CR 08-098 Site Plan Review - Excelsior Crossings Childcare Facility
O \TY OF HOPKIN October 29, 2008 Council Report 08 -98 SITE PLAN REVIEW — EXCELSIOR CROSSINGS CHILDCARE FACILITY Proposed Action. Staff recommends the following motion: Adopt Resolution 08 -60, approving a site plan to construct a day care at the Excelsior Crossings development. At the Zoning and Planning meeting Ms. Reilly moved and Ms. Flynn seconded a motion to adopt Resolution RZ08 -6, recommending approval of a site plan to construct a day care at the Excelsior Crossings development. The motion was approved unanimously. Overview. As part of the Excelsior Crossings development, a small development pad was platted for a future use. Now as the construction is continuing; Opus is proposing to construct a 14,300 square feet childcare facility for Cargill employees. The childcare facility will be a one -story building with 13 class rooms. The facility will be able to accommodate 144 pre- school children. There will be a large area on three sides of the building for the children to play. The childcare facility will be run by Bright Horizons. It is anticipated to open in the fall of 2009. Primary Issues to Consider. • What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? • What are the specifics of the site plan? • What was the discussion at the Zoning and Planning meeting? The subject property is zoned Business Park. The Comprehensive Plan has designated the site as Business Park. The PUD agreement does not prohibit this use. • What are the specifics of the site plan? Exterior The exterior is proposed to be brick with prefinished metal panels. There are large windows on the north and south sides. Landscaping There is extensive landscaping on the sides of the site. On the south, west and east sides of the site there are extensive play areas for the children. The landscaping will screen the play areas from the roads bordering the site. A fence will also be constructed around the play area. Parking The parking for the staff will be located in the east parking ramp. The on -site parking on the east side of the building will be for drop -off and pick -up. There are 25 spaces; the requirement for the site is 14 spaces. Engineering /Public Works The City Engineer is working with Opus to refine the access points. Any approval will be contingent on the City Engineer approving the plans. Trash The trash area is located on the north side of the building. The trash area will be enclosed as required by the ordinance. Access Access to the site will be from First Street North, via Jackson Avenue. This access will allow a vehicle to access the parking ramp or the on -site parking area for the day care. CR08 -98 Page 3 Setbacks The setbacks for the building are 20 feet on all sides. The proposed building complies with the 20 -foot setback requirement. The Business Park district requires a 20 -foot parking setback. The PUD agreement will be amended to allow parking 10 -feet into the 20 -foot parking setback. Watershed District This development will have to be approved by the Watershed District. Any City approvals will be contingent on their approval. Surrounding uses The site is surrounded by Excelsior Boulevard to the south, industrial use to the north and east and the Excelsior Crossings development to the west. • What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed childcare facility. Dave Bangasser from Opus appeared before the Commission. Mr. Bangasser stated that the colors of the building would be similar to the other buildings but would have different materials. No one appeared at the public hearing regarding this item. Alternatives. 1. Approve the site plan for the childcare facility. By approving the site plan the applicant will be able to construct the childcare facility as proposed. 2. Deny the site plan for the childcare facility. By denying the site plan the applicant will not be able to construct the childcare facility as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota Resolution No. 08 -60 A RESOLUTION MAKING FINDINGS OF FACT AND SITE PLAN APPROVAL FOR A CHILDCARE FACILITY AT THE EXCELSIOR CROSSINGS DEVELOPMENT WHEREAS, application has been made by Opus Northwest, LLC, (Applicant) for approval of the Site Plan for the childcare facility at the Excelsior Crossings Development; WHEREAS, the procedural history of the application is as follows: A. The applicant submitted applications to the City of Hopkins for approval of a childcare facility at the Development on October 1, 2008. Thereafter, the Site Plans were reviewed by City staff, and commented upon by City staff, in writing. B. On October 28, 2008, the Zoning and Planning Commission reviewed the Site Plan and considered the comments of City staff. WHEREAS, the City Council of the City of Hopkins, Minnesota, makes the following findings of fact related to the applications for approval of Site Plan for a childcare facility at the Development: A. That the proposed Site Plan for the childcare facility at Excelsior Crossings development meets the requirements of the Hopkins City Code related thereto, subject to Applicant's compliance with the comments and recommendations of City staff and the terms and conditions stated below. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hopkins, Minnesota, approves of the Site Plan for the childcare facility at the Development, subject to and conditioned upon Applicant's compliance with the following conditions: 1. Approval of the replatting of the site. 2. Execution and recording of an amendment to the PUD Agreement between the City and Applicant as approved by the Hopkins City Council, and Applicant's compliance with all terms and conditions stated in such Amendment and in the PUD Agreement. ATTEST: 3. Applicant shall obtain all required Watershed District approvals for the development of the Property and satisfy all requirements and conditions of such approvals. 4. All grading, drainage, utility, parking and traffic control plans, storm water pollution prevention plans, pond construction plans, landscaping plans and erosion control plans shall be subject to review and approval by the City's Public Works staff, and Applicant shall comply with or observe any modifications to such plans requested by the City's Public Works staff. 5. Applicant shall obtain all necessary approvals from Hennepin County, the Minnesota Department of Natural Resources, MPCA and other governmental agencies or authorities having jurisdiction over the development of the Property. 6. Applicant shall dedicate or grant to the City all drainage and utility easements and rights -of -way determined to be necessary by the City's Public Works staff.
