Approve Hennepin County Process - County Road 73 & 5 Improvements
Proposed Action.
Staff recommends adoption of the following motion: Move that Council aoorove the
Hennepin County proposal to address City conditions throuah the desian and
construction aareement approval process. provided the County has approved a concept
design for future County Road 5 corridor enhancements.
Overview.
.
At the December 21, 1999 City Council meeting, Council adopted a resolution which
stated the goals, expectations and several design elements of the County Road 73/5
intersection improvement project. The resolution also directed that Hopkins staff
develop a written agreement with the City of Minnetonka and Hennepin County. A
proposed agreement was reviewed and approved with slight changes at the February 8,
2000 Council worksession. Staff has presented the proposed agreement to the City of
Minnetonka and Hennepin County staff. The County has responded that they would
prefer to proceed with project design without a written agreement. They contend that
the Cities of Hopkins and Minnetonka can ensure their interests are met through the
Council approval process. Each City Council must approve the project design and the
funding, as specified in a construction cooperative agreement, before the project could
proceed. Staff has no reason to believe that Hennepin County would jeopardize this
project by backing away from previous verbal agreements regarding intersection design.

conditions, as developed by the task force and adopted in Resolution 99-116, will be
met?
Staff believes that the conditions of the intersection design will be met. The design
elements can be reviewed during the design review/approval process. The condition
that there be no roadway lane additions or expansions along County Road 5 for at least
10 years could be included in the construction cooperative agreement.

However, the County proposal doesn't provide any degree of buy-in for future County
Road 5 enhancements. The City would have to propose at least concept corridor
improvements and receive County approvals before City Council approved the CSAH
73/5 intersection work. Staff intends to have Council consider a design services
agreement with BIKO Associates at the April 4 Council meeting. If approved, BIKO
could develop concept CSAH 5 corridor plans in time to seek a County commitment
before City Council is asked to approve the intersection project. As a part of their scope
of services, BIKO would work in concert with Hoisington-Koegler Group, the City of
Minnetonka consultant, regarding the corridor elements that need to be consistent
throughout and also meet with and receive comments from the neighborhood, city staff
and City Counci1.
. Staff Recommendation
Staff recommends that we accept the Hennepin County proposal, as described in Mr.
Grube's letter, but with the understanding that the City will be seeking County approval
of future County Road 5 corridor enhancements prior to Hopkins City Council approvals
on the Co. Rd. 73/5 intersection improvements. Staff recommends City Council direct
staff to send a letter reply stating such.

Dear Gentlemen:

Recently, Mr. Stadler presented to the City of Milmetonka and Hennepin County a proposed agency
agreement which outlines for the parties certain physical aspects of a proposed CSAH 5/CSAI-I 73
intersection improvement and identifies a means by which the parties may address the future
treatment of the CSAH 5 corridor. While the county shares the cities' desire to develop a meaningful
partnership to address the many issues which will affect the corridor development, the county
questions the use of an agreement as a means to address those issues.
Regarding the CSAH 5/CSAH 73 intersecTion improvement, the county believes the six stipulations
contained in the proposed agreement can, for the most part, be incorporated in the project design and
proposes the design proceed without a preceding agreement. As you are aware, both cities must agree
with the proposed design and an agreement must be developed which identifies cost participation
related thereto. This should provide necessary assurances that the county will be responsive to the
desires of the cities to the greatest extent possible.
As we consider the treatment of the CSAH 5 corridor, we need to realize that different interests will
affect the way we develop the corridor plan. For instance. Minnetonka is examining the way in
which redevelopment will impact the corridor. These dynamics may result in a philosophy which
differs from the Hopkins philosophy.
To properly address the interests of both cities and the county, it is proposed that we actively engage
in a partnership (of a form agreeable to all pmiies) which considers the many issues and how each
community addresses corridor treatment. While we will likely reach agreement that eGcl1 city can

need to be consistent (or at least complementary) throughout. County staff is prepared to participate
in the partnership and invites the cities to use this as a means of addressing the future of CSAII 5
rather than negotiating an agreement.

RESOLUTION NO. 99-116
COUNTY ROAD 73 AND MINNETONKA BOULEVARD IMPROVEMENTS
WHEREAS, the City of Hopkins recognizes the need for improvements to the intersection and
surrounding areas County Road 73 (Hopkins Crossroads) and County Road 5 (Minnetonka
Boulevard) by improving the conditions for pedestrians, bicyclists and motorists; and
WHEREAS, the needed improvements must reflect the concerns of both the travelling public
and the surrounding neighborhoods; and
WHEREAS, The City of Hopkins has been working with a task force to develop an acceptable
response and solution to the various concerns and goals; and
WHEREAS, the result of these efforts from all parties has identified a potential solution to the
concerns of all parties and the Hopkins City Council wishes to present a position statement reflecting
it's position and desire to continue toward improvements; and
WHEREAS, The City Council of the City of Hopkins believes that the proposed improvements
are generally in line with the goals and expectations of the City of Minnetonka and Hennepin Co.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Hopkins that the
. City of Hopkins supports improvements to the area near the intersection of Co. Rd 73 and Co. Rd 5
under the following conditions: -
1. That the intersection design closely follows the design elements as depicted on the Biko Assoc.
"Hennepin County Discussion Plan" which includes the following design elements:
a. Concrete Pavement with contrasting color and texture elements in the crosswalk and center
areas.
b, Intersection geometrics will include the configurations as shown with the understanding that a
future right turn lane in the west-bound Co. Rd 5 approach will be accepted if the overall
intersection level of service reaches a service level D.
c. Intersection lane widths and raised center medians are .constructed to the minimum State Aid
standards (11'). Raised medians wtll include landscaping as shown.
d. Non-standard decorative traffic control devices are utilized which are acceptable to the Cities
of Hopkins, Minnetonka, and Hennepin Co.
e. Street identification signage, which is placed prior to the intersection rather than attached to
the poles and/or mast arms. Attempts will be made to keep all signage off of tQe poles and
mast arms. If signage must be attached, it shall be minimal in size.
f. Landscape design elements that reflect the intended effect of improving the aesthetics of the
area.
g. Maintenance of the intersection will be the responsibility of Hennepin Co.

