Staff recommends the following motion: Move to approve Resolution 97-36. approvin~ a preliminary/final plat at the northeast comer of 8th and Mainstreet. At the March 25, Zoning and Planning meeting, Mr. Gross moved and Mr. Blair seconded a motion to approve Resolution RZ97-6, recommending approval of a preliminary/final plat at the northeast comer of 8th and Mainstreet. The motion was approved unanimously. Overview. The applicant, JeffKakach, is proposing to develop the northeast comer of 8th Avenue and Mainstreet. With this development, the property will be re-platted into two lots. Lot 1 will be located on the north side of the existing east-west alley. Lot two is the lot on Mainstreet. The Lot 1 building is proposed to be used by an architectural firm. The Lot 2 buildings will have Glenrose Floral as a tenant and probably two smaller retail uses. The applicant has also applied for a conditional use permit and to vacated parts of the north-south and east-west alleys. Primarv Issues to Consider. o Does the proposed plat meet the zoning requirements? o Does the proposed plat meet the subdivision requirements? o Is a park dedication fee required? o What was the discussion at the Zoning and Planning meeting? Lots 1 and 2 are zoned B-3, General Business. The zoning of the properties will not change. Both lots will meet the minimum lot requirements. o Does the proposed plat meet the subdivision requirements? The plat as proposed meets the subdivision requirements. o Is a park dedication fee required? A park dedication fee is not required, because no additional lots are created. o What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the whole development with the Commission. Roman Roos representing the applicant appeared before the Commission. Mr. Roos stated that the buildings will be platted on individual lots so that at a future date someone could buy one building. Alternatives. 1. Approve the preliminary/final plat. By approving the preliminary/final plat, the applicant will be able to construct the proposed development as proposed. 2. Deny the preliminary/final plat. By denying the preliminary/final plat, the applicant will not be able to construct the development as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 97-36 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A PRELlMINARYIFINAL PLAT FOR THE NORTHEAST CORNER OF MAINSTREET AND 8TH AVENUE WHEREAS, an application for a preliminary/final plat, SUBD97-1, has been made by the City of Hopkins; and WHEREAS, the procedural history of the application is as follows: 1. That an application for preliminary/final plat SUBD97-1 was made by Jeff Kakach on February 21, 1997; 2. That the Hopkins Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on February 21, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of the City staff were considered. NOW, THEREFORE, BE IT RESOLVED that the preliminary/final plat SUBD97-1 is hereby for approved, based on the following Findings of Fact: 1. That the preliminary/final plat meets the requirements of the subdivision ordinance. BE IT FURTHER RESOLVED that application for a preliminary/final plat SUBD97-1 is hereby approved based on the following conditions: 1. That the conditional use pennit is granted to construct the buildings on the northeast comer of Main street and 8th Avenue. Adopted this 15th day of April 1997. By Charles D.
