CR 97-201 Approve & Setting Miscellaneous FeesOctober 31, 1997 Council Report 97-201 APPROVING AND SETTING MISCELLANEOUS FEES Staff recommends approval of the following motion: Move to approve Resolution 97-95. A~provingand Setting Miscellaneous Fees This action will allow the City to cover the cost of administering the Tobacco Ordinance, mandated public notices and staff time for Comprehensive Plan Amendments, and establish a fee for a temporary liquor license. The resolution will also increase the fee of the temporary beer license to better reflect the time involved in the issuance of the license and raise the cost of copies. Overview The State of Minnesota has required that the City perform annual checks to verify that holders of tobacco licenses are not selling to minors. The State also mandates public notices and filing fees for amendments to the Comprehensive Plan. According to our ordinances, we allow temporary liquor licenses, but a fee has never been set to cover staff time. Primary Issues to Consider • What should the license fee cover The license fees should cover the cost of issuing the license and any mandated activity related to the license. The state has mandated compliance checks for tobacco sales to minors. The proposed fee reflects the cost to do so. The state has mandated certain activities associated with changes to the Comprehensive Plan. Again, the fee reflects the cost of those mandated activities and staff time. The City has never established a fee for temporary liquor licenses and, yet, by adoption of state statutes allows them. A fee should be set to reflect staff time used to issue the license. The Temporary beer license fee needs to be raised to more accurately reflect staff time. The cost of copies has not been adjusted for over ten years. Meanwhile, the cost of paper and the cost of time has increased considerably. Supporting Documents • Resolution 97-95 • Cosfi work sheet prepared by Heather Alex for tobacco ordinance enforcement • Memo from Nancy Anderson on the Comprehensive Plan Amendments erry Ob aier, City Clerk CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION 97-95 APPROVING AND SETTING MISCELLANEOUS FEES WHEREAS, The City of Hopkins has enacted an ordinance for the regulation of the sale of tobacco and liquor and; WHEREAS, the ordinances require local law enforcement to conduct annual compliance checks for each tobacco licensee, and investigate each temporary liquor and temporary beer license, and; WHEREAS, State Statutes mandate published notices of changes to the Comprehensive Plan, and; WHEREAS, State law provides for cities to set license fees that reflect the actual costs of conducting the required compliance checks, and the city has made an estimate of those costs, and; WHEREAS, the cost of copies has remained the same for approximately ten years with the cost of paper and time increasing considerably, and; WHEREAS, Section 1000.05 of the City Code allows fees to be set by adoption of a resolution, NOW, THEREFORE BE IT RESOLVED, that the fee for the following activities be as follows: Tobacco License 5115.00 Temporary Beer License 5 35.00 Temporary Liquor License 5 50.00 Comprehensive Plan Amendment 5200.00 Copies, each page 5 0.25 Adopted by the City Council of the City of Hopkins this 5"' day of November, 1997.
