December 29, 1999 Council Report 2000-03 A RESOLUTION DECLARING A VACANCY IN THE HOPKINS CITY COUNCil Staff recommends approval of the following motion: Move to adopt resolution 2000-02, a resolution declarinq a vacancy in the Hopkins City Council. This action will allow the Council to move ahead with the appointment of a Council Member to replace the seat left vacant by Mayor Maxwell. Overview The City Charter requires that "the Council shall by resolution declare... a vacancy to exist and shall forthwith appoint an eligible person to fill the same. Primary Issues to Consider This resolution only declares the vacancy. It does not appoint. Declaration of the vacancy must be done before an appointment can be made. SUDDortinQ Documents · Copy of Section 2.05 of the City Charter . e e CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION 2000-02 RESOLUTION DECLARING A VACANCY ON THE CITY COUNCIL WHEREAS, Council Member Eugene Maxwell was elected to be the Mayor of the City of Hopkins on November 2, 1999, and; WHEREAS, Such election leaves Mr. Maxwell/s Council seat vacant and; WHEREAS, Section 2.05 of the Charter of the City of Hopkins provides that the City Council shall by resolution declare the Council seat vacant, NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Hopkins declares a vacancy on the Council. A vacancy occurs if an elected official dies, is convicted of a felony, is in violation of the official oath, resigns, ceases to maintain a legal residence in the City, fails to qualify for office, or fails, without good cause, to perform any of the duties of her or his office for a period of three months. In each such case the Council shall by resolution declare such a vacancy to exist and shall forthwith appoint an eligible person to fill the same. THE MAYOR Section 2.06. THE MA YOK Subdivision 1. The Mayor shall be the presiding officer of the Council and shall vote on all motions before the Council as any other member thereof. A president pro tempore shall be chosen by the full City Council at the first Council meeting in January after a municipal election. The president pro tempore shall serve as presiding officer in the Mayor's absence, and as Acting Mayor in case of the Mayor's disability or absence from the City. In cases where the Mayor and the President Pro Tempore are both absent, the Council Member, who has served the longest, shall perform as acting Mayor. Subdivision 2. The Mayor shall exercise all powers and perform all duties conferred and imposed upon her or him by this Charter, the ordinance of the City, and the laws of the State. The Mayor shall be recognized as the official head of the City for all ceremonial purposes, by the Courts for the purpose of serving all legal processes and by the Governor for the purposes of the martial law. The Mayor shall study the operations of the City govenunent and shall report to the Council any neglect, dereliction of duty or waste on the part of any official or department of the City. SALARIES Section 2.07. SALARlES. Subdivision 1. The Mayor and members of the City Council shall each receive an arumal salary as the Council may by ordinance establish in such amount as they deem reasonable. No change in such salaries shall take effect until after the next succeeding municipal election. The City Manager and all other employees of the City shall receive such salaries as from time to time may be fixed by the City Council. Subdivision 2. EXPENSES. The Mayor and Council Members shall be paid a reasonable sum for each day and/or their reasonable expenses incurred while traveling outside of the City on the City's business.
