Staff recommends adoption of the following motion: Move that Council adopt Resolution 98-21,
Resolution Approving Plans and Specifications, Alley Reconstruction, Project 97 -16, and
Authorizing Bids.
Overview.
Council at its April 7 meeting conducted a public hearing concerning the reconstruction of an
alley located between the Hopkins Center for the Arts and the US West Central Office Building.
Council reordered the preparation of plans and specifications. Those plans are now submitted
for final approval and staff seeks authorization to continue to the bidding phase.

Analysis.
Negotiations with US West for parcel acquisition
Negotiations have been on -going with US West in an attempt to facilitate parking along the
north side of the alley and to reach an accord with US West for an easement or parcel
purchase. The telephone company is interested only in the sale of a 2,037 square foot parcel
in consideration of $1.00. In return the company requests that permitted parking stalls be set
aside for their use and that special assessments against US West be waived.
Agreement has been reached with US West. Three parking stalls will be set aside for the
company's exclusive use, the necessary parcel will be conveyed to the City, and special
assessments forgiven. Staff has forwarded a warranty deed to corporate offices for signature
and an official agreement is in the process of being drafted.
Project design
Plans show reconstruction with a 12 -foot wide concrete alley and the installation of a storm
sewer system. Flow of traffic will be reversed to that of east to west to more adequately
utilize parking along the north edge of the alley. Eight parallel parking stalls will be created
along the north side. These stalls will be signed as permitted parking only. The parking
facilities adjacent to the Arts Center will be reconfigured and expanded to accommodate the
east to west flow. Three each of handicap and regular stalls will be installed.
The consultant has structured the bid document so that the City will get a quote for
bituminous restoration beyond the concrete alley pavement versus a quote for complete
concrete restoration.

Now that the City is prepared to waive special assessments against US West in return for
parcel acquisition and the establishment of parallel parking, there should be a breakdown of
costs within the assessable construction costs category. Perhaps the assessable cost of
$13,244.00, which could have been levied against US West, should now be categorized with
the Arts Center parking costs.
In keeping with current policy of funding the City's share of alley reconstruction through the
storm sewer utility, we find that roughly $27,300 of the total project costs is covered through
this mechanism. The remaining $22,679 of costs are attributable to parking improvements
that benefit the Center for the Arts.

RESOLUTION NO. 98-23
RESOLUTION APPROVING PLANS AND SPECIFICATIONS
ALLEY RECONSTRUCTION, PROJECT 97 -16
AND AUTHORIZE THE ADVERTISING FOR BIDS
WHEREAS, pursuant to a resolution passed by the Council on April 7, 1998, plans and
specifications for reconstruction of the alley in the #10 block between l l Avenues
North have been prepared by the consultant, and Bolton & Menk, Inc. presented such
plans and specifications to the Council for approval,
NOW THEREFORE BE IT RESOLVED, by the City Council of Hopkins, Minnesota:
1. Such plans and specifications, a copy of which are attached hereto and made a part
hereof, are hereby approved and ordered placed on file in the office of the City Clerk.
2. The City Clerk shall prepare and cause to be inserted in the official paper and in the
Construction Bulletin an advertisement for bids upon the making of such improvement
under such approved plans and specifications. The advertisement shall be published
twice, at least twenty -one days before date set for bid opening, shall specify the work to
be done, shall state that bids will be received by the clerk until 10 a.m. on the 14 day of
May, 1998 at the City Hall, and that no bids shall be considered unless sealed and filed
with the clerk and accompanied by a certified check or bid bond, payable to the City of
Hopkins, Minnesota for 5% of the amount of such bid.
3. The clerk and engineer are hereby authorized and instructed to receive, open, and read
aloud bids received at the time and place herein noted, and to tabulate the bids received.
The Council will consider the bids, and the award of a contract, at the regular City
Council meeting of May 19, 1998.
