EXTENSION OF INTERIM ORDINANCE--MORATORIUM ON
DEMOLITION OF SINGLE FAMILY HOMES
Proposed Action
Staff recommends approval of the following motion: Approve first reading of Ordinance 99-837.
an ordinance extending the interim ordinance regulating and restricting demolition or removal of
single family residential buildings and structures within the City of Hopkins.
Overview
In December of last year the City Council approved an interim ordinance placing a moratorium on
the demolition or removal of any single family residential building or structure located within
single family residential districts. During this period, staff was directed to complete a study of this
issue and then undertake any necessary ordinance revisions to address the Council concern about
the loss of single family homes.
In November the Council considered a recommendation by the Z & P Commission to establish a
conditional use permit process regulating the expansion of institutional uses within residential
zoning districts with specific conditions concerning the demolition and removal of single family
homes. The Council referred this item back to the Commission.
The Zoning & Planning Commission, at their November meeting, discussed this item. Staff
provided an update on recent discussion the Council had concerning this matter. Staffhas now
been directed to prepare a draft ordinance that would also involve creation of a new zoning
district for institutional uses presently allowed within residential districts. This will be discussed
at their December meeting.
To allow time to draft necessary ordinance changes, staffis requesting a six-month extension of
the moratorium. The second reading of this item, if approved by the Council, would be scheduled
for December 21, 1999. The ordinance would go into effect 20 days after publication in the
official newspaper.

AN ORDINANCE EXTENDING INTERIM ORDINANCE NO. 98-821,
AN INTERIM ORDINANCE FOR THE PURPOSE OF PROTECTING THE
PLANNING PROCESS AND THE HEALTH, SAFETY AND WELFARE OF CITY
RESIDENTS; AND REGULATING AND RESTRICTING THE DEMOLITION OR
REMOV AL OF SINGLE FAMILY RESIDENTIAL BUILDINGS AND STRUCTURES
WITHIN THE CITY OF HOPKINS
THE CITY COUNCIL OF THE CITY OF HOPKINS HEREBY ORDAINS AS FOLLOWS:
Section 1.
Background and Findings.
1.01 On December 15, 1998, the Hopkins City Council approved Ordinance No. 98-821 (the
"Interim Ordinance"), an Interim Ordinance directing City Staff to prepare a planning study
to determine how and to what extent the demolition or removal of single family residential
structures and buildings located within the City of Hopkins should be regulated or restricted
. and placing a moratorium on the demolition or removal of any single family building or
structure located within certain zoning districts established by the Hopkins official zoning
map. The Interim Ordinance is to remain in effect for a one (1) year period of time ending
February 2, 2000.
1.02 Section 1 of the Interim Ordinance included certain findings adopted and approved by the
Hopkins City Council as the basis for directing that the planning study be conducted and
adopting the moratorium on the demolition or removal of any single family building or
structure located within certain zoning districts established by the Hopkins official zoning
map. The Hopkins City Council hereby determines that the facts and circumstances and the
findings described in Section 1 of the Interim Ordinance remain in existence, that there
continues to be a need for further evaluation and review of the planning study by the Hopkins
City Council and adoption of ordinances, amendments to existing ordinances and/or
regulations to address the facts and circumstances that were the basis for adoption of the
Interim Ordinance. The City Council hereby confirms, adopts and ratifies the findings
contained in Section 1 of the Interim Ordinance.
1.03 The Interim Ordinance will terminate on February 2, 2000. There is a need to extend the
term of the Interim Ordinance for a period of six additional months to protect the planning
process and the health, safety and welfare of City residents while evaluation of the planning
study is completed and a final determination is made by the Hopkins City Council regarding
the need for adoption of amendments to the City's ordinances, regulations and official
controls relating to and regulating the demolition or removal of single family residential
structures and buildings located within the City of Hopkins.

Section 2.
Extension of Interim Ordinance.
The Interim Ordinance, Hopkins Ordinance No. 98-821, is hereby extended for a period of six
months, ending August 1, 2000. The Interim Ordinance, including the moratorium established by
Section 3 thereof, shall remain in effect in all of its terms and conditions, as originally adopted by
the Hopkins City Council, until August 1,2000, or such earlier date as may hereafter be established
by an ordinance duly adopted by the City Council repealing the Interim Ordinance.
Section 3.
Effective Date.
This ordinance shall be effective 20 days after its publication.
