At the Zoning and Planning meeting, Mr. Jenny moved and Ms. Reilly seconded at motion to adopt Resolution RZ08 -7, recommending approval of a preliminary /final plat for Excelsior Crossings. The motion was approved unanimously. Overview The applicant, Opus Northwest LLC, is proposing to replat the site. This replat is necessary to accommodate the daycare and a small corner of the building in Lot 1. The replat will add a small portion of Outlot A to Lot 1. The replat will also reconfigure what was Lot 4 into Lot 3 for the childcare facility. Opus Northwest is also proposing to vacate a small portion of First Street North. The public hearing for this vacation will take place at the November meeting. Any approval of the plat will be contingent on approval of this vacation. Primary Issues to Consider • What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? • Does the lot meet the zoning requirements? • What are the specifics of the plat? • Does the proposed plat meet the subdivision requirements? • Will a park dedication fee be required? • What was the discussion at the Zoning and Planning meeting? The zoning of the site is Business Park. The Comprehensive Plan has designated the site as Business Park. The proposed uses comply with both documents. The site will have an overlay zoning of Planned Unit Development to allow flexibility with the design of the development. • Does the lot meet the minimum lot requirements? The minimum lot size is 43,560 square feet in the Business Park zoning district. The proposed lots all meet this requirement. There is no minimum lot size for outlots; all outlots are unbuildable. The following are the sizes of the lots and the outlots: Lot 1 - 318,868 square feet (Building B) Lot 2 - 256,798 square feet (Building C) Lot 3 - 47,306 square feet (childcare building) Outlot A — 171,416 square feet • What are the specifics of the plat? The plat will be three lots and one outlot. • Does the proposed plat meet the subdivision requirements? The proposed plat meets the subdivision requirements. • Will a park dedication fee be required? A park dedication fee will not be required because no additional lots will be created. • What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the changes to the plat. No one appeared at the public meeting. Alternatives. 1. Approve the preliminary /final plat. By approving the preliminary /final plat, the property will be replatted. 2. Deny the preliminary /final plat. By denying the preliminary /final plat, the property will not be replatted. If the City Council considers this alternative, findings will have to be CR08 -99 Page 3 identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota Resolution No. 08 -61 A RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE PRELIMINARY/FINAL PLAT OF EXCELSIOR CROSSINGS WHEREAS, application has been made by Opus Northwest, LLC (Applicant) for review and approval of a plat known as Excelsior Crossings 2 Addition (the Plat); WHEREAS, the procedural history of the application is as follows: A. The applicant submitted an application to the City of Hopkins for approval of the Plat on October 22, 2008. Thereafter, the Preliminary/Final Plat was reviewed by City staff, and commented upon by City staff, in writing. WHEREAS, the City Council of the City of Hopkins, Minnesota, makes the following findings of fact related to the application for approval of the Plat: A. That the Preliminary /Final Plat meets the requirements of the Hopkins City Code governing the approval of Plats and Subdivisions, as modified by the Planned Unit Development Zoning approved by the City Council and subject to the Applicant's compliance with the conditions stated below. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hopkins, Minnesota, approves of the Preliminary /Final Plat known as Excelsior Crossings 2 Addition, subject to and conditioned upon Applicant's compliance with the following conditions: 1. Execution and recording of an Amendment to the PUD /Development Agreement between the City and Applicant as approved by the Hopkins City Council, and Applicant's compliance with all terms and conditions stated in such Amendment and in the PUD /Development Agreement. 2. Applicant shall obtain all required Watershed District approvals for the development of the Property and satisfy all requirements and conditions of such approvals. 3. All grading, drainage, utility, parking and traffic control plans, storm water pollution prevention plans, pond construction plans, landscaping plans and erosion control plans shall be subject to review and approval by the City's Public Works staff, and Applicant shall comply with or observe any modifications to such plans requested by the City's Public Works staff. 4. Applicant shall obtain all necessary approvals from Hennepin County, the Minnesota Department of Natural Resources, MPCA and other governmental agencies or authorities having jurisdiction over the development of the Property. 5. Applicant shall dedicate or grant to the City all drainage and utility easements and rights -of -way determined to be necessary by the City's Public Works staff. 6. That Hennepin County approve the plat. 7. That the small vacation of First Street is approved by the City Council or an agreement is reached between the City and Opus to allow the use of this property. ADOPTED this 3rd day of November 2008.
