Staff recommends the following motion: Move to approve Resolution 2000-87. approving a conditional use permit to permit parking on the north side of Second Street N.E. At the Zoning and Planning meeting Mr. Ross moved and Mr. Szuba seconded a motion to approve Resolution RZOO-22, recommending approval of a conditional use permit to permit parking on the north side of Second Street N.E., with conditions as identified in the resolution. The motion was approved unanimously. Overview. In 1963, special use permits were approved for the parking areas used by Alliant Techsystems, north of Second Street N.E. This special use was granted for one year. No records of a renewal of the permit were found. Alliant Tech is in the process of selling the building and parking areas to CSM Investors IT, Inc. The City Attorney reviewed the history of the parking area and determined that Alliant Techsystems should apply for a conditional use permit to allow the existing parking areas. The three lots have 711 parking spaces. There are 399 parking spaces for the building on the . south side of Second Street N.E. The parking lots will remain basically the same. What is the zoning and of the property, and how has the Comprehensive Plan designated the subject site? The parking lots are zoned R-I-A and R-I-C. The Comprehensive Plan has designated the site as low density residential. Parking is allowed in residential districts with a conditional use permit. . What does the zoning ordinance allow? The Zoning Ordinance states the following: 530.09 Subdivision 1 f) Off-street parking for abutting B or I uses provided: 1. Such parking may be extended the width of three contiguous lots or 150 feet, whichever is more onto land that is zoned for residential use~ 2. The land is under the same ownership or control as the abutting B or I uses land which is to be served; 3. Said parking is not located between two existing abutting dwelling units subject to . conformance with parking lot standards in the code; 4. Such off-street parking shall not be allowed on any lot on which a dwelling is located at the time of application for the conditional use permit or on which a dwelling was located but has been removed by or on behalf ofthe applicant at any time prior to the date of the application for the conditional use permit; and 5. Such off-street parking shall otherwise be subject to the standards and requirements stated in Section 525.13 of these ordinances. The existing parking areas are three contiguous lots and are under the same ownership as the building to be served. . What are the specifics of the parking area? Sidewalk There is an existing sidewalk along Second Street; this sidewalk will remain. Access Access to the parking areas will remain the same. The orange lot has access from Jackson and Monroe Avenues, the blue lot from Van Buren and Jackson Avenues and the Yellow lot from Van Buren and Second Street N.E. . CR2000-000 Page 3 . Fencing The applicant will be constructing a four-foot solid fence between the residential property to the north and the parking lots. Landscaping There is existing landscaping on the yellow lot. This landscaping will remain. Surrounding uses The parking lots are surrounded by residential to the north and east, and industrial to the west and south. . What was the discussion at the Zoning and Planning meeting? Representatives from A1liant Tech and CSM appeared at the Zoning & Planning meeting. Alliant Tech will be moving in the fall of 2001. Several neighborhood representatives spoke; some were concerned about drainage, and most were not in favor of a fence. . Alternatives. 1. Approve the conditional use permit. By approving the conditional use permit, the applicant will be allowed to continue parking on the subject parking lots. 2. Deny the conditional use permit. By denying the conditional use permit, the applicant will not be allowed to have parking on the subject lots. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 2000-87 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE PERMIT TO PERMIT PARKING ON THE NORTH SIDE OF SECOND STREET N.E. WHEREAS, an application for Conditional Use Permit CUPOO-7 has been made by Alliant Tech and CSM Investors II, Inc.; WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit was made by Alliant Techsystems Inc. and CSM Investors II, Inc., on November 6,2000; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and . reviewed such application on November 28, 2000: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Lots 1, 2, 22, 23, and 24, Block 1; and Lots 1 and 2 except the west 25 feet thereof; and the east half or that part of Lot 3, lying east of the west 25 feet thereof; and Lots 23 and 24 except the easterly 25 feet thereof; Block 2, Stevens Oakwood Park. NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUPOO-7 is hereby approved based on the following Findings of Fact: 1. That the parking area is allowed in a residential zoning district; and 2. That the parking area meets the requirements for a conditional use permit. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUPOO-7 is hereby recommended for approval based on the following conditions: . 1. A landscaping plan shall be submitted and approved by staff for the north side of the subject property that abuts residential lots. The applicant shall provide a copy of this landscape plan to the owners of these properties for their review and comment; .--..--- . . 2. That if, at a future date, the owners of the abutting residential lots indicate that a fence is needed, the owner of the parking lot will construct a fence in accordance with a plan acceptable to staff; and 3.
