RESOLUTION 2000-74 APPOINTING
DATA COMPLIANCE OFFICIAL

Staffreco111mends that the Council approve the following motion: Move to approve Resolution 2000-74.
Approval of this motion will result in the appointment of a data compliance official as required by Minnesota
State Law.
Overview
Minnesota Statutes Section 1305, Subdivision 13 states "By December 1, 2000, each responsible authOlity or
other appropriate authority in every government entity shall appoint or designate an employee of the
government entity to act as the entity's data practices compliance official. The data practices compliance
official is the designated employee of the government entity to whom persons may direct questions or
concems regarding problems in obtaining access to data or other data practices problems. The responsible
authority may be the data practices compliance officia1."
Staff is recommending that the City Council appoint the Assistant City Manager, who is currently the City's
.responsible authority, as the data practices compliance official.
Primary Issues to Consider
+ What will be the result of this action?
Aside from coming into compliance with state law, there will be little change in data practices or
procedures. As the responsible authority, the Assistant City Manager was already dealing with any
complaints or concerns regarding the access to City data.

RESOLUTION 2000-74
WHEREAS, Minnesota Statutes, Section 13.05 Subd. 13 requires that the City appoint
a City employee to act as its data practices compliance official to receive
questions or concerns regarding problems in obtaining access to data or
other data practices problems within the City; and
WHEREAS, the City Council shares the concern expressed by the Legislature about
access to City data and wishes to satisfy this concern by immediately
appointing a qualified data practices compliance official as required under
statute,
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Hopkins
hereby appoints James A. Genellie, the Assistant City Manager, as the
data practices compliance official to receive questions or concerns
. regarding problems in obtaining access to data or other data practices
problems.
Adopted by the City Council of the City of Hopkins this 1 yth day of October 2000.