2. That Hennepin Co., City of Minnetonka and City of Hopkins agree to diligently pursue
enhancements to Co. Rd. 5 including:
.
a. Roadway improvements such as streetscape amenities, trails, landscaping, and defined
driving surface edges with the expectation of improving aesthetics and reducing speed
through Hopkins (35 mph preferred).
b. Creating a uniform, consistent speed along the Co. Rd. 5 corridor from Hwy 169 to Hwy 494.
c. An understanding that there will be no roadway lane additions or expansions for at least 10
years.
d. The improvements outlined in this section are to be considered an integral part of the approval
process from the City of Hopkins.
BE IT FURTHER RESOLVED,
1. That the Hopkins staff is directed to develop an agreement with Hennepin Co. and the City of
Minnetonka which will lead to the construction of the improvements.

MUTUAL AGREE:MENT
This Agreement is made and entered into by and among the City of Hopkins, 1010 First
Street South, Hopkins, Minnesota 55343 ("Hopkins"), City of :Minnetonka., 14600 Mlnnetonka
Boulevar~ Minnetonka, Minnesota 55345 ("Minnetonka") and County of Hennepin, 300 South Sixth
Street, :Minneapolis, Minnesota 55487 ("Hennepin").
RECITALS
1. The parties have engaged in a series of discussions to improve and upgrade the
intersection of County State Aid Highway (CSAH) 73 ("Hopkins Crossroads") and County State Aid
Highway (CSAH) 5 ("Minnetonka Boulevard") to provide for more efficient usage by and for
pedestrians, bicyclists and motorized traffic.
2. The parties through the use of an independent design consultant have initially agreed to
design elements depicted on a design provided by said consultant referred to as "Hennepin County
Discussion Plan".
3. The parties desire that an Agreement be provided setting forth acceptance of the aforesaid
design and outlining its implementation.
4. The parties desire that the intersection improvements be accomplished in conjunction with
approval of additional CSAH 5 corridor improvement plans.
5. Each of the parties have by resolution authorized acceptance and execution of this
Agreement and to undertake the designated steps necessary to fulfill its terms.

NOW, THEREFORE, the parties confirm the accuracy of and accept the recitals above set
forth and agree as follows:
A. The recitals above set forth are incorporated herein by reference. A final design plan for
construction purposes shall be undertaken by County by selecting and contracting with a designer to
provide for construction purposes the final plans and specifications in specific detail to complete the
improvement of the intersection.
B. County shall direct the designer thus selected to include, incorporate and adhere to the
initial design plan as much as may be practical from a construction standpoint including the following
elements:
1. Crosswalk and center intersection areas will consist of contrasting colored and
textured concrete pavement.

Intersection geometries will include a design provision for installation of a future right
turn lane in the westbound CSAH 5 approach if and when the service level of the
intersection attains a Service Level D.
111. Lane widths and the raised center medians of the intersection shall be constructed to
minimum State aid standards of 11 feet with raised medians landscaped as depicted
on the design plan.
iv. Non-standard decorative traffic signal devises shall be utilized, the precise models of
which shall be agreed to among the parties.
v. Placement of street identification signage upon poles or mast arms shall be avoided
wherever possible.
VI. Landscape design elements shall reflect the intended effect of improving and
enhancing the aesthetics of the area nature.
C. The final design plan shall be completed and delivered to the County by September 29,
2000 and thereafter submitted to the Cities for review, modifications, if any, and final approval by
all parties on or before November 30,2000. Following final approval by all parties of the design plan

and specifications for construction, the County shall prepare a construction schedule and commence
the bidding process. Construction is to occur in the year 2001.
D. The parties hereto understand that development and County approval of improvement
plans along the CSAH 5 corridor within the City of Hopkins are considered integral to
the City of Hopkins approval of the CSAH 73/CSAH 5 intersection improvements.
E. The parties agree that the Hopkins CSAH 5 corridor improvement plans will include
streetscape amenities. trails, landscaping, and other design elements with the expectation
of improving aesthetics and reducing speed through Hopkins to 35 mph.
F. The parties agree that a uniform, consistent speed along the CSAH 5 corridor from Hwy
169 to Hwy 494 is desirable and that Hennepin County 'Will attempt to obtain MnDOT
approval for a more uniform speed limit based on the benefits of consistency.
G. Hennepin County agrees to that there will be no CSAH 5 roadway lane additions or
expansions for at least 10 years from the date of this agreement.
E. It is further agreed by the parties that the City of Hopkins will provide a corridor
improvement plan to the County for review and approval by July 30,2000. The County
agrees to undertake final design and fund the agreed upon improvements, based on
existing County funding policies. within the current 5-year capital improvement plan.

Termination
The parties agree that this agreement shall terminate in 10 years or upon completion of the CSAH
5 corridor improvements and CSAH 73/5 intersection improvements, whichever occurs last.

Payment/funding
Project design and construction funding will follow normal Hennepin County funding policies. Final
funding/payment arrangements will be approved by the parties under separate construction
cooperative agreements. It is understood by all parties that these projects will be allowed to compete
for Hennepin County Roadside Enhancement Partnership Program funds.
