allow for a new concrete
pedestrian sidewalk and connections to the new parking lot and a round-about for bus drop off for the
Early Learning Center. The proposed improvements are scheduled to be constructed begin in spring
2022 and be completed by fall 2023.
Neighborhood Meeting. City policy requires conditional use permit (CUP) applicants to hold a
meeting to provide information and answer questions from the surrounding neighborhood. This
meeting took place on November 10 from 6:30 to 7:30 p.m. at The Blake School and was attended by
6 people from both Hopkins and Edina. Questions from the attendees related to landscaping,
screening and noise related to the transportation and grounds maintenance facility and parking. A full
summary of the meeting is attached to this item.
Community Comment. Under state law, conditional use permit applications require a public hearing.
Accordingly, the City published notice of this request and public hearing in the Sun Sailor and mailed
notice directly to all residents and property owners within 500’ of the subject property. That notice
directed all interested parties to send questions or comments to the city by mail, phone or email or to
attend the public hearing where they could learn about the request, ask questions and provide feedback.
As of the writing of this report, the City had received no comments or questions regarding this request.
During the public hearing, staff will provide an update on all public comments received prior to the
Planning & Zoning Commission meeting.
Planning & Zoning Commission Action. The Planning & Zoning Commission held a public
hearing to review this item during their November 23, 2021 regular meeting. During the meeting, the
commission heard a summary presentation from staff and held a public hearing where one resident
spoke and voiced concerns regarding noise and existing exterior storage. The Blake School responded
noting that the proposed transportation and grounds maintenance facility would help clean up some of
the existing storage on the site and that work will not begin until 7 a.m. most mornings with the
exception of snow plowing. After some general discussion of the project with the applicant, the
Planning & Zoning Commission voted to recommend the City Council approve this request.
CONDITIONAL USE PERMIT REVIEW
Conditional use permit applications are considered quasi-judicial actions. In such cases, the City is
acting as a judge to determine if the regulations within the Comprehensive Plan, Zoning Ordinance
and Subdivision Ordinance are being followed. Generally, if the application meets these requirements
they are approved. In evaluating a conditional use permit application, the Planning & Zoning
Commission and City Council shall consider and require compliance with the standards, conditions
and requirements detailed in Section 102-94, of the City Code. In many cases these requirements
overlap with, and are covered in more detail in, the site plan review section of this report.
a) The consistency with the elements and objectives of the City's development plan, including the
comprehensive plan and any other relevant plans at the time of the request.
FINDING: The land use and zoning designations are consistent with the proposed improvements
to The Blake School campus. The subject property is both guided and zoned Institutional.
According to the Comprehensive Plan, the Institutional land use category is intended to capture
public and semi-public uses such as schools, churches, government buildings and other civic use.
By comparison, the Institutional zoning district identifies schools and all structures, facilities, and
physical improvements as a conditional use.

b) Consistency with this ordinance;
FINDING: The subject property and proposed development are consistent with the city
ordinances. More specifically, these ordinances relate to the City’s development standards
contained in the zoning regulations. Staff’s review of this project and the City’s zoning
regulations are detailed in the site plan section of this report.
c) Creation of a harmonious relationship of buildings and open spaces with natural site features and
with existing and future buildings having a visual relationship to the development;
FINDING: Staff finds the proposed campus improvements will not significantly alter the existing
relationship of buildings and open space with natural site features or their visual relationship to
the development.
d) Creation of a functional and harmonious design for structures and site features, with special
attention to the following:
1.) An internal sense of order for the buildings and uses on the site and provision of a desirable
environment for occupants, visitors, and the general community;
FINDING: The proposed campus improvements will improve the internal sense of order for
the buildings and uses on the site and provide a desirable environment for occupants, visitors,
and the general community. In total, these improvements will provide modernized and
expanded facilities, improved pedestrian access for students, faculty, and visitors.
2.) The amount and location of open space and landscaping;
FINDING: The proposed campus improvements will not substantially alter the amount and
location of open space and landscaping. These improvements are detailed in the landscaping
section of the Site Plan Review.
3.) Materials, textures, colors, and details of construction as an expression of the design concept
and the compatibility of the same with the adjacent and neighboring structures and uses.
FINDING: The proposed campus improvements include the construction of a new Early
Learning Center and a Transportation and Grounds Maintenance Facility. In each case, the
new buildings were designed to use materials, textures, colors, and details that are consistent
with the City’s zoning standards and compatible with both the surrounding neighborhood and
the school’s existing buildings. The proposed additions and their exterior materials are
detailed in the exterior building materials section of the Site Plan Review.
4.) Vehicular and pedestrian circulation, including walkways, interior drives, and parking in
terms of location and number of access points to the public streets, width of interior drives
and access points, general interior circulation, separation of pedestrian and vehicular traffic
and arrangements and amount of parking.
FINDING: The proposed campus improvements will improve vehicle and pedestrian
circulation throughout the site. These improvements are detailed in the Access and Parking
and Pedestrian Circulation section of the Site Plan Review.
e.) Promotion of energy conservation through design, location, orientation and elevation of

