CR 08-111 Preliminary Plat/Final Plat - 242 Van Buren AveNovember 26, 2008 ' P K INS Council Report 08 -111 PRELIMINARY PLAT/FINAL PLAT — 242 VAN BUREN AVENUE Proposed Action Staff recommends the following motion: Adopt R esolUtIO11 08 -71, app roving a preliminary /final plat for 242 Van Buren Avenue. At the Zoning and Planning meeting Mr. Jenny moved and Mr. Hatlestad seconded a motion to adopt Resolution RZ08 -10, recommending approval of a preliminary /final plat for 242 Van Buren Avenue. The motion was approved unanimously. Overview Carol Carpenter, the applicant, currently owns two adjoining lots. Her house is on 242 Van Buren Avenue which is a long lot that extends to Jackson Avenue. The other lot owned by Ms. Carpenter is a small lot on Jackson Avenue. Ms. Carpenter is proposing to divide 242 Van Buren into two lots and add the west side of 242 Van Buren that abuts Jackson Avenue to the small lot on Jackson. The new, larger lot on Jackson would allow a new home to be constructed. The small lot on Jackson is not buildable with out the addition of the west side of 242 Van Buren. The zoning of the site is R -1 -A, Single and Two - family. The Comprehensive Plan has designated the site as residential. • Does the lot meet the minimum lot requirements? The minimum lot size is 6000 square feet in the R -1 -A zoning district. Each of the proposed lots is over 6000 square feet. • What are the specifics of the plat? The plat will be two lots. • Does the proposed plat meet the subdivision requirements? The proposed plat meets the subdivision requirements. • Will a park dedication fee be required? A park dedication fee will be required because a new lot will be created. • What was the discussion at the Zoning and Planning meeting? Ms. Anderson reviewed the proposed subdivision. By approving the preliminary /final plat, the applicant will be able to replat the property as proposed. 2. Deny the preliminary /final plat. By denying the preliminary /final plat, the applicant will not be able to replat the property as proposed. If the Planning Commission considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. If the City Council indicates that further information is needed, the item should be continued. CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 08 -71 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF A PRELIMINARY /FINAL PLAT FOR 242 VAN BUREN AVENUE NORTH WHEREAS, an application for a preliminary /final plat SUBD08 -4 has been submitted for by Carol Carpenter; WHEREAS, the procedural history of the application is as follows: 1. That an application for preliminary /final plat was submitted for by Carol Carpenter on October 27, 2008; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on November 25, 2008: all persons present were given an opportunity to be heard; and 3. That the written comments and analysis of City staff were considered. NOW, THEREFORE, BE IT RESOLVED that the application for a preliminary /final plat SUBD08 -4 is hereby approved based on the following Findings of Fact: 1. That the preliminary /final plat meets the subdivision requirements. 2. That the preliminary /final plat meets the zoning requirements. BE IT FURTHER RESOLVED that application for preliminary /final plat SUBD08 -4 is hereby approved based on the following conditions: 1.
