CONDITIONAL USE PERMIT - APARTMENTS
Proposed Action.
Staff recommends the following motion: Move to approve Resolution 98-86 approving a
conditional use permit to construct a 37-unit apartment complex_
At the Zoning and Planning meeting, Mr. Brausen moved and Mr. Gross seconded a motion
to approve Resolution RZ98-29, recommending approval of a conditional use permit to
construct a 37-unit apartment complex_ The motion carried unanimously_
Overview_
The applicants are proposing to construct a 37-unit apartment complex south of the
apartment complex known as the Plantation. The proposed apartment building will be a
three-story building with underground parking_ The market for the proposed apartment
building will be upper bracket.
The site is situated on a vacant part of the lot on which the Plantation apartments are located.
. The building is proposed to have 24 two-bedroom units and 13 one-bedroom units_

. Primary Issues to Consider_
. What is the zoning and of the property, and how has the Comprehensive Plan
designated the subject site?
The property is zoned R-4, medium high density multiple family_ The Comprehensive Plan
has designated the site as high density multiple family_ The proposed development complies
with both documents_
The site is permitted to have 113 units_ The site with the proposed development will have
100 units_
. What are the specifics of the site plan?

The zoning ordinance requires 25 trees for the site_ The landscape plan indicated that 12
spruce and two honeylocust trees would be planted. There are existing trees on the site that
will remain that will complete the landscaping requirements. The landscape plan indicates
that the landscaping will be completed six months after occupancy. The applicant is required
to complete the landscaping before occupancy_
Public Works
. The Public Works department has reviewed the proposed development and has made the
following comments:
. The Minnehaha District wi1l have to approve the proposed development.
. The City will require a stormwater management plan with all runoff
calculations. Runoff will need to be mitigated to meet the requirements of
Section 546_06 Subd_ 7. The City will require a review of the developer's
storm water management plan by its own consultant_ The applicant will be
responsible for the cost of the review.
. The City will require utility easement dedicated to the public for an existing
water main, sanitary sewer and drainage ditch on site.
Fire Marshal
The Fire Marshal has reviewed the plans and made the following comments:
. The fire access land is over 150 feet in length and requires a turn-around_
. A fire hydrant is required to be added.
At the Zoning and Planning meeting, a new site plan was presented that appears to meet all
. the Fire Marshal's concerns_

. Parking
The zoning ordinance requires that 200 parking spaces are required for the entire site_ The
site plan indicates 81 surface parking spaces and 119 underground parking spaces_ The site
plan indicates that 200 parking spaces.
Trash
The trash receptacles will be located inside the building.
Access
Access to the site will be from the existing access pOlnt on Van Buren Avenue.
Exterior
The exterior lS proposed to be a rock-faced concrete masonry unit on the base of the building
and a stucco exterior on the majority of the building. The roof will have asphalt shingles_
Zoning requirements
The following are the required and proposed setback requirements:

Surrounding uses
The site is surrounded by Highway 169 to the west, multi-family to the north and east and
single family to the south_
. What was the discussion at the Zoning and Planning meeting?
Ms_ Anderson reviewed the proposed development with the Commission_ Keith Sjoquist,
representing the applicants, appeared before the Commission. Mr. Sjoquist reviewed a
revised site plan with the Commission_ The revised site plan eliminates many of the
concerns staff had with the proposal. Mr. Sjoquist stated that the building would be equipped
with a sprinkling system.
Mrs. Dahlberg of 425 Madison Avenue North appeared at the public hearing_ Mrs. Dahlberg
was concerned with the following:
. . Buffering on the south side of the property
. The utility easement
. The ditch handling the drainage

. Diane Johnson of 338 Madison Avenue North appeared before the Commission. Mrs.
Johnson was concerned with drainage problems on Monroe and did not want this
development to increase the existing problems_
Alternatives_
1. Approve the conditional use permit to construct a 37-unit apartment building_ By
approving the conditional use permit, the applicants will be able to construct the proposed
apartment building as proposed.
2_ Deny the conditional use permit to construct a 37-unit apartment building_ By denying
the conditional use permit, the applicant will not be able to construct the development as
proposed_ If the City Council considers this alternative, findings will have to be
identified that support this alternative.
3_ Continue for further information_ Tfthe City Council indicates that further information is
needed, the item should be continued_

RESOLUTION NO: 98-86
RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A CONDITIONAL USE PERMIT
TO CONSTRUCT AN APARTMENT BUILDING
WHEREAS, an application for Conditional Use Permit CUP98-13, has been made by Ervvin,
Duane and Lesley Stobbe;
WHEREAS, the procedural history of the application is as follows:
L That an application for a conditional use permit was made by Erwin, Duane and
Lesley Stobbe on October 23 1998;
2_ That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on November 24, 1998: all persons present were given an opportunity
to be heard;
3_ That the written comments and analysis of City staff were considered; and
. 4. A legal description of the subject property is as follows:
That part of the North half of the Northwest Quarter of Section 19, Township 117
Range 21, West of the fifth principal meridian lying Easterly of the Easterly right
of way line of the Great Northern Railway, South of the Southerly line of Trunk
Highway #7 as built and operated across said North half, West of the Northerly
extension of the Easterly line of the plat of Auburn North, Northerly and
Northwesterly of the Northerly and Northwesterly lines of said plat of Auburn
N0I1h and North of the Westerly extension of that certain South line of Lot 1,
Block 1, Auburn North shown on said plat having a dimension of 174.12 feet.
NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit
CUP98-13 is hereby approved based on the following Findings of Fact:
1. That the proposed building meets the requirements for a conditional use permit.
BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP98-13 is hereby
approved based on the following conditions:
1. The utilities are connected to the City's system_
2. The Minnehaha District will have to approve the proposed development.
