Staffrecommends adoption of the [ol1owing motion: Move that Council adopt Resolution 98-82. Resolution Approving Petition for Private Improvement Hopkins Business Center. Overview. The developer of the proposed Hopkins Business Center in the 1 0900 Block on the south side of Excelsior Boulevard has installed new water main and sanitary sewer services to the property. The work was done in conjunction with County Road 3 reconstruction. The owner wishes to place the service installation costs upon the property as a special assessment. PrimalY Issues to Consider. . Petition The owners are petitioning Council to make arrangements to place the cost of private utility service installation costs as a special assessment against their propeliy. Council will need to give approval to the attached contractor proposal and invoice and to the petition/waiver. The quoted construction costs of$10,398.95 would be assessed over a . ten-year period at 8% per annum. . Staff recommendation The petition for cost assessment of utility service line installation falls under project guidelines of M.S. 429 as an acceptable special assessment project. Final payment by the City to the contractor or petitioner shall be contingent upon receipt of lien waiver. Said property owner hereby waives any right to notice or objection to said improvement as provided in Chapter 429 of the Minnesota Statutes and any other provisions of municipal or state law providing for notice or objections_ The property owner understands that the aforesaid property will be assessed for the costs for the aforesaid work. CITY OF HOPKINS Helmepin County, Minnesota Resolution No. 98-82 RESOLUTION APPROVING PETITION FOR PRlV ATE IMPROVEMENT HOPKINS BUSINESS CENTER WHEREAS, the owners of property located at 10901 Excelsior Boulevard petitioned for improvements consisting of the installation of sewer and water main service lines pursuant to Minnesota Statute No. 429, and WHEREAS, the petition and accompanying document thereto comply with the requirements of the aforementioned statute. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HOPKINS, MINNESOTA: . 1. Such improvements are hereby ordered as proposed and requested in the petition. 2. That said improvement be in conformance with Minnesota Statute Chapter 429 and all state and municipal codes, ordinances and regulations pertaining thereto, that owners obtain the necessary City utility permits at time of final connection, and that the improvements receive a final City inspection as conditions to this approval.
