Prooosed Action.
Staff recommends adoption of the following motion: Move that Council Adoot

Overview.
The City Council at its regular November 19, 1996 meeting conducted a public
hearing concerning street improvements to First Street North from 5th Avenue to
17th Avenue. Council authorized the project to proceed allowing the preparation
of plans and specifications. City Council approved non-assessable 1997
residential street imfrovements to be included with the First Street North project
at its December 19 meeting., The approved 1997 - 2001 Capital Improvement
Plan includes a small storm sewer imJ;lrovement project for the north central
Hopkins area (2nd Street North at 16 ,18th and 19th Avenues). The three
projects are similar in nature (pavement milling, storm sewer construction, curb
work and new asphalt paving) and have been combined to be a single
construction contract with three bid schedules. Bolton & Menk, Inc. has
prepared the plans and specifications and staff now seeks authorization to
continue to the bidding phase.

. Assessment Change - Impact on Assessments
Staff has discovered that the existing assessment policy allows the assessment
on single family residential property to be reduced to 50% when a maior street is
improved. Major streets are defined as collector or thoroughfare streets. First
Street North is not labeled as a collector street in the Comprehensive Plan Major
Roadway plan. Further, the City intends to remove the State Aid designation
from all but four blocks of 151 Street. It is also possible the City may take other
measures in the future to reduce traffic on this street. Nevertheless, the street
carries significant traffic (ADT=3,600), functions as a collector, and is being
designed to a higher road capacity than a local street design. Therefore, staff is
proposing to lower the assessment on assessed single family property from 70%
to 50% of project cost. The policy states that the single family residential
property should abut the major roadway. However, staff believes the intent of
the policy is to allow the lower assessment rate for all assessed single family
property. The assessment rate for commercial property would remain at 70% of
project cost.
The impact of this change on the typical single family property with 50 foot
frontage is as follows:

. First Street North Project Scope and estimated costs
The scope of improvements on First Street North have not changed since the
November 19 Public Hearing. The improvements include:
. Reconstruct 10th - 12th Avenues maintaining the current street width
. Reconstruct 14th - 15th Avenues to current width
. Replace existing vertical curbing with new curb and gutter set to
proper slopes, mill and asphalt overlay street (5th - Sth Aves, 7th - 10th

6.03 It is not the intent of the State Aid Funding Program to totally finance the MSA system. Rather, it is
designed to assist communities with street construction projects in an effort to improve the roadway
system state wide. Therefore, when an MSA street is constructed or upgraded, assessments will be
levied in accordance with the policies for major streets. The assessment rate will reflect the benefit
conveyed by the improved design, additional width, and curb and gntter, and these rates will be set by the
City Council on recommendation of the Public Works Director.
7. MAJOR STREETS
7.01
Major streets are considered by the City of Hopkins to be collector and thoroughfare streets. Streets of
this variety generally service local traffic as well as traffic from other areas and therefore are designed in
accordance with standards of a higher road capacity. Major streets within the City of Hopkins are
constructed with a minimum capacity of 9 ton per axle. The primary source of funding for major
roadways is special assessments and MSA funds.
7.02 Major new and reconstructed streets shall be constructed with curb and gutter. Street width shall be
determined by existing conditions, traffic counts and patterns, and, if applicable, MSA standards.

