ORDINANCE 2000-839, AMENDING SECTION 1170.01
OF THE HOPKINS CITY CODE
Proposed Action
Staff recommends adoption of the following motion: Move to adopt ordinance
2000-839 for first readinQ.
This will allow uniformity of the definitions of "Lodging House" within the City
Code.
Overview
.
This is a housekeeping matter. The City has adopted the 1998 Uniform Building
Code by reference. The code contains the definition of "Lodging House". Section
1170.01, Subd. 4 also defines "Lodging House". The two definitions are in
conflict. Ordinance 839 will change the definition in Section 1170.01, Subd 4 to
read the same as the 1998 Uniform Building Code.

The two definitions read as follows:
The Uniform Building Code:
LODGING HOUSE is any building or portion thereof containing not more than
five guest rooms where rent is paid in money, goods, labor or otherwise.
Section 1170.01, Subd.4:
"Lodging House" means every building or structure or any part thereof, kept,
used as, maintained as, advertised as, or held out to be a place where
sleeping accommodations are furnished to the public as regular roomers for
periods of one week or more and having five or more beds to let to the
public.
Which is the appropriate definition
.
The designations that are listed in the building code are Hotel, Motel, Lodging
House, and Apartment. Hotels and Motels have six or more guest rooms and do
not provide any cooking facilities. Apartments have to meet square footage
requirements and provide an area for cooking and eating. Staff feels that a Lodging
House would more appropriately fill the gap by referring to an old-fashioned
rooming house or Bed and Breakfast type of lodging. The definition that is given by
the Uniform Building Code refers to a rooming house or Bed and Breakfast type of
lodging, while the definition that is given in Section 1170.01 could as easily refer
to a Hotel.
Alternatives
1. Approve ordinance 839 for first reading
2. Continue the item for more information
3. Deny the change

OF THE HOPKINS CITY CODE
THE COUNCIL OF THE CITY OF HOPKINS DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. That section 1170.01, Subd. 4 be amended as follows:
