REZONING- WESTSIDE BUSINESS PARK
ProDosed Action.
Staff recommends the following motion: Move to adopt Resolution 01-58. approving
Ordinance 01-860. rezoning Westside Business Park from 1-1. Industrial. to Business Park
for first reading.
At.the Zoning and Planning meeting, Mr. Bartz moved and Mr. Rowan seconded a motion to
adopt Resolution 01-13, approving Ordinance 01-860, rezoning Westside Business Park from
1-1 to Business Park for first reading. The motion was approved unanimously.
Overview.
Westside Business Park is currently zoned 1-1, Industrial. The new Comprehensive Plan has
designated the site as Business Park. The City is required to have the Comprehensive Plan
and the zoning the same designation. This is the second property that will is considered to
be rezoned following the adoption of the new Comprehensive Plan. In the following months
there will be a few more zoning amendments. Overall within the City most of the parcels
have the same zoning and Comprehensive Plan designation.

Prima" Issues to Consider.
How has the Comprehensive Plan designated the subject site?
The new Comprehensive Plan has designated the site as Business Park. With the proposed
zoning change, the zoning and the Comprehensive Plan designation will be consistent.
What is the difference between the 1-1 and Business Park zoning?
The biggest difference between the I-I district and the business park district is the uses. The
majority of uses allowed in the business park district are office-type uses. In the Business
Park district there is also a limit on the amount of warehousing. The Business Park zoning
also has standards for the type of building that can be constructed.
· Should the site be rezoned to Business Park?
The state statute requires that the Comprehensive Plan and the zoning ordinance be
consistent. In the future, other properties within the City will be rezoned so the new
Comprehensive Plan designations and the zoning will be consistent.
· What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the reason for the rezoning. Ms. Anderson also stated that the owner
called and was opposed to the rezoning and will probably appear before the City Council
next Tuesday. No one appeared at the public hearing regarding this issue.
Mr. Bartz moved and Mr. Rowan seconded a motion to adopt Resolution RZOI-13,
recommending approval of Ordinance 01-860, rezoning Westside. Business Park from I-I,
Industrial, to Business Park.
Alternatives.
I. Approve the rezoning. By approving the rezoning, the site will be rezoned to Business
Park.
2. Deny the rezoning. By denying the rezoning, the site will not be rezoned to Business
Park. If the City Council considers this alternative, findings will have to be identified
that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION NO: 01-58
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING AN ORDINANCE REZONING WESTSIDE BUSINESS PARK
WHEREAS, an application for Zoning Amendment ZNO 1-6 has been made by the City of
Hopkins;
WHEREAS, the procedural history of the application is as follows:
1. That an application for zoning amendment was made by the City of Hopkins;
2. That the Hopkins Zoning and Planning Commission published notice, held a
public hearing on the application and reviewed such application on August 28,
2001: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered.
NOW, THEREFORE, BE IT RESOLVED that the application for Zoning Amendment ZNO 1-6
is hereby approved based on the following Findings of Fact:
1. That the rezoning is consistent with the Comprehensive Plan.
Adopted this 4th day of September 2001.

ORDINANCE NO. 01-860
AN ORDINANCE REZONING WESTSIDE BUSINESS PARK
THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS
FOLLOWS:
That the present zoning classification of I-I, Industrial, upon the following described
premises is hereby repealed, and in lieu thereof the said premises is hereby zoned as Business
Park.
Lots 10, 11, and 12, Block 52, West Minneapolis, according to the plat thereof on file or of
record in the office of the Register of Deeds in and for Hennepin County.
Those parts of the following described properties:
Lots 5 to 9 inclusive and Lots 13 to 16 inclusive, Block 52:
The vacated alley in Block 52 lying between extensions across it of the North and South lines of
said block; that part of the W est ~ of vacated 9th Avenue lying between extensions across it of
the North and South lines of Block 52; that part of the East Half of vacated 9th Avenue lying
between extensions across it of the North and South lines of Block 52; all in West Minneapolis,
according to the plat thereof on file or of record in the office of the Register of Deeds in and for
Hennepin County.
Lot 7, Auditor's Subdivision Number One Hundred Ninety Five (195), Hennepin County,
Minnesota.
Which lie southerly and southeasterly of a line described as follows:
Beginning at the intersection of the center line of 5th Street South and the center line of 7th
Avenue as dedicated in the recorded plat of West Minneapolis; thence westerly, along the
westerly extension of the center line of said 5th Street South, a distance of 127.00 feet; thence
westerly, a distance of 576.03 feet along a tangential curve concave to the south having a radius
of 835.19 feet and a central angle of 39 degrees 3 1 minutes 00 seconds; thence southwesterly, a
distance of 255.54 feet, along a compound curve concave to the southeast having a radius of
563.48 feet and a central angle of 25 degrees 59 minutes 00 seconds; thence southwesterly,
tangent to the last described curve, a distance of 176.85 feet; thence southwesterly, a distance of
209.78 feet, along a tangential curve concave to the northwest having a radius of 183.69 feet and
a central angle of 65 degrees 26 minutes 00 seconds and said line there terminating.
The above described property is subject to and easement for public road and right-of-way
purposes as described in Document No. 4039889, files of County Recorder, Hennepin County,
Minnesota.
