FINAL PLAT--NINE MILE COVE
Prooosed Action.
Staff recommends the following motion: Move to aoprove Resolution 97-50. approving a final
plat for Nine Mile Cove,
At the Zoning and Planning meeting, Mr. Brausen moved and Mr. Gross seconded a motion to
approve Resolution RZ97-9, recommending approval of a final plat for Nine Mile Cove. The
motion carried unanimously.
Overview.
The applicant has been approved to construct 62 detached townhomes on the former Minneapolis
Floral site. The units will appear as single family homes but have the advantages of townhomes
with respect to the upkeep of the units and the ground keeping. The applicant is proposing to
sell the units at a price range of $250,000 to $300,000.
The applicant is platting the property in phases. The first phase will consist of 32 lots. The
remaining buildable area will be outlots A and C.
The applicant has also received a rezoning of the property to P.U.D.

Primarv Issues to Consider.
o Does the proposed plat meet the zoning requirements?
The entire parcel is proposed to be rezoned as P.U.D., Planned Unit Development. A
P.U.D. zoning allows for flexibility in the zoning standards. The density is less than the
existing zoning ofR-2.
The following are the typical lot setbacks:
front yard
side yard
rear yard
ten feet
five feet
25 feet
The engineering department has reviewed the proposed final plat and has found it
acceptable.
o Does the proposed plat meet the subdivision requirements?
The only requirement the proposed plat does not meet is that one cul-de-sac is more than
500 feet. The P.U.D, zoning allows flexibility with the requirements. The City road into
the project will have the right-of-way increased to 60 feet.
o What is the access into the site?
The only access into the site will be from Second Avenue South. The developer will be
paying for the extension of Second Avenue South.
o Is a park dedication fee required?
A park dedication fee is required. Each unit will be required to pay $200.00.
o What was the discussion at the Zoning and Planning meeting?
Ms. Anderson stated that approval of the final plat is necessary for the development to
proceed. The final plat is basically the same as the preliminary plat. No one spoke at the
public hearing.
Alternatives.
1. Approve the final plat at the former Minneapolis Floral site. By approving the final plat,
the final plat will be approved and be able to be filed at Hennepin County.
2. Deny the final plat at the former Minneapolis Floral site. By denying the final plat, the
applicant will not be able to file the plat at Hennepin County and the townhome

development will not be able to proceed. Ifthe City Council chooses this alternative,
findings will have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued,

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A FINAL PLAT FOR NINE MILE COVE
WHEREAS, an application for a final plat SUBD97-2 has been made by Taurus Properties;
WHEREAS, the procedural history of the application is as follows:
I. That an application for a final plat was made by Taurus Properties on March 28, 1997;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held
a public hearing on the application and reviewed such application on April 29, 1997: all persons
present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the subject property is as follows:
That part of the Northeast Quarter of the Southeast Quarter of Section 25, Township 117 North,
Range 22 West of the 5th Principal Meridian described as follows:
Commencing at the northeast comer of the Southeast Quarter of said Section 25; thence South 00
degrees 46 minutes 37 seconds, West, assumed bearing along the east line of said Southeast
Quarter of Section 25, a distance of 1132,12 feet; thence South 85 degrees 15 minutes 56 seconds
West, a distance of 637.05 feet; thence North 00 degrees 46 minutes 37 seconds East, a distance
of 769.84 feet to the south line of Registered Land Survey No. 939; thence South 88 degrees 13
minutes 00 seconds West along the south line of said Registered Land Survey No. 939 and its
westerly extension a distance of 724,29 feet to the west line of said Northeast Quarter of the
Southeast Quarter of said Section 25; thence South 00 degrees 03 minutes 20 seconds West along
the west line of said Northeast Quarter of the Southeast Quarter of Section 25 a distance of

degrees 15 minutes 56 seconds West, a distance of 72.08 feet; thence South 00 degrees 46
minutes 37 seconds West, a distance of 66.24 feet to the south line of the Northeast Quarter of
the Southeast Quarter of said Section 25; thence West, along said south line of the Northeast
Quarter of the Southeast Quarter of Section 25 a distance of 695.73 feet to the southwest corner
of said Northeast Quarter of the Southeast Quarter of Section 25; thence North, along the west
line of said Northeast Quarter of the Southeast Quarter, a distance of 490.42 feet to the point of
beginning,
TOGETHER WITH:
That part of the North Half of the Southeast Quarter of the Southeast Quarter, Section 25,
Township Range 22, lying west of the East 650,98 feet thereof, Hennepin County, Minnesota.
NOW, THEREFORE, BE IT RESOLVED that the application for a final plat SUBD97-2 is
hereby approved based on the following Findings of Fact:
1. That the final plat meets the subdivision requirements with the P,D.D. zoning.
