PRELIMINARY PLAT - W ALGREENS
Proposed Action.
Staff recommends the following motion: Move to approve Resolution 2000-54. approving a
preliminary plat at the Hopkins House site.
At the Zoning and Planning meeting. Ms. Allen moved and Me, Thompson seconded a
motion to approve Resolution RZOO.13. recommending approval of a preliminary plat at the
Hopkins House site. The motion was approved unanimously,
Overview.
With the redevelopment of the Hopkins House site. the site will need to be platted. The site
is currently three lots, The former Union 76 gas station is a lot, there is a triangular-shaped
lot along Highway 7. and the Hopkins House is on third lot. With the platting. the Hopkins
House will be on one lot and the Walgreens on another lot.
Access to the sites will be from Rohinwood Lane, Fifth Street and 17th Avenue.

. Primarv Issues to Consider.
. What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is B-3, General Business. The Comprehensive Plan has
designated the site as commercial. The toning and the land use comply with the proposed
uses.
. Do the lots meet the zoning requirements?
A lot in the B-3 district is required to have a minimum size of 3,000 square feet. The lots
will meet the minimum lot size.
. What are the specifics of the plat?
The area will be divided into two parcels. The Hopkins House will be on one parcel and the
Walgreens will be constructed on the second.
. Does the proposed plat meet the subdivision requirements?
. The plat as proposed meets the subdivision requirements with the exception of the number of
sides for a lot for the Walgreens parcel. The applicant has applied for a variance.
. Have the State and County made comments on the proposed plat?
The state and county are required to review all plats that abut a state of county road. As of
the date of this report, the state and county have not made comments on the proposed plat.
. Will a park dedication fee be required?
A park dedication fee will be required.
. What was the discussion at Zoning and Planning?
Staff reviewed the need for the re-platting of the lots. There was no one that spoke at the
public hearing regarding this issue. John Kohler of Semper Development was at the meeting
to answer questions from the Commission.
Alternatives.
1. Approve the preliminary plat. By approving the preliminary plat, the applicant will be
able to plat the lots as proposed.
. 2. Deny the preliminary plat. By denying the preliminary plat, the Applicant will not be

. able to plat the property as proposed and not be able to construct the proposed Walgreens.
If the City Council considers this alternative, findings will have to be identified that
support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION NO: 2000-54
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A PRELIMINARY PLAT
WHEREAS, an application for Preliminary Plat SUBDOO-2 has been made by Semper
Development.
WHEREAS, the procedural history of the application is as follows:
1. That an application for a preliminary plat was made by Semper Development on June 23,
2000;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published
notice, held a public hearing on the application and reviewed such application on July 25,
2000: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
. 4. A legal description of the subject property is as follows:
Tract A, B, D. F. and G, Register Land Survey No. 1053 Files of Registrar of Titles. County of
Hennepin and Lot 2, Block 1, Union Oil Second Addition, Files of Registrar of Titles, County of
Hennepin, Minnesota and that part of vacated Robinwood Lane as platted in ROB INWOOD 5TH
ADDITION described as follows: commencing at the southeast comer of Outlot No.1. said
ROBINWOOD 5TH ADDITION; thence on an assumed bearing of North 01 degrees 42 minutes
41 seconds East along the easterly line of said Outlot No. 1 a distance of 337.22 feet to the point
of beginning of the land to be described; thence continuing North 01 degrees 42 minutes 41
seconds East a distance of 42.01 feet; thence North 44 degrees 04 minutes 19 seconds West a
distance of 13.95 feet; thence North 89 degrees 51 minutes 19 seconds West a distance of 102.21
feet; thence North 89 degrees 49 minutes 10 seconds West a distance of 18.52 feet to the
northerly line of Outlot No.1; thence southeasterly along the northerly line of Outlot No.1 18.70
feet along a non-tangential curve concave to the northeast having a radius of 74.47 feet a central
angle of 14 degrees 23 minutes 07 seconds and a chord which bears South 82 degrees 39 minutes
46 seconds East; thence South 89 degrees 51 minutes 19 seconds East along the northerly line of
said Outlot No.1 and tangent to last described curve a distance of 62.16 feet; thence southeasterly
along the northerly and easterly line of Outlot No.1 77.77 feet along a tangential curve concave
to the southwest having a radius of 48.66 feet a central angle of 91 degrees 34 minutes 00
seconds to the point of beginning.
. NOW. THEREFORE, BE IT RESOLVED that the application for Subdivision SUBD00-2 is
hereby approved based on the following Findings of Fact:

. 1. That the proposed plat meets the subdivision requirements of Minnesota statutes
and the Hopkins Code of Ordinances.
2. That the proposed lots meets the zoning requirements.
BE IT FURTIIER RESOLVED that application for Subdivision SOODOO-2 is hereby approved
subject to the following conditions:
1. That the conditional use. permit is approved and the applicant satisfies all
conditions and requirements for such conditional use permit for the construction
of the Walgreens.
2. That the conditional use permit is approved and the applicant satisfies all
conditions and requirements for such conditional use permit for the improvements
to the Hopkins House.
3. That the Applicant satisfies all conditions and requirements for and obtains final
approval of the plat of the subject property.
4. Applicant obtains the proposed irregular lot variance and satisfies all conditions
and requirements for such variance.
