At our last discussion of this issue the City Attorney was ask to draft
language that would allow creation of a Council appointed Police Review
committee that could provide all the oversight in police department
discipline matters without the hindrance of delays in hiring carried over by
the ties to the Minnesota State Code requirements now experienced in the
Civil Service code.
Language that met those requirements was drafted by the City Attorney and
distributed to members of the Council, City staff, and each of the labor
organizations representing employees of the Police Department.
During review of that draft language it became apparent that the Council
did not have the ability to delegate that type of oversight review authority
under limitations of our City Charter and the Minnesota State Code.
Representatives of the employees bargaining units, the City Attorney, and
members of the City staff are expected to be present to discuss the
problems in setting up a Police Review Committee outside the boundaries
of state civil service code that would enjoy the oversight authority currently
granted to the Police Civil Service Commission. The employees of the
Police Department and the members of the Police Civil Service
Commission have been informed of the scheduled discussion and invited to
attend.