10. ASSESSMENT POLICIES
10.01 When assessments are levied for roadway improvements, the assessment will be calculated in accordance
with the formulas set forth in the section on Assessment Formulas, using either the adjusted front foot
method or per lot unit method. The adjusted front foot method will be used for assessment purposes
unless the per lot/unit method is requested by petition by at least 55% of the assessed property owners
and/or it is determined that the affected lots have received equal benefits. The City Council shall have
fmal authority on the type of formula to be used.
10.02 The total project cost for streets constructed or reconstructed in any given project shall be equal to the
actual constru~tion cost, plus associated costs such as lega~ bonds, administrative and engineering.
10.03 When the city CONSTRUCTS A NEW LOCAL OR MAJOR STREET, 100% of the total project cost,
including all utilities, will be recovered by assessing the benefitting property for actual benefit received. A
new street shall be defined as a roadway including curb and gutter which had not previously existed.
10.04 When the city RECONSTRUCTS AN EXISTING LOCAL OR MAJOR STREET, 70% of the totai
project cost will be recovered by assessing the benefitting property for benefit received. The remaining
30% shall be absorbed by the city. A reconstructed street shall be defined as a roadway which existed
previously. The addition of curb and gutter when it did not previously exist is still considered
reconstruction.
10.05 When the city CONSTRUCTS OR RECONSTRUCTS AN ALLEY, 80% of the total project cost will
be recovered by assessing the benefitting property for benefit received. The remaining 20% shall be
absorbed by the city.
10.06 When major street construction or reconstruction is partially financed by State Aid Funds to improve the
design and capacity, the adjoining properties will be charged an assessment based on the cost of an
average street construction. The remainder to be paid by State Aid Funds or General Funds.
10.07 The following assessment policies will apply for existing single family property when a major street is
improved:
1.
Existing single family residential property abutting two or four lane divided median roads will be
assessed using the adjusted front footage method, based on 1/4 of the cost of a standard local
street as if built at the time of the assessment.
2. Existing single family residential property abutting two or four lane undivided roads will be
assessed using the adjusted front footage method, based on 1/2 of the cost of a standard local
street as if built at the time of the assessment.
10.08 Lots which are split subsequent to a roadway improvement project shall be assessed as if in existence at
the time the assessment was adopted, using the formula used at the time of assessment plus interest as
per current City policy from date of assessment.

RESOLUTION APPROVING PLANS AND SPECIFICATIONS
FIRST STREET NORTH IMPROVEMENTS, PROJECT 96-13;
STORM SEWER IMPROVEMENTS, PROJECT 96-17;
AND 1997 RESIDENTIAL STREET IMPROVEMENTS, PROJECT 96-18
AND AUTHORIZING ADVERTISEMENTS FOR BIDS
WHEREAS, pursuant to a resolution passed by the Council on November 19, 1996, plans and
specifications for improvements t6l First Street North from 5th Avenue to 17th Avenue (Project 96-
13) including street reconstruction, replacement of curb, installation of bituminous overlay and
stonn sewer/drainage improvements have been prepared by Bolton and Menk, Inc., and have
presented such plans and specifications to the Council for approval, and,
WHEREAS, it is beneficial to include Project 96-13, First Street North Improvements; Project 96-17,
Stonn Sewer Improvements; and Project 96-18; 1997 Residential Street Improvements into a
single contract bid package for advertisement and award, and,
WHEREAS, plans and specifications for Projects 96-17 and 96-18 have also been prepared by
Bolton & Menk, Inc. and have been presented to Council for approval.
NOW THEREFORE, BE IT RESOLVED by the City Council of Hopkins, Minnesota:
1. Such plans and specifications, a copy of which are attached hereto and made a part hereof,
are hereby approved and ordered placed on file in the office of the City Clerk.
2. The City Clerk shall prepare and cause to be inserted in the official paper and in the
Construction Bulletin an advertisement for bids upon the making of such improvement under
such approved plans and specifications. The advertisement shall be published three times,
at least three weeks before date set for bid opening, shall specify the work to be done, shall
state that bids will be received by the clerk until 10:00 a.m., on the 27th day of February,
1997, at the City Hall and that no bids shall be considered unless sealed and filed with the
clerk and accompanied by a certified check or bid bond, payable to the City of Hopkins,
Minnesota for 5% of the amount of such bid.
3. The clerk and city engineer are hereby authorized and instructed to receive, open, and read
aloud bids received at the time and place herein noted, and to tabulate the bids received.
The Council will consider the bids and award of contract at the regular City Council meeting
of May 20, 1997, in the Council Chambers.
