Order Final Payment
Nine Mile Creek Maintenance
Proposed Action.
Staff recommends adoption of the following 111otion: Move that Council adopt Resolution 98-80.
Resolution Accepting Work and Ordering Final Payment Nine Mile Creek Maintenance.
Overview.
The contractor has completed the task of ditch excavation and creek bed maintenance associated
with Nine Mile Creek. The contractor has performed on punch list items to the engineer's
satisfaction and the consultant reconunends final payment.
Primary Issues to Consider.
. Accepting work and final payment
The contractor has met all contract obligations. The work is done satisfactorily and the
contractor has submitted the IC-134 form. Lien waivers and a signed certificate of
completion are forthcoming. Staff reconunends approval of final payment.

RESOLUTION ACCEPTING WORK AND ORDERING FINAL PAYMENT -
NINE MILE CREEK MAINTENANCE
WHEREAS, pursuant to a written contract signed with the City on February 19, 1998,
Wickenhauser Excavating, Inc. has satisfactorily completed the improvement of Nine Mile
Creek maintenance and excavation procedures, commonly known as City Proj ect 97-13 in
accordance with sLlch contract,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF HOPKINS,
MINNESOT A:
1. The work completed under said contract is hereby accepted and approved.
2. Order for final payment on such contract is hereby ordered, taking the contractor's receipt
e in full.
3. A one-year warranty on contract work shall commence upon the adoption ofthis
resolution.
Adoption by the City Council of the City of Hopkins, Minnesota, this 17th day of November,
1998.
