TRANSFER OF PROPERTY TO HRA
Pro Dosed Action
Staff recommends the following motion be approved: Adopt Resolution 97-22. transferring
certain City-owned properties located at the northeast corner of Eighth and Mainstreet to the
liRA subiect to the nroiect proceeding in accordance with the development agreement dated
February 12. 1997.
Overview
The Hopkins lIRA has entered into a development agreement with JeffKakach for the
redevelopment of certain properties at the northeast corner of Eighth Avenue North and
Mainstreet. The public property that will be part of this project is owned by both the HRA and
the City. The City-owned property, which consists of two lots, was previously occupied by the
old City Hall.
The development agreement states that the lIRA will sell all the publicly-owned property in the
project area to the developer for $1. A public hearing has been scheduled for April 1 to consider
this sale; however, prior to the this transaction being completed, the City needs to transfer
ownership of its property to the lIRA for $1.
Primary Issues to Consider
o What action will take place if this project did not proceed?
The subject action is conditioned on the project proceeding. If this does not take place, the
transaction transferring the property to the lIRA would not be completed.

RESOLUTION NO. 97-22
A RESOLUTION APPROVING THE CONVEYANCE OF REAL PROPERTY TO THE
HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE
CITY OF HOPKINS
WHEREAS, the City of Hopkins (the "City") holds fee title to certain real property located
at the northeast comer of Eighth Avenue and Mainstreet in the City of Hopkins, Hennepin CoUnty,
Minnesota, legally described in Exhibit A attached to and incorporated in this Resolution (said real
property being hereinafter referred to as the "Property"). The Property is adjacent to other real
property (the "HRA Property") owned by the Housing and Redevelopment Authority in and for the
City of Hopkins (the "HRA").
WHEREAS, the HRA has entered into a Purchase and Development Agreement dated
February 12, 1997 (the "Development Agreement") with Jeff L. Kakach (the "Redeveloper")
whereby the HRA has agreed to transfer the Property and the HRA Property to the Redeveloper for
the purpose of redevelopment. The City intends to transfer the Property to the HRA for no
consideration for the purpose of facilitating the redevelopment of the Property and the HRA Property
by the Developer.
WHEREAS, the City Council of the City of Hopkins makes the following Findings of Fact
regarding the transfer of the Property to the HRA:
1. The conveyance of the Property to the HRA will serve the purpose of aiding and
cooperating in the planning, undertaking, construction, or operation of a project of the HRA, namely
the redevelopment of the Property and the HRA Property in accordance with the Development
Agreement.

2. It is in the interest of the City to transfer the Property to the HRA without
consideration for the purpose of the aiding such HRA project.
3. The proposed conveyance of the Property to the HRA has no relationship to the City's
Comprehensive Plan and, thus, requires no prior approval by the Zoning and Planning Commission.
NOW, THEREFORE, based upon the foregoing Resolutions and Findings of Fact, it is
hereby resolved by the City Council of the City of Hopkins that the Property described in Exhibit
A attached to this Resolution be transferred to the HRA without consideration, and the Mayor and
City Clerk are hereby authorized, directed and empowered to execute and deliver all documents
required to transfer the Property to the HRA.
