ORDER FINAL PAYMENT
11TH AVENUE SOUTH RECONSTRUCTION
Proposed Action.
Staff recommends adoption of the following motion: Move that
Council adopt Resolution 98-089, Resolution Acceptinq Work and
Orderinq Final Payment, 11th Avenue South Reconstruction.
Overview.
The contractor has completed a project for the reconstruction of
11th Avenue South from 5lh Street South to BCRRA Trail property.
The contractor has performed on punch list items to the
engineer1s satisfaction and the consultant recommends final
payment.
Primary Issues to Consider.
. o Accepting work and final payment
The contractor has met all contract obligations. The work
is done satisfactorily and the contractor has submitted
the necessary Ijen waivers and IC-134 withholding form. A
signed certificate of completion has also been returned.
Staff recommends approval of final payment in the amount
of $l4,l39.55
o Resolution 98-089
Adoption of this resolution formally acknowledges
completion of the work, orders final payment, and
initiates a one year warranty on the contract work.

RESOLUTION 98-089
RESOLUTION ACCEPTING WORK AND ORDERING FINAL PAYMENT-
11TH AVENUE SOUTH RECONSTRUCTION
WHEREAS, pursuant to a written contract signed with the City on
May 7, 1998, Midwest Asphalt Corporation has satisfactorily
completed the improvement of reconstruction of 11th Avenue South
from 5th Street South to HCRRA property commonly known as City
Project 96-16 in accordance with such contract.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF HOPKINS,
MINNESOTA;
l. The work completed under said contract is hereby accepted
And approved.
2 . Order for final payment on such contract is hereby ordered,
taking the contractor's receipt in full.

3. A one-year warranty on contract work shall commence upon the
adoption of this resolution.
Adoption by the City Council of the City of Hopkins, Minnesota,
this 15th day of December, 1998.
