Staff recommends the following motion: Move to approve Resolution 97-13. approving a conditional use pennit to construct 64 townhomes on the vacant site north of St. Therese. At the Zoning and Planning meeting, Mrs. Boen moved and Mr. Gleeson seconded a motion to approve Resolution RZ97-2, recommending approval of a conditional use pennit to construct 64 townhomes on the vacant site north of St. Therese. The motion camed unanimously. Overview. The applicant, Stuart Nolan, is proposing to construct 64 townhomes on the vacant property just north of the St. Therese property on Feltl Court. The property is approximately nine acres and is zoned R-2, which allows townhomes. The townhomes will be placed between the two heavily wooded hills on the site. There will be six buildings consisting of 32 one-bedroom and 32 two-bedroom townhomes. The townhomes will be rental and will not have basements. The site is a difficult to development because of the hills and the wetlands. The hills on the site are on the official map and are protected from development. The site is allowed a density of 112 units with the R-Z zoning. Primary Issues to Consider. o What are the properties zoned and what has the Comprehensive Plan guided the site? o What are the specifics of the development? o What was the discussion at the Zoning and Planning meeting? Anderson, A1CP Planner CR97-26 Page 2 Primary Issues to Consider. o Wbat is tbe zoning of the property, and how has the Comprehensive Plan designated the subject site? The site is zoned R-2, Low Density Multiple Family, and the Comprehensive Plan has designated the site as Medium Density Residential. The zoning and the Comprehensive Plan designation comply with the proposed development. o What are the specifics oftbe development? Landscaping The site will retain the vegetation on the hills. The site is required to have 146 trees. The Zoning Ordinance allows that existing vegetation is counted towards the required trees. The site has more than the number of trees required with the existing vegetation. The site plan shows additional plantings at the fronts of the buildings. The buildings will have two feet of rock and edging around the buildings. There will be two retaining walls on the site, one on the east side and one on the west side. The retaining walls will be Keystone retaining walls. Irrigation All of the landscaped areas will be irrigated. Engineering The engineering department has reviewed the proposed plans and found them acceptable with the conditions outlined in the resolution Utilities are available in Felt! Court. The site will have two retaining ponds in the center of the site. Nine Mile Watershed District will have to approve the proposed development. There is a slight possibility that because of the watershed district review the site plan may change. If this occurs, the Planning Commission will review the changes at a future meeting. . Fire marshal The fire marshal has reviewed the proposed plans and found them acceptable with two comments. The fire marshal noted that the townhomes will have to be sprinkled. Also, the fire truck turnaround will have to be modified. The fire marshal has spoken to the architect regarding modifYing the turnaround, which can be done. CR97-26 Page 3 Parking The Zoning Ordinance requires two spaces for each unit. The site plan indicates a one-stall garage for each unit plus a parking space in front of the garage. These parking spaces will meet the parking requirements. In addition to this parking there will be an additional 18 spaces with the detached garages and 46 surface parking spaces. Trash Each unit will be responsible for its own trash. Access There will be two access points to the site from F eltl Court. Felt! Court is a cul-de-sac street which serves only St. Therese and this proposed development. Exterior The exterior is proposed to be vinyl siding, aluminum trim and brick. Lighting There will be two light poles in the parking area to illuminate the site. Also, the individual townhomes will have lights on the garages. Signage The site plan indicates a site identification sign along Felt! Court. A sign up to 60 square feet is allowed with a conditional use pennit. The ordinance requires a 25-foot setback. The site plan indicates approximately a l4-foot setback. The sign will have to be moved to allow for the 25-foot setback. CR97-26 Page 4 o What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed development with the Commission. Stuart Nolan appeared before the Commission. Mr. Nolan presented a colored elevation and reviewed the exterior treatments with the Commission. Mr. Nolan stated that the rents would be approximately $850-$1300. Mary Beth Davis from St. Therese appeared before the Commission. Ms. Davis was concerned about the speed of the traffic on Feltl Court. Discussion followed regarding the speed on Felt! Court. It was suggested that speed limit signs be erected on Felt! Court. The staff will contact Public Works regarding putting up speed limit signs. Alternatives. I. Approve the conditional use pennit to construct 64 townhomes. By approving the conditional use permit to construct 64 townhomes, the applicant will be able to construct the townhomes as proposed. 2. Deny the conditional use pennit to construct 64 townhomes. By denying the conditional use pennit to construct 64 townhomes, the applicant will not be able to construct the townhomes as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. That an application for a conditional use pennit was made by Stuart Nolan on January 24, 1997; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on February 25, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Lot 1, Block 1, Opus 2 Ninth Addition NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Pennit CUP97-1 is hereby approved based on the following Findings of Fact: 1. That the proposed development meets the requirements for a conditional use pennit. 2. That the proposed development meets the zoning requirements. BE IT FURTHER RESOLVED that application for Conditional Use Pennit CUP97-l is hereby approved based on the following conditions: 1, That the Engineering Department approves the final stormwater, drainage and grading plan. 2. That Nine Mile Watershed District approves the proposed development. 3. That the site identification sign has a 2s-foot front yard setback. 4. That the fire truck turnaround is modified and approved by the fire marshal. 5. That townhomes will be sprinkled if required by the fire marshal. 6, That there is an agreement with the applicant and the City regarding the maintenance and access of the N.U.R.P. pond. .. 7.
