Staff recommends adoption of the following motion: Move that Council adopt Resolution 98-25., Resolution for Adoption of the Assessment Roll, Project 97 -12, Interlachen Park Street Improvements. Overview. Council at its April 7 meeting considered the proposed assessment roll for Interlachen Park street reconstruction: segments of Preston Lane and Holly Road. A public hearing for special assessments was set for May 5. This hearing sets in motion levying of assessments against properties along Preston Lane from Ashley Road to Interlachen Road and along Holly Road from its terminus to Goodrich Street. A public hearing notice has been published and mailed, along with an assessment statement, to every affected property owner. As of Friday, May 1, two appeals were submitted contesting the proposed assessments. Appeals must be submitted no later than the hearing date. Analysis. Appeal procedure Property owners are given the opportunity to approach Council with their appeals during the public hearing. Standard appeal forms have been available at City Hall and need to be submitted no later than the hearing date. Staff will make recommendations on all appeals. Assessment policy Staff has adhered to the City's legislative policy 8 -B concerning special assessment policies and formulas as they pertain to this project. In the case of reconstructed portions of Preston Lane and Holly Road, 70% of street reconstruction cost will be recovered by assessing the benefiting adjacent properties. The bid schedules for each of the streets detail the construction costs that form the basis of calculating the special assessments. It is important to note that sanitary sewer repairs in Preston Lane and water main replacement in Holly Road are at "City expense as part of a reconstruction project." This is to quote,Section 10.11 of the City's legislative policy manual on assessment policies. Some residents have taken issue with the City in claiming that street reconstruction was an excuse used to do utility repairs and replacement and to have street restoration costs passed on to property owners. Staff has ample evidence to prove that the City made several studies of the roadway conditions before even considering utility issues. Council should also note that the bid documents reflect quotes in separate tables for utility service costs on the part of the City and the homeowners. Table Cl reflects costs the City may bear in making new connections or repairs to resident owned water and sanitary services inside the R.O.W. construction zone. Table C2 reflects costs the homeowners may have to bear should upgrades to their sewer and water services be required outside the City's right -of -way. Should homeowners face such costs, staff is prepared to have them sign waiver /petition forms to have the cost placed on the property as a special assessment. Project costs and assessment rates Computations used to derive the proposed assessments are found on the assessment worksheets. A worksheet is provided for each of the two streets where an assessment is proposed: Holly Road and Preston Lane. The worksheets are premised on the low bid contractor quotes in Tables E (Streets and Restoration) of the bid document and on the contracted consultant fee. The assessable construction costs for each of the streets is established, pro -rated engineering costs are added, a 6% admin. /legal, finance fee is applied, and a final 70% share (per current legislative policy) for assessing is calculated. The assessable project costs are divided by the assessable footage to derive the assessment rate. The "Final Assessment Roll" summary sheets reflect the proposed assessment for each lot. Staff prepared the assessable construction costs without benefit of the customary 5 -10% contingency added to either the construction bid or the pro -rated consultant fee. Staff is recommending waiving the contingency in anticipation of renegotiating lower revised costs on some of the bid items. Staff also is concerned about keeping the assessment rate as close as possible to the original estimate. Clearly, the proposed assessment rates are higher than those quoted in original feasibility study estimates. This is a reflection of the higher bids in the total contract. The consultant has provided an assessment analysis to demonstrate how increased unit prices and changes in bid item quantities, subsequent to the feasibility report, have contributed to the assessment rate increase. In the case of Preston Lane, the analysis shows that an increase in quantities from the feasibility phase to the bidding state contributed at least 36% to the increase of the assessment rate. Below is a comparison of the assessment rates: Preston Lane Feasibility rate - $51.03/FF Proposed final rate - $55.90/FF Holly Road Feasibility rate - $53.32/FF Proposed final rate - $55.08/FF Project timetable May 5 Assessment hearing and adopt assessment roll June 16 Award contract July 1 Begin construction October Project complete Action on appeals The following are appeals concerning Project 97 -12: 1. Address: 1318 Preston Lane Assessed Amount: $4,472.00 Appeal for cancellation of assessment by reason of cost to homeowner and no perceived need for a project, and that street repairs and maintenance should be funded out of general revenues. Recommendation: Deny appeal on the basis that City based need for a project on extensive surficial and underground testing, that 100% funding of street reconstruction from general funds would be unfair to residents in at least seven other neighborhoods where the City participated with a 30 % -40% share of the costs. 