Staff recommends the following motion: Move to approve Resolution 98 -27, approving a . conditional use permit to construct a Valvoline Instant Oil Change at 1821 Mainstreet. At the Zoning and Planning meeting, Mr. Engel moved and Ms. Boen seconded a motion to approve Resolution RZ98 -7, recommending approval of a conditional use permit to construct a Valvoline Instant Oil Change at 1821 Mainstreet. The motion carried unanimously. Overview. Valvoline Rapid Oil is proposing to raze the existing car wash at 1821 Mainstreet and construct a new building. The Valvoline Instant Oil Change located on the southwest corner of Excelsior Boulevard and Blake Road will close in the future. The proposed building will be situated on the site so that the garage doors face east /west. The proposed building will have two service bays. Primary Issues to Consider. • What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? • What are the specifics of the development? • What was the discussion at the Zoning and Planning meeting? Council Report 98 -69 CUP98 -4 2 Primary Issues to Consider. o What is the zoning of the property, and how has the Comprehensive Plan designated the subject site? The site is zoned B -3, General Business. The Comprehensive Plan has designated the site as commercial. The proposed use is permitted in the B -3 zoning district. o What are the specifics of the proposed development? Landscaping The site is required to have 10 trees. The landscape plan shows 17 trees of the required size. The majority of the landscaping will be placed along Mainstreet and along the alley. There are also various shrubs planted throughout the site. The site will be irrigated. Access Access to the site will be from 19th Avenue. The northerly access will be the entrance to the building. After a car has had the oil changed, it will drive through the building and exit the southerly access. The northerly access will be used for the entrance and exit for the parking area. Fire Marshal The fire marshal has reviewed the preliminary plans and found them acceptable. Public Works The Public Works department has reviewed the proposed development and made the following comments: o The grading plan needs to be submitted to Nine Mile Creek Watershed District for final approval and a permit. o A driveway permit from Engineering will be required. o The development will be held responsible for repair of any sidewalk damage generated by site construction activity. Sidewalk The sidewalk on Mainstreet will remain, and there will be a sidewalk added along 19th Avenue. CUP98 -4 3 Exterior The site plan indicated the exterior will be split face block. There will be an accent flashing on the top of the building that is slate gray in color. Zoning requirements The following are the B -3 and proposed development requirements: B -3 Proposed Building front yard 1 foot 10 feet west sideyard 0 45 feet east sideyard 0 45 feet rear yard 25 feet 68 feet height 45 feet 15 feet Parking The site is required to have eight parking spaces. The site plan indicated seven parking spaces with additional room for three other spaces. The site also has stacking space. Staff is recommending that the three additional spaces be added in the future only if needed. Trash The trash area is located on the northeast side of the building. The trash area will be enclosed as required by the ordinance. There will also be landscaping around the trash area for further screening. 0 What was the discussion as the Zoning and Planning meeting? Ms. Anderson reviewed the proposed development. Mark Gilbertson of Valvoline Instant Oil appeared before the Commission. Mr. Gilbertson reviewed the site plan with the Commission. Arthur Bell of 25 19 Avenue North appeared at the public hearing. Mr. Bell was concerned about the access points from 19 Avenue and wanted the access points changed to Mainstreet. The Commission discussed the access from 19 rather than from Mainstreet and the visibility of the access point closest to Mainstreet. Mr. Gilbertson stated that they service about 43 cars in a 12 -hour day. In the discussion regarding the access from 19 the Commission decided to leave the site plan as presented because the building will be set back further from 19 Avenue and the southerly access point will be moved to the north. The Commission also indicated that accessing to 19 Avenue is safer that accessing onto Mainstreet. Mr. Engel was concerned about trash and delivery vehicles creating noise at evening and early morning hours. A condition was added to the resolution regarding limiting the times for delivery and trash vehicles. CUP98 -4 4 Alternatives. 1. Approve the conditional use permit to construct a Valvoline Instant Oil Change at 1821 Mainstreet. By approving the conditional use permit to construct a Valvoline Instant Oil Change, the applicant will be able to construct the development as proposed. 2. Deny the conditional use permit to construct a Valvoline Instant Oil Change at 1821 Mainstreet. By denying the conditional use permit to construct a Valvoline Instant Oil Change, the applicant will not be able to construct the development as proposed. If the City Council considers this alternative, findings will have to be identified that support this alternative. 3. Continue for further information. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on April 28, 1998: all persons present were given an opportunity to be heard; 1. That Nine Mile Creek Watershed District approves the grading plan. 2. That the applicant obtains a driveway permit. 3. That the applicant is responsible for the repair of any sidewalk damage generated by construction activity. 4. That the applicant will have to add the additional three parking spaces if they are deemed necessary by staff. 5. That any trash and delivery vehicles making noise will be allowed on the site only from the hours of 8:00 a.m. to 6:00 p.m. weekdays and 10:00 a.m. to 4:00 p.m. weekends. By Charles D.
