Overview
In preparation for the 1999 Shady Oak Beach season, staff has been reviewing operational
procedures for the facility. In past years, a major area of concern has involved smoking on
the beach premises. Beach staff have received three basic complaints from users of the
facility regarding smoking in the beach area. These concerns are as follows:
1.) Smoke drifts into the area of non-smok~rs on occasion
2_) The abundance of cigarette butts scattered throughout the beach area
3.) The inability of beach staff to enforce youth smoking
At the March 10, 1999 JoinL Recreation Board meeting, the Board reviewed staff
recommendations to de~ignate Shady Oak Beach a smoke free facility. Staff recommended
approval of this policy prior to the opening of the 1999 season.
e In reviewing staff recommendations, the Board discussed which areas to designate as
smoke free. Initial consideration of motions to restrict smoking in the parking area and
secured areas of beach were not adopted. The final motion adopted by the Joint
Recreation Board recommends that the entire fenced in area and main entrance area to the
beach be considererl smoke and tobacco free. This motion passed on a 7 to 1 vote.
Because the Joint Recre.Jtion Board's recommendation only affects the beach facility, this
item is being brought to the Hopkins City Council for consideration. Had the
recommendation involved the entire park, a change in the City of Minnetonka's park
ordinance would have been required and the item would have gone to the Minnetonka
Council for consideration.
If approved by Council, the areas affected will be signed as "Smoke and Tobacco Free".

If Shady Oak Beach is designated smoking and tobacco free, non-smoking users would
benefit from the elimination of second hand smoke within the facility. All users of the
beach would benefit from a cleaner environment due to the elimination of cigarette butts
from the grounds. Those users of the beach wishing to smoke, would be required and
allowed to exit the facility and main entrance area to smoke in other areas of the park.
. Regulation and enforcement of the policy
In past years, complaints directed to beach staff regarding youth smoking within the beach
area have been difficult to resolve. Users of the facility are not required or expected to
carry identification making verification of their age difficult. The elimination of smoking in
general would resolve this problem.
Enforcement of a smoke and tobacco free policy would require enforcement by the beach
staff. Violators of the policy would be required to exit the faci I ity to smoke. Users of the
facility who refuse to do so, or who continue to abuse the policy, would be restricted from
using the faci lity.

WHEREAS, the cities of Hopkins and Minnetonka provide Shady Oak Beach for an enjoyable
recreational opportunity; and,
WHEREAS, Shady Oak Beach serves the youth of both communities; and,
WHEREAS, Shady Oak Beach provides quality family recreation.
NOW, THEREFORE, be it resolved, by the Council of the City of Hopkins, Mim1esota:
1. The Council authorizes to designate the fenced in area of Shady Oak Beach as a Smoke and
Tobacco Free area.
. 2. The Council authorizes the main entrance area of Shady Oak Beach to be designated as a
Smoke and Tobacco Free area.
Adopted by the City Council of the City of Hopkins this 20th day of April 1999.
