CR 97-101 Temp 3.2 Beer Licenses for Raspberry Festival ~ May 27,1997 Council Report 97-101 TEMPORARY 3.2 BEER LICENSES FOR RASPBERRY FESTIVAL ProDosed Action Staff recommends that the Council adopt the following motion: move to aoorove temoorarv 3.2 beer licenses for the Rasoberrv Festival from 12:00 noon to 12:00 a.m. for the tent dances at 9th Street and Mainstreet Parkin~ Lot on Julv 12 - 13 and 18 - 19, 1997: at Town and Countrv Dodoe car show from 7:00 p.m. to 12:00 a.m. on Julv 12. 1997: and at Central Park softball tournaments and fireworks from 12:00 o.m. to 11 :00 o.m. on Julv 12. 1997 and 12:00 p.m. to 9:00 o.m. on Julv 13, 1997. with conditions as stioulated. Adoption of this motion will allow a total of four licenses for the sale and consumption of 3.2 beer at the listed events and times during the Raspberry Festival. Overview The Raspberry Festival has applied for licenses for the tent dances, Town and Country Dodge car show, and at Central Park for the softball tournaments and fireworks. They have requested police coverage at the tent dances, but not any of the other events. At Central Park they will serve beer from the shelter and provide additional fencing around it. Copy of Policy 4-C, Temporary 3.2 Beer Licenses Council Report 97-101 Page 2 Primarv Issues to Consider On the application for Central Park, the Raspberry Festival has requested a starting time of 11 :00 a.m. The policy that was set up for the sale and consumption of 3.2 beer has a starting time of 12 p.m. The applicant has indicated that the shelter is used for the sale of beer at Central Park and that they put up a small portable fence around the area, but, in the past, consumption has not been confined to the fenced area. They intend to use the same method for the fireworks. Policy 4-C, Temporary 3.2 Beer Licenses, 2.06, states that sales and/or consumption of beer will only take place in enclosed building or a fenced area. This would require that consumption also take place inside the fenced area. The Raspberry Festival has requested two police officers for each of the tent dances. They have not requested officers for any of the other events, particularly the fireworks. The number of persons estimated to attend is 2000. It can be assumed that a number of these people will be teenagers unaccompanied by parents. Staff recommends the folloWin9 conditions. . Starting time on Saturday, July 12, 1997, for the softball tournaments be changed from 11 :00 a.m. to 12:00 p.m. . Consumption take place in confined or fenced areas only . Hopkins Police Officers in attendance for the tent dances and for the fireworks. Alternatives 1. Approve the applications as presented 2. Approve any combination of the above mentioned conditions 3. Approve the applications with the time changed on Saturday, July 12, 1997 from 11 :00 a.m. to 12:00 p.m., require that consumption take place within fenced areas, require Hopkins Police Officers to be in attendance for the dances and the fireworks. Staff recommends alternative number 3 Policy 4-C Temporary 3.2 Beer Licenses 1. PURPOSE 1.01 The Hopkins City Council recognizes that the issuance of temporary 3.2 beer licenses may result in events which disturb surrounding businesses and residents and also may provide an opportunity for underage drinking. The City Council believes that by creating a set of rules and regulations in regard to the issuance of these licenses, problems can be avoided and the responsible consumption of3.2 beer can be encouraged. 2. REGULATIONS 2.01 A temporary 3.2 beer license will be issued on a per event basis, each event not lasting more than three days. 2.02 Beer sales may only be conducted between the hours of 12:00 p.rn. and 12:00 a.m. 2.03 A separate license is required for each location where beer is sold. 2.04 Application for a temporary 3.2 beer license must be received at least five weeks prior to the event. 2.05 Applicants for a temporary 3.2 beer license must be an organization whose principal location or office is within the City of Hopkins, has been located in Hopkins for at least two years, and has at least 30 active members. 2.06 Sales and/or consumption of beer will only take place in enclosed building or a fenced area. 2.07 Individuals under the age of 21 will not be allowed in any designated area where beer is sold or consumed, except if accompanied by a parent or guardian. 2.08 All organizations which have a temporary 3.2 beer license must use the following method for checking identification to ensure that underage individuals do not purchase beer: Anyone wishing to purchase beer must have a either a driver's license, or a Minnesota ID with their picture. Individuals with the proper ID will have their hand stamped so that the actual sellers of the beer will not have to check IDs. If the event exceeds one day, a different color of ink must be used on subsequent days. 2.09 No temporary 3.2 beer license shall be issued in conjunction with a youth activity.! \ A "youth activity" is an activity that is designed primarily for individuals under the age of 18 or the majority of the participants are under the age of 18. Legislative Policy Manual -- Chapter 4-C Page I '. 2.10 The number of temporary 3.2 beer licenses issued in conjunction with all public events' during any calendar year will be limited to twelve (12). 2.11 The City Council reserves the right to deny any 3.2 beer license at its sole discretion.