structures, the use and location of glass in structures and the use of landscape materials and site
grading;
FINDING: The ELC building will be heated and cooled by a geothermal system and utilizes
daylighting strategies to reduce electric lighting use. The building will have high-efficiency
window systems and is seeking LEED Certification.
f.) Protection of adjacent and neighboring properties through reasonable provision for surface water
drainage, sound and sight buffers, preservation of views, light and air and those aspects of design
not adequately covered by other regulations which may have substantial effects on neighboring
land uses, and;
FINDING: The applicant has taken several steps to protect adjacent and neighboring properties.
These steps are detailed in the Landscaping and Engineering section of the Site Plan Review.
g.) The use will not be injurious to the use and enjoyment of other property in the immediate vicinity
for the purposes already permitted, nor tend to or actually diminish and impair property values
within the neighborhood.
FINDING: The proposed campus improvements will not be injurious to the use and enjoyment
of other property in the immediate vicinity or diminish and impair property values within the
neighborhood.
h.) In Institutional zoning districts, the Conditional Use Permit application shall comply with the
standards, conditions and requirements stated in Section 102.309 of this Ordinance.
FINDING: Section 102.309 provides for standards related to a conditional use that includes
demolition or removal of dwelling units and does not apply to this application.
i.) Traffic impacts such as increases in vehicular traffic, changes in traffic movements, traffic
congestion, interference with other transportation systems or pedestrian traffic, and traffic hazards
shall be considered by the Planning & Zoning Commission and City Council in evaluating an
application for a Conditional Use Permit.
FINDING: The proposed campus improvement will improve internal traffic circulation and
provide an improved pedestrian experience. Details about the proposed changes can be found in
the Access and Parking and Landscaping sections of the Site Plan Review.
SITE PLAN REVIEW
Standards for reviewing a site plan application are detailed in Section 102-126 of the City Code. This
section establishes site plan review procedures and provides regulations pertaining to the enforcement
of site design standards consistent with the requirements of this section. These procedures are
established to promote high quality development to ensure the long-term stability of residential
neighborhoods and enhance the built and natural environment within the City as new development and
redevelopment activities occur.
Land Use and Zoning Standards. The land use and zoning designations are consistent with the
proposed improvements to The Blake School campus. The subject property is both guided and zoned
Institutional. According to the Comprehensive Plan, the Institutional land use category is intended to
capture public and semi-public uses such as schools, churches, government buildings and other civic
use. By comparison, the Institutional zoning district identifies schools and all structures, facilities, and
physical improvements as a conditional use.

Lot and Building Standards. The subject property is zoned Institutional and the lot and building
standards for this district are detailed in the table below. Given the size of The Blake School property
(more than 49 acres) and the internal orientation of the existing buildings and proposed additions, the
site remains in compliance with the setback standards listed below.

Exterior Building Materials. While the Institutional district does not provide specific exterior building
materials criteria, the conditional use permit standards do require building materials, textures, colors,
and details are compatible with the adjacent and neighboring structures and uses. The proposed
additions were designed to use materials, textures, colors, and details that are consistent with the City’s
zoning standards and compatible with both the surrounding neighborhood and the schools existing
buildings. Specifics for each building are detailed below.
According to the applicant, the Early Learning Center will be constructed using modular brick and brick
accents for the exterior walls, with aluminum-clad wood doors and windows. Two skybox features
made of aluminum and glass. Mechanicals will be stored next to the building, rather than on the roof
and will be enclosed in corrugated metal paneling. The Transportation and maintenance facility will be
constructed with concrete masonry block and will have aluminum and metal accent materials.
Building Height. The proposed Early Learning Center will be two-story design with a finished height
of 27 feet. The building does include three skyboxes, which are utilized to increase light and decrease
energy consumption, which have a height of 39 feet. Staff finds that while these are over the allowable
height within the district, they are similar in nature to items found in Section 102.621, such as belfries
and steeples which are allowed to over the height requirement with a Conditional Use Permit.
The Transportation and Grounds Maintenance Facility will be a single-story structure measuring 16
feet, 10 inches in height.
Access and Parking. The applicant has proposed improvements to Campus Drive to create better
pedestrian access as well as provide some room for overflow parking during events. A roundabout,
located in front of the Early Learning Center, will provide improved circulation for bus drop off and
helping limit bus-vehicle interactions.
The applicant proposes to remove an informal, gravel parking lot to create the Transportation and
Grounds Maintenance facility, as well as provide stormwater retention area and add 61 additional stalls
in front of the Early Learning Center. Section 102-484 of the City Code requires that the school use
and accessory uses of the theater, hockey arena and football stadiums have a total of 371 parking spaces.
The applicant has proposed a total of 373 parking spaces and is in compliance with this standard.
Pedestrian Circulation. The proposed campus improvements will improve pedestrian circulation
through significant improvements to Campus Drive. The applicant has proposed to reconstruct all of
Campus drive, from Blake Road through campus to the Early Learning Center and connecting with the
existing parking lot on the southside of the parcel and the newly constructed parking lot which serves

