Staff recommends the following motion: Move to anorove Resolution 97-32 aporoving Ordinance 97-800 vacating alleys on the northeast corner of Mainstreet and 8th Avenue for first reading. At the March 25 Zoning and Planning meeting, Mr. Blair moved and Ms. Boen seconded a motion to approve Resolution RZ97-5, recommending approval or Ordinance 97-800, vacating alleys on the northeast corner of Mainstreet and 8th Avenue. The motion was approved unanimously. Overview. The applicant, JeffKakach, is proposing to construct two buildings on the northeast corner of Mainstreet and 8th Avenue. In conjunction with this development, the applicant is requesting to vacate parts of the alleys that abut the proposed development. The east-west alley will be vacated in the area that abuts both Lots, 1 and 2. Lot, 1 and 2 will each get one-half of the alley. The north-south alley will be vacated in the area that abuts Lot 1. Lot 1 will get the west side of the alley, and Rudy Luther will get the east one-half The applicant has also applied for a conditional use permit to construct the buildings and for a preliminary and final plat. The Public Works department has reviewed the proposed vacation and determined the alleys are not needed for the public use. However, the Public Works department is concerned about plowing the remaining east-west alley. They are recommending that a condition is added that the applicant provide an easement so that the City vehicles can continue on the applicant's property when plowing. If this easement is not granted, in reality there will be a dead end for the snow plows, with no cul-de-sac. The City is looking into the possibility of vacating the remaining east-west alley in the future. o Are there utilities in the alleys? There are utilities located in the alleys. The applicant will be required to grant the City and utility companies' easements for the utilities. The utility companies have been notified of the proposed vacation. As of the date of the report the City has received a response Minnegasco and NSP have responded to the notification regarding the vacation. NSP is requiring an easement for overhead lines. o What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed alley vacation. Roman Roos, representing the applicant, appeared before the Commission. The Commission asked were the lot line separating the two lots will be. Mr. Roos stated the lot line separating the two lots is down the center of the alley. Alternatives. 1. Approve the alley vacation. By approving the alley vacation, the alleys will be vacated for the proposed development. 2. Deny the alley vacation. By denying the alley vacation, the alleys will not be vacated for the proposed development. If the Planning Commission considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 97-32 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A VACATION OF THE ALLEYS BEHIND THE NORTHEAST CORNER OF 8TH AVENUE AND MAINSTREET WHEREAS, an application for Vacation V AC97-1 has been made by JeffKakach, and WHEREAS, the procedural history of the application is as follows: 1. That an application for Vacation VAC97-l was made by Jeff Kakach on February 21, 1997; 2. That the Hopkins Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on March 25, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of the City staff were considered; and 4. A legal description of the subject property to be vacated is as follows: That part of the East-West alley in Block 66, WEST MINNEAPOLIS SECOND DIVISION, Hennepin County, Minnesota, which lies East of the west line of said Block 66, extended across said alley, and which lies West of the southerly extension of the West line of Lot 6; and, That part of the North-South alley in Block 6, WEST MINNEAPOLIS SECOND DIVISION, Hennepin County, Minnesota which lies North of a line from the southeast corner of Lot 13 to the southwest corner of Lot 6, and which lies Southerly of a line from the northwest corner of said Lot 6 to the northeast corner of Lot 16. NOW, THEREFORE, BE IT RESOLVED that application for Vacation VAC97-1 is hereby approved, based on the following Findings of Fact: 1. That the alleys are not needed for a public right-of-way. BE IT FURTHER RESOLVED that application for Vacation V AC97 -1 is hereby approved based on the following conditions: 1. That the conditional use permit is granted for the construction of the proposed development. 2. That the property is granted the preliminary/final plat. Page 2 3 That the applicant grant the City and utility companies an easement for any utilities located in the vacated alleys. 4. That the City is granted a maintenance vehicle easement to allow City trucks to travel unimpeded on the vacated east-east alley. 5. That the vacated east-west be kept clear of any obstructions which would restrict or hamper City vehicle travel - see item 4. Adopted this 1 st day of April 1997. By Charles D.
