FIRST READING ADOPTION STATE BUILDING CODE
Proposed Action.
Staff recommends the following motion: Move to approve first reading
of ordinance number 2000-838 an ordinance ~ending section 400 of
the Hopkins City Code and adopting the latest edition of the State
Building Code.
Approval of this motion will approve a first reading of an ordinance
that will update the city's building code to the latest standards
required by State Statutes,
Overview.
Minnesota Statutes require that all communities that enforce a
building code use the State Building code. Communities cannot be
more or less restrictive than the State Code,
The State from time to time updates the code to incorporate the
latest edition of the Uniform Building Code and includes new State
e standards that take into account the latest building technology. The
State code was recently updated to include the 1997 Uniform Building
Code, The code must be adopted by the City to be properly enforced.
Included in the 1997 Uniform Building Code is an updated fee
schedule. This fee schedule will increase permit fees about 10%, The
city can modify this schedule, Hopkins Building permit fees have not
increased since 1995 and staff feels the new schedule is
appropriate.

AN ORDINANCE RELATING TO BUILDING, HOUSING AND CONSTRUCTION
REGULATIONS AMENDING SECTION 400 OF THE HOPKINS CITY CODE
BE IT ORDAINED by the Council of the City of Hopkins as follows:
SECTION 1, That Hopkins City Code is amended by revising Sections
400,03 to read as follows:
400,03 Adoption of Minnesota State Building Code, Subdivision
1.Building Code. The Minnesota Sate Building Code, one copy of
which is on file in the offices of the City Clerk, has been
adopted by Minnesota Statutes, section 16B,59 to 16.B75 as a
Uniform Building Code for the State. The State Building Code is
hereby confirmed as the building code of the city and is
incorporated in this chapter as completely as if set out in full.
Subd.2 Adoption by reference. The Harch 20th, -:l-9-9-5- 1998
edition of the Minnesota State Building Code, as amended, adopts
by reference certain codes, appendices, standards and supplemental
materials, The following codes, appendices, standards and
. supplemental materials are adopted by reference and incorporated
into this code as if fully set out at this point:
a) H94 1997 edition of the Uniform Building Code, identified as
"UBC" ; Minnesota Rules Chapter 1305;
b) 1993 1996 edition of the National Electric Code, identified
as "NEC" , Minnesota Rules Chapter 1315;
c) Elevators and related devices, Minnesota Rules Chapter 1307;

d) Minnesota Plumbing Code, Minnesota Rules, Chapter 1355, parts
4715.2860; 4715.3900-.4100;

Subd. 3. Building Official. For purposes of this chapter the term
"Building Official" means the city "Chief Building Inspector".
Subd. 4. Building Permits required. It is unlawful for any
person to perform any work regulated by this section without first
having obtained a license, if required, and a permit to do so, and
paid all the fees set out in Section 107, and Table 1-A 1997 of

I the Uniform Building Code.
. SECTION 2. That Hopkins City Code is amended by revising Sections
400.05 Plumbing by adding a new Subd. 4 to read as follows:
400.05 Plumbing
Subd.4. Fees Doubled. If a person begins any plumbing or
utility work for which a permit is required by this Chapter and
has not obtained a permit from the Building Official for such
work, the person shall, when subsequantly securing such permit,
pay double the fees required for such permit.
Section 3. The effective date of this ordinance shall be 21 days
after publication:
First Reading: February 1, 2000
Second Reading: February 15, 2000
Date of publication: February 23, 2000
Date Ordinance Takes Effect: March 15, 2000