the early learning center. Campus Drive will now have a concrete sidewalk along the south side which
will run the length of the drive, and in front of drive lanes along Blake Road. There will also be
improved crossings along the stretch of the drive and detectable warning plates (also called truncated
domes), will be installed along Blake Road to improve accessibility. The City Engineer has requested
that as a condition of approval the applicant install a refuge island, complete with truncated domes, at
the entrance monument sign.
Landscaping. The applicant’s landscape plans include the removal of 28 trees where the Early
Learning Center will be constructed and does not show removal of trees for the construction of the
transportation and grounds maintenance facility. The applicant plans to replace the trees and the
landscaping plan is consistent with Section 102-524 of the City Code, adding 96 total deciduous and
coniferous trees. Twenty-five trees will be located at the transportation and grounds maintenance
facility and are concentrated between the building and Blake Road to screen the building. Seventy-one
trees will be located around the early learning center near the new access drive, and around and
throughout the parking area.
Staff recommends a condition of approval require the applicant provide a landscape security in the form
acceptable to the City Attorney equal to 1.5 times the value of the proposed plantings. The letter of
credit shall be provided prior to the issuance of any building permit and shall be valid for a period of
time equal to two growing seasons after the date of installation of the landscaping.
Signage. The applicant’s plans to submit a new signage package for the campus outside of these
approvals and is aware that any new signage must conform to the City’s sign regulations and be
approved through a separate administrative sign permit.
Exterior Lighting. The applicant’s plans do not include an exterior lighting plan or light fixture details.
The applicant is still developing plans but is planning to obtain LEED certification for the building and
has noted that as such will be paying special attention to minimizing light pollution and monitoring
light levels. Staff recommends that a condition of approval require the applicant to receive approval of
their exterior lighting plans and light fixture details prior to issuance of a building permit.
Refuse Enclosure. The applicant’s plans for the Early Learning Center have refuse located within the
service yard and refuse for the transportation and grounds maintenance building will be located within
the fenced, outdoor storage area.
Exterior Storage. The applicant’s plan includes exterior storage located adjacent to the transportation
and grounds maintenance facility. The plan set indicates that this would be a chain link fence with vinyl
inserts, which would not be an allowed material, and will instead be a 6-foot cedar fence which is 90%
opaque. The revision to the fence material is shown in the supplemental narrative.
Engineering Standards. The City Engineer has reviewed the applicant’s plans and offers the following
comments:
• Access to trail and city easement on southern edge of parcel required at all times.
• Please add a pedestrian refuge island, complete with truncated domes, at the entrance
monument sign.
• Provide a minimum 10’ concrete or bituminous apron at all public trail connections. The Blake
School maintenance will be responsible for removing any excess materials which spill onto the
trail.
• Provide detail for connection to existing sanitary manhole.
o Sanitary sewer connection will require ROW permit and restoration.

Staff recommends a condition of approval require the applicant to comply with all conditions of the
City Engineer and receive all necessary approvals from the Minnehaha Watershed District.
ALTERNATIVES
1. Vote to approve the conditional use permit application. By voting to approve this application,
the conditional use permit application for an early learning center, transportation and grounds
maintenance building and improvements to Campus drive at 110 Blake Road will be approved.
2. Vote to deny the conditional use permit application. By voting to deny this application, the
conditional use permit application for an early learning center, transportation and grounds
maintenance building and improvements to Campus drive at 110 Blake Road will not be
approved. Should the City Council consider this option, it must also identify specific findings
that support this alternative.
3. Continue for further information. If the City Council finds that further information is needed,
the item should be continued.

