CONDITIONAL USE PERMIT -- RASPBERRY WOODS SIGN

Proposed Action.
Staff recommends approval of the following motion: Move to adopt Resolution 98 -3,
granting a conditional use permit to construct a sign at Raspberry Woods Townhomes.
At the Zoning and Planning meeting, Mr. Engel moved and Mrs. Boen seconded a motion to
approve Resolution RZ97 -18, recommending a conditional use permit to construct a sign at
Raspberry Woods Townhomes. The motion carried unanimously.
Overview.
The applicant, Stuart Management Corporation, is proposing to construct a monument sign.
At the time the conditional use permit was granted for the construction of the townhomes,
Mr. Nolan stated that they would like to construct a monument sign. The monument sign that
was proposed requires a conditional use permit.
The townhomes are in the construction process, and Mr. Nolan is seeking approval of the
proposed monument sign.
Greenfield Apartments to the west of the applicant's site was granted a conditional use permit
to construct a monument sign in the past.

o What does the zoning ordinance allow for additional signage with a conditional
use permit?
The zoning ordinance states the following:
Conditional Use Permit R- Districts. Signs may be permitted by conditional use permit for
public parks and playgrounds, churches, synagogues, public libraries, public museums, public
and parochial schools, municipal buildings, golf courses, county clubs, apartment buildings,
nursing homes, community centers, colleges, universities and private schools, hospitals, and
sanitariums, based on the following design criteria and other conditions the City Council may
require:
a) size: The size shall be proportional to the size of the facility, need for signing,
frontage on street(s), location, visibility, and development in the area. The
maximum size should not exceed 60 square feet per sign surface with a
maximum area of 120 square feet per single sign.
b) height: No free standing sign shall exceed fifteen feet in height.
c) lighting:
1) lighting shall be indirect or it shall be backlit
2) neon lighting, flashing lighting, and /or rotating lighted sign shall be
prohibited.
d) design: signs attached to the building shall be integrated with the building
design and architecture in terms of materials, colors, lighting and placement;
signs not attached to the buildings shall be architecturally treated and
coordinated with the principal building by use of compatible materials and
design.
e) location: no free standing signs shall be located less that five feet from any
street right -of -way line.
f) sign purpose: the principal purpose of the sign permitted under this section
shall be to identify the public or institutional use made of the property.
The site plan submitted by the applicant indicates the sign is in the right -of -way. The sign will
have to be moved and have a five -foot setback. The proposed sign meets the other
requirements.

o What are the specifics of the proposed sign?
The sign will be 60" x 48.5 ", which is approximately 22.5 square feet. The sign will be
mounted on pillars that will be constructed of brick. The height of the sign will be 72 ". The
pillars will add 16" to either side of the sign. The sign will be sandblasted cedar. The
proposed colors of the sign will be red and green. The lighting of the sign has not been
determined. If the sign is lit, it will be with ground lighting.
o What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed signage. The proposed sign meets the requirements for
a conditional use permit for a sign, except for the setback.
Elly Burrington, representing Stuart Management Corporation, appeared before the
Commission. Ms. Burrington stated that they need to make the sign bigger because it is the
only sign on the site.
Ms. Burrington stated that they would be moving the sign to the five -foot setback.
Ms. Burrington also stated that they hopefully will be occupying the first building on January
15, and the whole development should be done by April 1.
No one spoke at the public hearing.
Alternatives.
1. Approve the conditional use permit. By approving the conditional use permit, the
applicant will be able to construct the sign as proposed.
2. Deny the conditional use permit. By denying the conditional use permit, the applicant will
not be able to construct the sign as proposed. If the City Council considers this
alternative, findings will have to be identified that support this alternative.
3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF
FACT AND APPROVING A CONDITIONAL USE
PERMIT TO CONSTRUCT A SIGN
WHEREAS, an application for Conditional Use Permit CUP97 -7 has been made by Stuart
Management Corporation;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a conditional use permit was made by Stuart Management
Corporation November 24, 1997;
2, That the Hopkins Zoning and Planning Commission, pursuant to mailed and published
notice, held a public hearing on the application and reviewed such application on
December 30, 1997: all persons present were given an opportunity to be heard;
3. That the written comments and analysis of City staff were considered; and
4. A legal description of the subject property is as follows:

NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit
CUP97 -7 is hereby approved based on the following Findings of Fact:
1. That the proposed sign meets the requirements for a conditional use permit.
BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP97 -7 is hereby
approved based on the following conditions:
1. That the applicant receive a sign permit before constructing the proposed sign
2. That the proposed sign has a five -foot setback.