2. Address: 235 Holly Road Assessed Amount: $5,508.00 Appeal for cancellation of assessment by lengthy list of reasons attached. (See appeal form and notice of objection.) Recommendation: Deny appeal on the basis that benefit is deemed to be derived when a street of substandard condition is replaced and drainage characteristics enhanced, that the City is not obligated to obtain before and after market value appraisals to sustain special assessments, that the City adhered to an established policy concerning reconstruction of streets and the assessing of costs thereof, and that the City is not aware of any violations of Minn. Statutes 429.061 or 429.081 in carrying out its special assessment procedures. Adoption of assessment roll Staff recommends adoption of Resolution 98 -25, adopting the special assessment roll as it pertains to street improvements on Preston Lane and Holly Road. NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in the Council Chambers of the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota at 7:30 p.m. on Tuesday, May 5, 1998, to hear all persons concerning the adoption of the assessment roll for Public Improvement Project 97 -12 and to adopt the assessment roll as presented or amended. This hearing is scheduled pursuant to Minnesota Statutes Chapter 429. The assessment roll as herein described is on file in the office of the City Clerk. AREA TO BE ASSESSED: CITY OF HOPKINS Hennepin County, Minnesota NOTICE OF ASSESSMENT HEARING Those properties abutting Holly Road from its terminus to Goodrich Street and those properties abutting Preston Lane from Ashley Road to Interlachen Road. TOTAL AMOUNT TO BE ASSESSED IS $180,662.96 All persons who wish to be heard, or to object with reference to this matter may present their cases at this hearing, either orally or in writing. No appeal may be taken as to the amount of any assessment adopted unless a written objection signed by the property owner is filed with the Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. Even though appeals are due by the hearing date on May 5, 1998, the City Clerk strongly recommends that appeals be submitted to the Assessment Clerk's office by April 29, 1998. Appeal forms will be available at the assessment hearing or at the Assessment Clerk's office at the Hopkins City Hall, 1010 1st Street South, Hopkins, Minnesota. An owner may appeal an assessment to district court pursuant to MSA Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thirty (30) days after the adoption of the assessment and by filing such notice with the district court within ten (10) days after service upon the Mayor and City Clerk. Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its discretion, defer the payment of assessments for any homestead property owned by a person 65 years of age or older for whom it would be a hardship to make the payments. The procedures to apply for such deferment are available from the Assessment Clerk. Deferment applications should be submitted to the Assessment Clerk by April 29, 1998. • The following information shall also apply: 1. The property owner shall have the right to prepay the entire assessment. Your assessment may be paid without interest from May 5, 1998 to June 4, 1998, to the Assessment Clerk at City Hall, 10101st Street South, Hopkins, Minnesota. You may at any time thereafter, pay to the Assessment Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made by November 30, 1998 or interest will be charged through December 31 of the succeeding year. 2. Partial prepayment of the assessment in excess of 25 percent of the total assessment has been authorized by ordinance. A partial prepayment can only be made prior to November 30, 1998 with interest accrued to the payment date, except that no interest shall be charged if such partial payment is made by June 4, 1998. 3. In the case where accrued interest applies, the rate of interest to be accrued, if the assessment is not prepaid within the required time period, is proposed to be 8 percent commencing on the date of adoption by the City Council. Assessments shall be payable in annual installments over a period of 10 years. 4. The amount to be specially assessed against your property is shown on the statement of assessment sent to you by mail. Between the feasibility and final design phases of the project, there was much discussion regarding the interpretation of the Braun's soils report. The latest conclusions led us to increase the Subgrade Excavation and associated Stabilizing Aggregate items. The increase in concrete item quantities hinges on the discovery of additional concrete, rather than bituminous, driveways and the necessity of a cross gutter along the church parking lot at the intersection of Preston Lane and Interlachen Road. An analysis of Holly Road actually reveals a reduction in the assessment rate due to changes in the bid item quantities, but unfortunately not enough to offset the higher bid prices. The adjusted bid item which has the most influence on this reduction is Common Excavation. This quantity changed as a result of modifications to the road's proposed profile.
