2008-042 CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2008-042 RESOLUTION ADOPTING THE MODIFICATION TO THE REDEVELOPMENT PLAN FOR REDEVELOPMENT PROJECT NO.1. BE IT RESOLVED by the City Council of the City of Hopkins, Minnesota, as follows: WIIEREAS, the City Council (the "Council") of the City of Hopkins (the "City") has heretofore established Redevelopment Project No.1 and adopted the Redevelopment Plan therefor. It has been proposed that the City adopt a Modification to the Redevelopment Plan for Redevelopment Project No.1, referred to herein as the "Redevelopment Plan Modification", all pursuant to and in conformity with applicable law, including Minnesota Statutes, Sections 469.001 to 469.047 and Sections 469.174 to 469.1799, inclusive as amended (the "Act"), all as reflected in the Redeve10plnent Plan Modification, and presented for the Council's consideration; and WHEREAS, the Council has investigated the facts related to the Redevelopment Plan Modification; and WHEREAS, the City has performed all actions required by law to be performed prior to the adoption and approval of the proposed Redevelopment Plan Modification, including, but not limited to, the holding of a public hearing upon published notice as required by law; and WHEREAS, the City is expanding the boundaries of Redevelopment Project No.1 to include the parcels listed in Attachment A. Section 1. Findings for Proiect Plan Modification 1.01. The Project Plan Modification includes the expansion of the Project Area Boundaries. The Boundaries are being expanded to allow for continuing the redevelopment goals of the City. 1.02. The Redevelopment Plan Modification conforms to the general plan for development or redevelopment of the City as a whole. The reason for supporting this finding is that the Redevelopment Plan Modification will generally complement and serve to implement policies adopted in the City's comprehensive plan. 1.03. The Project Plan Modification will afford maximum oPPOliunity, consistent with the sound needs of the City as a whole, for the development or redevelopment of Redevelopment Project No. 1 by private enterprise. The reason for supporting this finding is that the development activities are necessary so that development and redevelopment by private enterprise can occur within Redevelopment Project No.1. 1.04. The land in the project area would not be made available for redevelopment without the financial aid to be sought. The land being added to the Project has been underutilized for years and it is clear that for redevelopment of that land to occur public financial participation will likely be necessary. Section 2. Approval and Adoption of the Proiect Plan Modification~ Filing. 2.01. The Redevelopment Plan Modification is hereby approved, and shall be placed on file at the City Clerk. Approval of the Project Plan Modification does not constitute approval of any project or a development agreement with any developer. 2.02. The staff of the City is authorized to file the Redevelopment Plan Modification with the Commissioner of Revenue and the Hennepin County Auditor. 2.03. The staff of the City, the City's advisors and legal counsel are authorized and directed to proceed with the implementation of the Redevelopment Plan Modification and for this purpose to negotiate, draft, prepare and present to this Council for its consideration all further modifications, resolutions, documents and contracts necessary for this purpose.
