Parking Lots 500 & 600 and 10th and 11th Avenue North Improvements
Prooosed Action.
Staff recommends adoption of the following motion: Move that Council: 1) adoot
Resolution 2001-05. Resolution Orderina Imorovements After Public Hearina. Proiect
98-12: 2) adoot Resolution 2001-06. statina City's intent to sell revenue bonds to fund
this oroiect: and 3) authorize the mayor and city manaaer to enter into an aareement
with RLK-Kuusisto. Ltd for enaineerina services related to this 2001 street and oarkina
lot imorovement oroiect.
This action continues an assessable project for street and parking lot improvements.
Overview.
Council at its July 18, 2000 meeting authorized RLK-Kuusisto, Ltd. to prepare a
feasibility study concerning improvements to parking lots 500, 600 and 10th and 11 th
Av nues between Mainstreet and 1st Street North. The report was presented to Council
at its December 19 meeting and a public hearing was ordered for January 16. Hearing
notices have been mailed to all affected property owners of record. Council needs to
conduct the hearing and determine authorization of a project. At the January 9 Council
work session it was decided that work would continue on determining an acceptable
method for assessing property owners for this street and parking lot work. Therefore,
this report does not include preliminary assessment calculations. RLK-Kuusisto, Ltd
has proposed a fee of $25,400 to complete de~ign services. -

Analvsis of Issues
Scope of Improvements
Pavements: Parking lot pavement surface deterioration and poor underlying soils
necessitate complete removal and reconstruction of parking lots 500 and 600. The
pavement condition of 10th and 11th Avenues is fair-poor. Partial reconstruction
including both full pavement section replacement and full depth asphalt mill and overlay
is recommended. Concrete sidewalk and curb and gutter will be replaced where in poor
condition, impacted by underground utility work or due to parking/curbline re-
alignments.
Drainage: Underground storm sewer will be added to 10th Avenue and along the
parking lots to collect pavement runoff and runoff from roof downspouts.
Landscaping: New trees are proposed along both avenues and the south edge of lot
500. Existing trees will predominantly remain in place.
Parking: Parking changes are proposed in order to meet the objectives of improving
pedestrian and vehicular safety. The number of parking stalls within lots 500 and 600
are reduced from 191 to 188. Parking along 10th and 11th Avenues is reduced from 81
to 56. Overall, parking is reduced from 360 to 332 stalls.
Public Input
Four public meetings were held while developing the feasibility report. The meetings
were productive with business and property owners providing valuable input on all areas
covered by the report.
Project budget, estimated project costs, engineering fees and assessments
Project budget: The city's capital improvement plan budget for this project is $350,000
($105,000 - PIR; $245,000 - SA).
Estimated project costs: The estimated project cost for 10th and 11 th Avenues is
$242,604.79 and for the parking lots is $229,451.74.

Engineering Fees: RLK-Kuusisto, Ltd has proposed a fee of $25,400 to complete
design and construction admin services through bidding, or 7% of the estimated
construction cost. The total preliminary and final design engineering services including
the feasibility report and project survey work would be $54,500 or 15.5 % of estimat d
construction cost ($29,100: feasibility report and survey work + $25,400: design). This
is a very reasonable fee that compares favorably with fees the city has paid on other
projects of similar complexity and public interest.
Ass sments: City Council has decided to further discuss funding options and will
determine the level of assessments at a future meeting. However, assessments will not
exceed those included in the project feasibility report. The proposed assessment
amounts from the feasibility report for street improvements and parking lot
improvements are $65,441.94 and $134,934.97, respectively. These costs were based
on both the parking lot and street work being assessed with owner paying 70% and city
30% of the assessable construction costs. When you consider the project as a whole,
the assessments amount to 42% of the total estimated project cost. The proposed
street assessment formula was based on an adjusted building square footage (SF).
The resulting formula meant that properties with street frontage paid a higher
assessment rate than properties without street frontage. The final determination of
project funding, including assessments will be made prior to Council ordering an
assessment hearing - on/about March 20,2001 City Council meeting.

RESOLUTION ORDERING IMPROVEMENT AFTER PUBLIC HEARING
PROJECT # 98-12
WHEREAS, a resolution of the city Council adopted the 19th
day of December, 2000, fixed a date for a Council hearing on the
proposed improvement of street and parking lot reconstruction on
10th and 11th Avenues North from Mainstreet to 1st Street North
and City parking lots 500 and 600, including replacement of
deficient utilities,
WHEREAS, the Council deems it appropriate and expedient to
make such improvements, and
WHEREAS, ten days mailed notice and two weeks published
notice of the hearing was given, and the hearing was held
thereon on the 16th day of January, 2001 at which all pe+sons
desiring to be heard were given an opportunity to be heard
thereon,
NOW THEREFORE BE IT RESOLVED BY THE CITY OF HOPKINS,
MINNESOTA:
1. Such improvement is hereby ordered as proposed in the
Council resolution adopted the 19th day of December,
2000.
2. RLK-Kuusisto, Ltd is hereby designated to prepare
plans and specifications for the making of such
improvement.

DECLARING THE OFFICIAL INTENT OF THE CITY OF HOPKINS TO REIMBURSE
CERTAIN EXPENDITURES FROM BOND PROCEEDS TO BE ISSUED BY THE CITY
OF HOPKINS
WHEREAS, as the Internal Revenue Service has issued Treas. Reg. #1.150.2 providing
that proceeds of tax-exempt bonds used to reimburse prior expenditures shall not be deemed
spent unless certain requirements are met, and
WHEREAS, the Council expects to incur certain expenditures which may be financed
temporarily from sources other than bonds, and reimbursed from the bond proceeds:
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Hopkins
Minnesota (the "City"), as follows:
1. The City intends to incur expenditures for the project described in Council Report
2000-200 for project 98-12 (the 'tproject"), and intends to reimburse itself for such
expenditures from the bond proceeds to be issued by the City in the maximum
principal amount described in the "project".
2. The City Manager is authorized to designate additions to project 98-12 in
circumstances where time is of the essence, and any such designation shall be
reported to the Council at the earliest practicable date and shall be filed with the
official books and records of the City.
3 . This resolution is intended to constitute a declaration of official intent for the
purposes ofTreas. Reg. #1.150-2 and any successor law, regulation, ruling or
amendment pertaining thereto.

This Council proposes to proceed under the authority granted by Chapter 429 MSA.
