CONDITIONAL USE PERMIT SIGNS-- THE OAKS OF MAIN STREET
Pro Dosed Action.
Staff recommends the following motion: Move to aoprove Resolution 97-48. approving a
conditional use permit to allow more signage for The Oaks of Main street.
At the Zoning and Planning meeting, Ms. Boen moved and Mr. Blair seconded a motion to
approve Resolution RZ97-7, recommending approval of a conditional use permit to allow more
signage for The Oaks of Main street. The motion carried unanimously.
Overview.
The applicant, Real Estates Equities, is proposing to erect five signs for The Oaks of Mainstreet
townhomes. The Zoning Ordinance allows one 12-square-foot sign for residential developments;
however, with a conditional use permit, more signage is allowed.
The applicant is proposing to attach the signs to the fence, The applicant has applied for a
variance to allow the proposed signs in the setback area,

Primarv Issues to Consider.
o What does the zoning ordinance allow for additional signage with a conditional use
permit?
570.46, Conditional Use Permit R-Districts. Signs may be permitted by conditional use
permit for public parks and playgrounds, churches, synagogues, public libraries, public
museums, public and parochial schools, municipal buildings, golf courses, country clubs,
apartment buildings, nursing homes, community centers, colleges, universities and private
schools, hospitals, and sanitariums, based on the following design criteria and other
conditions the City Council may require:
a) size: the size shall be proportional to the size of the facility, need for signing
frontage on street(s), location, visibility, and development in the area. The
maximum size should not exceed 60 square feet per sign surface with a maximum
area of 120 square feet per single sign,
b) height: no free-standing sign shall exceed fifteen feet in height.
c) lighting:
1) lighting shall be indirect or it shall be backlit
2) neon light, flashing lighting, andlor rotating lighted signs shall be prohibited
d) design: signs attached to the building shall be integrated with the building design
and architecture in terms of materials, colors, lighting and placement; signs not
attached to the buildings shall be architecturally treated and coordinated with the
principal building by use of compatible materials and design.
e) location: no free-standing signs shall be located less than 25 feet from any street
right-of-way line,
1) sign purpose: the principal purpose of the sign permitted under this section shall
be to identifY the public or institutional use made of the property.
The proposed signs meet all of the above requirements except for the 25-foot setback.
o What are the specifics of the proposed signs
The applicant is proposing five signs, all mounted on the fence. Four will be located on
Mainstreet: two by the entrance, one on the comer of Mainstreet and Shady Oak Road,
and one on Mainstreet and 19th Avenue. The fifth sign will be located on the southwest
side of the site. The signs will be 3' }O" x 4' 6", The applicant has requested a variance to
allow the signs within the 25-foot setback.

o What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed signage. Keith Jans, the applicant, appeared before
the Commission. Mr. Jans brought a mock-up of the proposed signage. Mr. Jans stated
that because of the location of the site that one sign was not enough. No one spoke at
the public hearing.
Alternatives.
1. Approve the conditional use permit for more signage, By approving the conditional use
permit for more signage, the applicant will be able to erect the number of signs as
proposed.
2. Deny the conditional use permit for more signage. By denying the conditional use permit
for more signage, the applicant will not be able to construct the signage as proposed. If
the City Council considers this alternative, findings will have to be identified that support
this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT
AND APPROVING A CONDITIONAL USE PERMIT
TO ERECT SIGNS FOR THE OAKS OF MAINSTREET TOWNHOMES
WHEREAS, an application for Conditional Use Pennit CUP97-4 has been made by Real Estate
Equities, and;
WHEREAS, the procedural history of the application is as follows:
1. That an application for Conditional Use Pennit CUP97-4 was made by Real Estate
Equities on February 21, 1997;
2. That the Hopkins Planning Commission, pursuant to mailed and published notice, held a
public hearing on the application and reviewed such application on April 29, 1997: all
persons present were given an opportunity to be heard;
3. That the written comments and analysis of the City staff were considered; and
4. A legal description of the subject property is as follows:
Parcel 1:
That part of the Southeast Quarter of Southeast Quarter of Section 23, Township 117,
Range 22 described as follows:
Commencing at a point in a line parallel to and 660 feet West at right angles from
the east line of said Subdivision which point is 689.3 feet measured along said line
Northerly from the intersection of said line with the Northerly line of the
right-of-way of the Chicago Milwaukee and St, Paul Railroad Company; thence
West at right angles 291 feet to the point of beginning of the tract to be described;
thence continuing West 382,6 feet more or less to the West line of said
Subdivision; thence North to the Northwest comer of said Subdivision; thence
East along the North line thereof; thence East along the North line thereof to an
intersection with a line drawn from the actual point of beginning parallel with the
East line of said Subdivision; thence South along said parallel line to the point of
beginning.
Parcel 2:

approved based on the following conditions:
1. That the setback variance is granted,