A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR THE BLAKE SCHOOL
CAMPUS IMPROVEMENTS
WHEREAS The Blake School has initiated a conditional use permit (CUP) application for the
properties currently located at 110 Blake Road;
WHEREAS, these properties are legally described as Lot 1, Block 1, The Blake School Addition,
except that part embraced within the east 1/2 of the southwest 1/4 of Section 19 Township 117 Range 21
Hennepin County, Minnesota;
WHEREAS the procedural history of the application is as follows:
1. That a site plan application was initiated by the applicant on October 20, 2021;
2. That the Hopkins Planning and Zoning Commission, pursuant to published and mailed
notice, held a public hearing on the application and reviewed such application on
November 23, 2021, all persons present were given an opportunity to be heard; and,
3. That the written comments and analysis of City staff were considered; and,
4. That the Hopkins City Council reviewed this application during their December 7, 2021
meeting and agreed with the findings of the Planning & Zoning Commission.
AND, WHEREAS staff recommended approval of the site plan based on the findings outlined in
the staff report dated December 7, 2021.
NOW, THEREFORE, BE IT RESOLVED that the Planning & Zoning Commission of the City
of Hopkins hereby recommends the City Council approve a conditional use permit for The Blake School,
subject to the conditions listed below.
1. Issuance of a building permit.
2. Submission of a landscape security in a form acceptable to the City Attorney equal to 1.5
times the value of the proposed plantings. The letter of credit shall be provided prior to the
issuance of any building permit and shall be valid for a period equal to two growing seasons
after the date of installation of the landscaping.
3. All exterior signage shall be approved through a separate sign permit.
4. Approval of an exterior lighting plan prior to issuance of a building permit.
5. Conformance with all conditions of the City Engineer listed in the December, 2021, staff
report.
6. Approval of all necessary permits from the Minnehaha Creek Watershed District prior to
issuance of a building permit.

This supplemental narrative addresses site fencing and campus-wide parking.
SITE FENCING REVISION
FNC-1 originally listed on A405 as chain link fencing with vinyl privacy inserts will be replaced with
natural cedar fencing of the same height and layout as shown on the drawings. The fencing will
be primarily opaque (over 90%) with only small gaps between boards and the base board and
the ground.

Parking Operational Usage
The primary uses summarized above are not anticipated to run concurrently on the Blake
Campus based on current and ongoing operations. The football stadium and hockey arena
events do not typically overlap because they have separate seasons. Athletic and theatrical
events do not typically occur during the school day.
Blake has calculated an anticipated campus-wide parking demand during a typical day to be
a total of 250 stalls. This number includes parking for teachers, employees, and visiting parents
during the regular school day. After 3:00 p.m. students will be arriving for use of the athletic fields
and/or hockey arena. During this time, most of the school day parking demand is substantially
reduced and is not anticipated to go above the peak demand that occurs during the day.
To streamline peak traffic demand during pick up and drop off, East Entry Drive is being widened
to four traffic lanes. The two outer lanes will be converted to parallel parking spots to supplement
event parking in the evenings when campus traffic is reduced.

a. Harrison Ave residents cannot park on their own street when there are sporting
events, how does Blake plan to resolve this?
i. Response: Dan shared Blake is aware of this concern and we have been
working to improve the situation. Since adding golf carts and a shuttle bus
to major events, we have seen much greater use of our lower lot by
visiting fans. We will continue to work on our communication with parents
from the home and visiting team to use our lots.
b. How many parking spaces is Blake adding?
i. Response: Blake is building a new lot by the ELC with 61 spaces. In
addition more parents will be able to park along the main driveway after
school, due to the widening of the driveway to 4 lanes.
c. Any plans for Blake owned properties on Harrison Ave- they’ve just sat since
they were purchased and are run down.
i. Response: No plans at this time, those homes are not part of this project.
d. Have traffic studies been done about this project?
i. Response: No, because we expect minimal impact to Blake Road and
Excelsior Blvd traffic given the significant investment we are making into a
new parking lot, widening our driveway and enhancing our bus travel
path.
e. Can the walking path be turned into a road?
i. Response: Blake doesn’t own that land.
f. Concern about noise at Transportation & Grounds Maintenance Facility before
8am and it being a dumping ground, visibility to equipment:
i. Response: Dan stated that Blake works closely with neighbors during
construction and during normal operations to address concerns. Dan
shared his contact information with the neighbor and encouraged him to
call anytime if there is a noise issue. Dan also shared the yard will be
fenced in and will have extensive landscape screening around the facility.
g. Will this project direct additional water to the south of the property? The neighbor
was concerned about this.
i. Response: All water from the ELC project area will flow north into existing
or new stormwater ponds.
h. Is it possible to improve pedestrian crossing where the trail meets Blake Rd?
i. Response: Not within the scope of this project and this issue is in the
City’s jurisdiction, but Blake is happy to help in that effort in any way they
can.

i. Blake is actively working to keep as many old growth trees as possible,
and will replace any that need to be taken out. Blake will also be working
