Second Reading of Ordinance 2000-838
Staff recommends that the Council approve the following motion: Move that the Hopkins
City Council approve Ordinance 2000-838 for second reading and order published.
This ordinance would adopt the latest state building code for Hopkins. The ordinance has not
changed since the first reading.
The City Council requested a comparison of the fee structure. Attached are the proposed fee
structure, from the 1997 Unifoffi1 Building Code, and the current fee structure, from the 1994
UnifOlID Building Code. The last time that the building permit fees were increased was 1995.
Below is a comparison of the fees based upon different project costs:

AN ORDINANCE RELATING TO BUILDING. HOUSING AND CONSTRUCTION
REGULATIONS AMENDING SECTION 400 OF THE HOPKINS CITY CODE
BE IT ORDAINED by the Council of the City of Hopkins as follows:
SECTION 1. That Hopkins City Code is amended by revising Sections
400.03 to read as follows:
400.03 Adoption of Minnesota State BULlding Code. Subdivision
1.Building Code. The Minnesota Sate Building Code, one copy of
which is on file in the offices of the City Clerk, has been
adopted by Minnesota Statutes, section 16B.59 to 16.B75 as a
Uniform Building Code for the State. The State Building Code 1S
hereby confirmed as the building code of the city and is
incorporated in this chapter as completely as if set out In full.
Subd.2 Adoption by reference. The H.:J.rch 20th, ~ 1998
edition of the Minnesota State Building Code, as amended, adopts
by reference certain codes, appendices, standards and supplemental
materials, The following codes, appendices, standards and
supplemental materials are adopted by reference and incorporated
into this code as if fully set out at this point:
a) ~ 1997 edition of the Uniform Building Code, identjfied as
"DEC"; Minnesota Rules Chapter 1305;
b) 1993 1996 edition of the National Electric Code, identified
as "NEC", Minnesota Rules Chapter 1315;

Subd. 3. Building Official. For purposes of this chapter the term
"Building Official" means the city "Chief Building Inspector".
Subd. 4. Building Permits required. It is unlawful for any
person to perform any work regulated by this section without first
having obtained a license, if required, and a permit to do so, and
paid all the fees set out in Section 107, and Table 1-A 1997 of
the Uniform Building Code.
SECTION 2. That Hopkins City Code is amended by revising Sections
tit 400.05 Plumbing by adding a new Subd. 4 to read as follows:

Subd.4. Fees Doubled. If a person begins any plumbing or
utility work for which a permit is required by this Chapter and
has not obtained a permit from the Building Official for such
work, the person shall, when subsequantly securing such permit,
pay double the fees required for such permit.
Section 3. The effective date of this ordinance shall be 21 days
after publication:

Tn instances where reinspection fees have been assessed, no
additional inspection of the work will be perfomled until the re-
quired fees bave been paid.
SECTION 109 - CERTIFICATE OF OCCUPANCY
109.1 Use and Occupancy. No building or structure shall be
used or occupied, and no change in the existing occupancy classi-
fication of a building or structure or portion thereof shall be made
until the huilding official has issued a certificate of occupancy
therefor as provided herein.
EXCEPTION: Group R. Division' and Group U Occupancies.
Issuance of a certificate of occupancy shall not be construed as
an approval of a violation of the provisions of this code or of other
ordinances of the jurisdiction. Certificates presuming to give au-
thority to violate or cancel the provisions of this code or otller ordi-
nances of tbe .jurisdiction shall not be valid.
109.2 Change in 11se. Changes in the character or use of a build-
ing shall not he made except as specified in Section 3405 of this
code.
109.3 CerUfieate Issued. After tbe building official inspects the
building or strudure and finds no violations of the provisions of
lhis code or other laws that arc enforced by the code enforcement
agency, the building official shall issue;] certificate of occupancy
that shall contain the following:

3. The name and addrcss of the owner.
4. A description of that portion of the building for which the
certificate is issued.
5. A statement that the described portion of the building has
been inspected for compliance with the requirements of this code
for the group and divisiou of occupancy and the usc for which the
proposed occupancy is classificd.
6. The name of the huilding olTicial.
109.4 Temporary Certificate. If the huilding official finds that
no substantial hazard will result from occupancy of any building
or portion thereofbcfore the same is comrle1ed, a temporary cer-
tificate of occupancy may be issued for the use of a portion or por-
tions of a building or structure prior to the completion of the entire
building or structure.
109.5 Posting. The certificate of occupancy shall be posted in a
conspicuous place on the premises and sball not be removed ex-
cept by the building official.
109.6 Revocation. The building official may, in writing. sus-
pend or revoke a certificate of occupancy issued under the provi-
siems of this code whenever the certificate is issued in error, or on
the basis of incorrect information supplied, or when it is deter-
mined that the building or structure or portion thereof is in viola-
tioll of any ordinance or regulation or any of the provisions of this
code.
