Staff recommends the following motion: Move to approve Resolution 97-61. approving a waiver ofolat at 316 Van Buren Avenue North. At the Zoning and Planning meeting, Mr. Blair moved and Mr. Gross seconded a motion to approve Resolution RZ97-11, recommending approval of a waiver of plat at 316 Van Buren Avenue North. The motion carried unanimously. Overview. The applicant, Norma Jean Fuentes, is proposing to divide the lot at 316 Van Buren Avenue North into two lots. The existing home is located on the south parcel, and the north parcel will be able to have a new home constructed on the lot. The existing lot is 108 feet x 145.71 feet. The north parcel will have a 58-foot frontage on Van Buren, and the south parcel will have a 50-foot frontage on Van Buren. The division line is angled to allow for the correct side yard setback for the existing garage. The subject lot is zoned R-I-A, single and two-family high density. o Do the proposed lots meet the zoning requirements? The zoning ordinance requires a 50-foot minimum lot width at the front yard setback line. Both lots will meet this requirement. The north lot will be 6,336 square feet, and the south lot is 9,383 square feet. A minimum lot size of 6000 square feet is required for a lot in an R-I-A zoning district. o Do the lots meet the requirements for a waiver of plat? The following are the requirements for a waiver of plat: 500.61 Waiver of Plat. Subdivision 1. In certain circumstances a waiver of plat may be more appropriate than a subdivision to divide a property. An applicant may apply for a waiver of plat if the following circumstances exist: a) the division requires substantially a single line b) the division will not create more than one additional lot c) the division will not require the dedication of a public right-of-way or extension of utilities in a public right-of-way d) the new lots created meet or exceed the existing conditions The lots meet the requirements for a waiver of plat. o What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed division. Ms. Anderson noted that the proposed lot division met the zoning and waiver of plat requirements. Alternatives. 1. Approve the waiver of plat. By approving the waiver of plat, the applicant will be able to divide the lot at 316 Van Buren Avenue North. . 2. Deny the waiver of plat. By denying the waiver of plat, the City Council will consider a recommendation of denial. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 97-61 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A WAIVER OF PLAT AT 316 VAN BUREN WHEREAS, an application for a waiver of plat, WVR97-1, has been made to the City of Hopkins; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a waiver of plat WVR97-1 was made by Norma Jean Fuentes on April 25, 1997; 2. That the Hopkins Planning Commission, pursuant to mailed notice, held a meeting on the application and reviewed such application on May 27, 1997: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of the City staff were considered. 4. Legal descriptions of the new properties are as follows: North Parcel That part of Lot 7 lying East of the West 145.5 feet thereof, Block 2, Stevens Oakwood Park, Hennepin County, Minnesota. Which lies North of the following described line: Commencing at the northeast comer of said Lot 7; thence on an assumed bearing of South 00 degrees 12 minutes 06 seconds West along the East line of said Lot 7 a distance of 58.00 feet to the point of beginning of the line to be described; thence North 79 degrees 02 minutes 52 seconds West a distance of 148.22 feet to the East line of the West 145.5 feet of said Lot 7 and there terminating. South Parcel That part of Lot 7 lying East of the West 145.5 feet thereof, Block 2, Stevens Oakwood park, Hennepin County, Minnesota. Which lies South of the following described line: Commencing at the northeast comer of said Lot 7; thence on an assumed bearing of South 00 degrees 12 minutes 06 seconds West along the East line of said Lot 7 a distance of 58.00 feet to the point of beginning of the line to be described; thence North 79 degrees 02 minutes 52 seconds Page 2 West a distance of 148.22 feet to the East line of the West 145.5 feet of said Lot 7 and there tenninating. NOW, THEREFORE, BE IT RESOLVED that Waiver of Plat WVR97-1 is hereby approved, based on the following Findings of Fact: 1. That the waiver of plat meets the requirements of the subdivision ordinance. 2. That the new lots meet the zoning requirements. BE IT FURTHER RESOLVED that application for Waiver of Plat WVR97-1 is hereby approved based on the following conditions: 1. That the waiver of plat is filed with the Hennepin County Recorder.
