Staff recommends adoption of the following motion: Move that Council approve Nine Mile Cove proiect changes, including plantings and ixri ag tion along Second Avenue South, additional site gradingproject sig~-age and bridge/monument installation. Overview. The Nine Mile Cove townhome developer, R.E. Clark, Inc., has proposed several changes to the development. The proposed changes have been reviewed and approved by the Park Board and the Zoning and Planning Commission. Primary Issues to Consider. • Details of proposed changes. • Maintenance. Plantings and irrigation along Second Avenue South: The developer would like to provide a wider, planted boulevard area along 2na Avenue. The plantings would include trees and shrubs. The planted boulevard area would be on city right-of--way. The homeowner's association would assume maintenance responsibilities for the plantings and irrigation system. The current development agreement will be amended to include this responsibility and include a clause which holds the city harmless in the event of damage to trees, shrubs or irrigation placed on the right-of-way. The developer will need the watershed district and DNR approval to change the slope of the roadway. Bridge and monument installation: The developer is proposing amock- bridge to be constructed on the public right-of--way with entry monuments. The mock-bridge would be constructed by placing boulders on the side slope along the west section of 2~ Avenue leading into the site. The entry monuments would be placed no closer than 6' from the back of curb. The wrought iron fence would be 10' - 11' from the back of curb. As with the plantings, the homeowner's association will be responsible for the maintenance and repair of these roadside amenities. Additional grading: The developer would like to remove a berm along the west side to allow better drainage from the site and allow a few more units to be full walk-out homes. The grading change doesn't negatively impact the adjacent city park land. Drainage from the site must still flow across 30 - 60 feet of unimproved grassy area or wooded area prior to entering the drainage ditch leading to Nine Mile Creek. Project signage: The developer received approval from the Park Board to place a temporary (removed by Dec, 1999) 50 square foot sign advertising the development adjacent to the TH 169 right-of-way. The sign would be mounted on piles to allow visibility from TH 169. The location would be just east of the south end of 2°d Avenue South, again, near the TH 169 ROW. %1 Council Report 97-204 Page 3 • Maintenance. Maintenance responsibility for additional improvements along the right-of- way will be clearly stated, as mentioned above, in an amended development agreement. The proposed improvements will be located such that they will not hinder City street maintenance activities. The City is responsible for street and utility maintenance up to the circular turn-around area only - maintenance of interior streets and utilities are a homeowner's association responsibility. Mr, Dietrich and Mr. Clark are proceeding with additional marketing proposals/ideas that will help make this project a success. The first home is expected to begin this week, with active selling in the model at the Spring Preview next February. There are four (4) additional items that the project team would like the City Council to consider to help make this project viable. These items include interest to the Public Works department and the Parks Department. We have enclosed a Planting Plan and also, previously submitted "Bridge Plans", for your review and consideration. 1. Planting/Irrigation Along 2°" Avenue: The Planting Plan details a planting scheme along 2"d Avenue that will greatly enhance the streetscape as you enter the project. The plants proposed along this street will be planted within public right-of--way because of the minimum amount of room that we have to plant because of wetland impacts. Because of the importance of this plant material, we also propose a irrigation system along this stretch of roadway. Because of the amount of dead and dying existing plant material along this roadway, the Developer would like an opportunity to remove the dead material and prune up the existing plant material on a one time basis. The Developer proposes that the maintenance of the new plant material and irrigation system will be the responsibility of the Home Owner's Association. Any wetland approvals needed beyond the City Controlled WCA permits, due to additional boulevard width, will be the responsibility of the Developer. Z. Grading in Park Area behind Lots 18-22 To improve drainage and provide walkout lots along the West property line, we request a grading permit that would extend from the lot line to the existing storm water ditch. This grading would limited to absolute minimum disturbance to existing trees. The existing turf trail would be replaced, and CMP culverts added where needed. To compensate for vegetation damage, the Developer would agree to plant a minimum of 6 new trees in this vicinity, on Park property. The Developer will also clean up the debris in the existing ditch along the West property line. . October 13,1997 Mr. Steven Stadler Page 3 of 3 3. Project Signage The marketing of this project is by far the most important element of the development to date. Making the project a success by selling units will help the City as well as the Developer in the long term relationship that you have entered into. As you are aware, the site visibility from public view points is very limited. We are requesting the City to allow us to erect a sign that is 12 feet by 20 feet in size, mounted on piles that will allow the traffic from Highway 169 to see it. The sign will provide directions to the site and a general description with art work. Hopefully, this will reduce the amount of traffic that will be routed through existing neighborhoods in order to find our development. The sign location requested is on Pazk property next to the existing bridge along 169. The Developer will remove the sign by December 31s`, 1999. 4. Ornamental Bridge Work and Details The Developer previously submitted details of some ornamental wood monuments with copper tops and rot iron railing with street modifications that would be constructed next to 2nd Avenue near station 15+00 and around the public tum-around. The City's response at that time was to have the Developer take ownership of 2"d Avenue because the City was not comfortable with the proposal. While ownership of 2°d Avenue is not an option for the Developer, we do propose to maintain the structures through the Home Owner's Association. The brick work on the street will be eliminated so that the street is back to the original design. An amendment to the Developer's agreement would be made that would address maintenance issues that you may have. We request that this information be addressed at the October City Council meeting. The highlighted areas on the plan is what we discussed and agreed that it would be appropriate to work in these areas with the exception of the swale on the North side. I noticed this after the Parks people left. It was agreed that the rubble would not be buried on Park property, and that tree removal would be limited to what is required to remove the berm (volunteer box elder). Ray also agreed that some downed trees, broken limbs, and garbage within the Park could be cleaned up by Ron Clark Construction if they so desired. The large clump behind lots 18-20 should be left natural for wildlife. They agreed that a small culvert was preferable over a swale through the turf trail. We hope to begin removal work in this area next week. I would like to meet with you on the North swale, as I understand Ray will be out on vacation. This work accomplishes two things, first, it removes the left over rubble from the nursery operation, and second, it will improve the drainage behind the buildings to a great extent.
