WAIVER OF PLAT - 318 TYLER
Proposed Action.
Staff recommends the following motion: Move to adopt Resolution 01-85. approving a waiver
of plat at 318 Tyler Avenue North.
At the Zoning and Planning meeting, Mr. Rowan moved and Mr. Thompson seconded a motion
to approve Resolution RZO 1-18, recommending approval of a wavier of plat to divide the
property at 318 Tyler Avenue. The motion was approved unanimously.
Overview.
The applicant, Garold Healy, is proposing to divide his single lot at 318 Tyler into two lots.
The home is located on the west side of the property and will have over the minimum setback on
the side the lot will be divided. The new lot will be located on the east side of the existing lot.
The lot is zoned R-I-C, which requires a 12,000 square-foot minimum lot size. Both the lots will
have the required 12,000 square feet. Access to the existing home will be from a driveway
easement on the easterly lot.

The survey shows an area where the existing utilities can be located. Staff is
recommending a condition that all existing utilities be located in this proposed easement.
. What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the waiver of plat with the Commission. Garold Healy, the
applicant, appeared before the Commission. No one appeared regarding this issue.
Alternatives.
1. Approve of the waiver of plat for 318 Tyler Avenue North. By approving the waiver of
plat, the applicant will be able to divide the lot as proposed.
2. Deny the waiver of plat for 318 Tyler Avenue North. By denying the waiver of plat, the
applicant will not be able to divide the lot as proposed. If the City Council considers this
alternative, findings will have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A WAIVER OF PLAT AT 318 TYLER
WHEREAS, an application for Waiver of Plat WVROI-2 has been made by Garold
Healy; and
WHEREAS, the procedural history of the application is as follows:
1. That an application for Waiver of Plat WVRO 1-1 was made by Garold
Healy, on September 20,2001;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed
notice, held a meeting on the application and reviewed such application on
October 30, 2001: all persons present were given an opportunity to be
heard;
3.
That the written comments and analysis of the City staff were considered;
and
4. Legal descriptions of the parcels are as follows:
Proposed Legal Description of Westerly parcel
That part of Lot 9, Block 1, Stevens' Oakwood Park Hennepin County,
Minnesota, which lies West of the East 111.50 feet thereof
Proposed Legal Description of Easterly parcel
That East 111.5 feet of Lot 9, Block 1, Stevens' Oakwood Park, Hennepin
County, Minnesota.
NOW, THEREFORE, BE IT RESOLVED that application for Waiver of Plat WVROI-2
is hereby approved, based on the following Findings of Fact:
1. That the lots meet the requirements for a waiver of plat.
BE IT FURTHER RESOLVED that application for Waiver of Plat WVROl-2 is
hereby approved based on the following conditions:

That Hennepin County accepts the waiver of plat.
That the.utility and driveway easements are recorded.

access will be replaced with curb and gutter.
All existing utilities to the rear lot must be located or relocated within the
