Staff recommends the following motion: Move to approve Resolution 97-51. ao\>roving a conditional use permit to operate an auto towing business at 149 Jackson Avenue. At the Zoning and Planning meeting, Mr. Brausen moved and Ms. Boen seconded a motion to approve Resolution RZ97-1O, recommending approval of a conditional use permit to operate an auto towing business at 149 Jackson Avenue. The motion carried unanimously, Overview. The applicant, Schmit Towing, is proposing to operate an auto towing business at 149 Jackson Avenue. The Zoning Ordinance requires a conditional use permit if a use is not conducted totally within a building. The subject building is the former Precious Metal building, which partially collapsed this past winter. The existing building will be used as the business office, dispatching area, vehicle maintenance area and truck storage area. The applicant will also own the home to the south and plans to continue the use as rental property, In the future, the applicant hopes to expand the business to this property. Primarv Issues to Consider. o What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? o What are the specifics of the applicants operation? o What was the discussion at the Zoning and Planning meeting? Documents, o Analysis ofIssues o Site Plan o Resolution 97-51 CR97-83 Page 2 Primary Issues to Consider. o What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The subject property is zoned 1-2, General Industrial. The Comprehensive Plan has designated the site as industrial. o What are the specifics ofthe towing operation? Landscaping There is existing landscaping on the site. The existing landscaping is along Second Street and the corner of Jackson and Second, The zoning ordinance does not require additional landscaping on the site. Public Works The Public Works department has reviewed the site plan. They noted that the parking area will have to have curb and gutter, The applicant was notified of this and will add curb and gutter to the parking area. Also, Minnehaha Watershed District will have to approve the site plan. The applicant has been informed of the watershed approval needed. Fencing The fence surrounding the site will be an eight-foot privacy fence, The gate on the east side will be a chain link sliding fence. The chain link gate will have slats. The applicant at the Planning Commission meeting, agreed to improve the appearance of the fence on the west and south sides, The fence on these sides will be similar to the fence on Excelsior Boulevard. An example of the fence is included in this report, Parking The parking area will be completely paved. The parking area will be used for the parking of personal vehicles, winter storage of vehicles, and storage of impounds. Access Access to the fenced parking area will be from the east side alley. The site plan indicated two entrances, one gate will be a swing gate and the second a sliding gate. Exterior The exterior of the building will remain the same, The house and garage will be painted, CR97-83 Page 3 Surrounding uses The site is surrounded by AIliant Tech on the north, south, and east and industrial uses to the west. o What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed improvements to the site. Stephen and Betty Schmit, the applicants, appeared before the Commission, The Schmits reviewed the proposed improvements with the Commission. Mr. Schmit stated that the lot would hold 25 cars. He also stated that they do not tow many junk cars; the only junk car that may be on the site is an abandoned car from an apartment complex. The majority of the cars they tow go to auto repair businesses. The Commission was concerned with cars being pushed into the fence. Mr. Schmit stated that they will construct steel posts with a steel bar on the interior of the fence so this will not occur. The Commission asked the Schmits if they would upgrade the fence. The Schmits stated they would be in favor of upgrading the fence on the west and south sides of the site. The Commission found this acceptable. The fencing on the west and south sides will be the same as the fence along Excelsior Boulevard. No one in the audience spoke at the public hearing. Alternatives. 1. Approve the conditional use permit to operate an auto towing business at 149 Jackson Avenue. By approving the conditional use permit, the applicant will be able to construct the storage lot as proposed, 2. Deny the conditional use permit to operate an auto towing business at 149 Jackson Avenue. By denying the conditional use permit, the applicant will not be able to construct the storage lot as proposed, If the Planning Commission considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued, CITY OF HOPKINS Hennepin Connty, Minnesota RESOLUTlONNO: 97-51 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE PERMIT TO OPERATE AN AUTO TOWING BUSINESS AT 149 JACKSON WHEREAS, an application for Conditional Use Permit CUP97-5 has been made by Schmit Towing; WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit was made by Schmit Towing on March 27, 1997; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on April 29, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. A legal description of the subject property is as follows: Lots 24, 25, 26 and the north 10 feet of Lot 23, Block 3, West Minneapolis Center Addition. NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUP97-5 is hereby approved based on the following Findings of Fact: 1. That the proposed development meets the requirements for a conditional use permit. 2. That the proposed development meets the zoning requirements. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP97-5 is hereby approved based on the following conditions: 1. That the Engineering Department approves the final stormwater, drainage and grading plan. 2. That Minnehaha Watershed District approves the site plan. 3. That curb and gutter is added to the parking lot. 4, That no stripped cars will be on the site for more than 20 days. 5. That the fence on the west and south side is upgraded to the proposed fence on Excelsior Boulevard. 6. That steel posts with a steel bar are added to the interior of the fence. Erect an eight foot wood privacy fence around the property line between the current office /shop building and the private garage that is for the residence on the property, There will be m:o gates to enter the fenced area, both or which will be eight foot chain link with privacy slats and require entry from the alley, One gate will be a swing gate, the other a sliding gate. The fenced area will be used for vehicle parking and will be completely paved. LANDSCAPING PLA1'lS - The property is nicely landscaped at this time. SUPPLEMENTAL DATA FOR CONDITIONAL USE PERMIT DETAll,ED NARRATIVE for CHANGE IN OCCUPANCY LOCATION: 149 JACKSON ST NE HOPKINS, MN OCCUPANCY CHANGE: AUTOMOTIVE TRANSPORTATION OPERATIONS PROPOSED CHANGES TO THE LOCATION: EXISTING PRECIOUS METAL BUILDING - We will move our automotive transportation operations into this building. The front portion will be our business office and dispatching area. A small area in the back of the shop will be an employee lounge and kitchen area. The remainder of the building will be for maintenance and light repairs of our own company vehicles only. We also will store our trucks inside when not in use. The vehicle parking area will be used for storing some of our own personal vehicles. There will be some space set aside for winter storage of vehicles for a fee. The remainder will be used for storage of private property impounds and overnight storage of vehicles on . occasion when waiting for delivery. Schmit Towing, Inc. is a service provider for repair shops, fleets and automobile dealerships, EXISTING RESIDENCE and GARAGE. We intend to leave the residence as rental property at this time. Sometime in the next two to three years we hope to donate the use of the building to the City of Hopkins Police & Fire Dept, To be used for training purposes and then burned down.
