Approval of Depot Lease Area Expansion
Proposed Action
Staff recommends approval of the following motion: Motion to approve a lease amendment
with the Hennepin County Reqional Railroad Authority to expand the area leased by the City of
Hopkins for the Depot Coffee House and to authorize Mayor Redepenninq and City Manaaer
Mielke to execute the lease amendment on behalf of the City of Hopkins.
Overview
The City of Hopkins leases the former Hopkins railroad depot and grounds from the Hennepin
County Regional Railroad Authority for use by a Depot Coffee House, a chemically-free gathering
place for students of Hopkins High School. The lease is for $1 per year to the year 2016. The area
leased for the Depot runs 190 feet west of the west end of the building, and 100 feet east of the east
end. The proposed lease amendment would expand the easterly leased area to 400 feet from the
east end of the building. This expansion would provide room for a paved parking lot and unpaved
overflow parking, including parking area for a trailhead for users of the Southwest LRT Corridor trail.
The Depot Board believes that the proposed expansion will greatly enhance the Depot's ability to
use the site. The Depot Board and City staff recommend approval of the proposed expansion of the
leased area.

The proposed expansion of the leased area at the Depot will make the trailhead parking possible all
on Depot property. It will allow the Depot and Hennepin Parks to invest in a paved parking lot. The
proposed expansion is preparatory to the arrangements for the trailhead.
. How will the proposed expansion affect the transit way described in the City's transit
study?
Staff is coordinating the proposed expansion of the leased area and resulting parking improvements
with the improvements called for in the City's transit study. Specifically, the transit way will require a
strip of right-of-way approximately 30 feet wide if a two-lane bus way is built. The Depot and
Hennepin Parks are waiting for more detailed information about the bus way, so that they can
incorporate that use into the design for a parking lot. The proposed expansion of the lease area
should not adversely affect the transit way.
Alternatives
· The Council has the following alternatives regarding this matter:
1. Approve the item as recommended by staff.
2. Amend and approve the item.
3. Continue the item for additional information.
4. Deny the item.

FIRST AMENDMENT TO LEASE AGREEMENT NO. 73-32102
THIS AGREEMENT, made and entered into by and between the HENNEPIN
COUNTY REGIONAL RAILROAD AUTHORITY, a Minnesota political subdivision, LESSOR,
and the City of Hopkins, LESSEE; .
WIT N E SSE T H:
WHEREAS, LESSOR and LESSEE entered into a certain Lease Agreement bearing
Contract No. 73-32102, for the leasing of a building, yard and parking area used as a
community recreation and education facility, commonly described as the Depot Coffee
House at the intersection of State Trunk Highway 169 and C.S.A.H. 3 (Excelsior'
Boulevard) in Hopkins, Minnesota, said Lease being set forth in Exhibit "I" attached hereto
and made a part hereof by reference;
WHEREAS, LESSOR and LESSEE desire to amend the Lease in certain particulars;
NOW, THEREFORE, the parties mutually agree as follows:
A. Clause I. "Leased Premises" of the Lease is hereby deleted by substituting the
following therefor:
I. LEASED PREMISES
LESSEE agrees to lease from LESSOR, and LESSOR agrees to lease to
LESSEE, that certain property described as follows:
Hennepin County Regional Railroad Authority (HCRRA) Hopkins Depot
building, formerly the Chicago & North Western Transportation
Company Hopkins Depot building, and that part of the Hennepin
County Regional Railroad Authority Hopkins to Minneapolis right-of-
way located southerly of C.S.A.H. No. 3 {Excelsior Boulevard};
easterly of a line drawn parallel with and 190 feet westerly, as
measured along the southerly HCRRA property line, of the westerly
wall of the said HCRRA Hopkins Depot building; westerly of a line
drawn parallel with and 400 feet easterly, as measured along the
southerly HCRRA property line, of the east wall of said HCRRA
Hopkins Depot building; and northerly of a line drawn parallel with and
5 feet northerly of the north edge of the bike/pedestrian trail
pavement, the rights to said trail being granted and contained in Permit
Agreement No. 73-32001 dated September 1, 1998 between the
LESSOR and the Suburban Hennepin Regional Park District; which is
marked in pink on Exhibit II. Exhibit II is attached and incorporated by
reference in this Lease.

B. Clause XVIII. "Suburban Hennepin Regional Park District Permit Agreement" below is
hereby added to the Lease:
XVIII. SUBURBAN HENNEPIN REGIONAL PARK DISTRICT PERMIT AGREEMENT
LESSEE agrees that the rights contained in this Lease are
subject to and subordinate to the rights granted and contained in
Permit Agreement No. 73-32001 dated September 1, 1998 between
HCRRA and the Suburban Hennepin Regional Park District (SHRPDj,
and that LESSEE shall comply with all rules and regulations of the
SHRPD in regards to the exercise of its rights over HCRRA's right-of-
way, including but not limited to those regarding safety.
C. "Exhibit A" of the Lease is hereby deleted by substituting Exhibit II, said Exhibit II
is attached hereto and made a part hereof by reference.
The effective date of this First Amendment to Lease Agreement No. 73-32102 is
September 1, 1999.
Except as herein above amended, the terms, conditions and provisions of Lease
Agreement No. 73-32102, shall apply to and govern the provisio'ns of this Agreement.

LESSEE having signed this Lease, and the Hennepin County Regional Railroad
Authority's Commissioners having duly approved this Lease on the day of
, 199_, and pursuant to such approval, the proper officials having
signed this Lease, the parties hereto agree to be bound by the provisions of this Lease.
