CR 08-071 Prliminary Plat/Final Plat - 133 Oakwood• Nf N0PKINS July 30, 2008 Council Report 08 -71 PRELIMINARY PLAT/FINAL PLAT —133 OAKWOOD Proposed Action Staff recommends the following motion: Move to adopt Resolution 08 -43, approving a preliminary /final plat for 133 Oakwood. At the Zoning and Planning meeting Ms. Reilly moved and Ms. Newcomb seconded a motion to adopt Resolution RZ08 -3, recommending approval of a preliminary /final plat for 133 Oakwood. The motion was approved unanimously. Overview The applicant, Charles Watts, is proposing to raze the existing home and construct a new home at 133 Oakwood. 133 Oakwood consists of two 40 -foot lots. The existing home straddles the two lots, as would the new home. The problem is that in the past homes were allowed to straddle lot lines. This was not a good practice and is not allowed today. To remedy the situation the owner will have to replat. Interlachen Park was platted as 40 -foot lots; however, in this area each home is on two or three 40 -foot lots. The new lot will be 80' x 133'. The proposed home meets the minimum requirements for setbacks. The home will have a detached garage on the northwest side of the site. The zoning of the property is R -1 -C. The Comprehensive Plan has designated this site as Low Density Residential. The proposed replat complies with both documents. • Does the lot meet the zoning requirements? A lot in the R -1 -C zoning district is required to have a minimum size of 12,000 square feet and a minimum lot width of 80 feet. The proposed lot will be 80 feet in width. The proposed lot is 10,642 square feet; the applicant has applied for an area variance. • What are the specifics of the plat? The lot will be approximately 80' x 133'. This lot is consistent with the other parcels in the area. • Does the proposed plat meet the subdivision requirements? The plat as proposed meets the subdivision requirements. • Will a park dedication fee be required? A park dedication fee will not be required because no additional lots will be created. • What was the discussion at the Zoning and Planning Commission? Ms. Anderson explained the reasons for the replatting. Ms. Anderson also stated that there was a letter signed in support of the subdivision and variance by many of the surrounding neighbors. Charles Watts appeared before the Commission. Mr. Watts stated that they started out looking at remodeling the existing home and came to the conclusion it was not going to work. There were structural issues with the old home. No one appeared at the public hearing. Alternatives 1. Approve the preliminary /final plat. By approving the preliminary /final plat, the applicant will be able to construct the new home as proposed. 2. Deny the preliminary /final plat. By denying the preliminary /final plat, the applicant will not be able to construct the new home as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. CR8 -43 Page 3 3. Continue for further information. That an application for preliminary /final plat was submitted by Charles Watts on July 3, 2008; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on July 29, 2008: all persons present were given an opportunity to be heard; and 3.
