Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 98-29.,
Resolution to Authorize Granting of Roadway Easements, County Road 3 Reconstruction.
Overview.
In past action Council approved design and plans for the reconstruction of County Road 3 from
Shady Oak Road to 9th Avenue. To facilitate the installation of sidewalks and a trail, the City is
called upon to grant roadway easements over its property at Public Works and Central Park,
along 2nd Street South between l lth -13th Avenues, on llth Avenue adjacent to City Hall, and
along City property on the south side of County Road 3 between 9th -1 lth Avenues.
Primary Issues to Consider.
Why is Council authorization needed?
The City Charter requires Council authorization whenever transfer of City property or
encumbrances thereon take place.
Is there adverse impact on City property?
No. In fact, in the instance of property on the south side of County Road 3 between 9th and
1 lth Avenues there is resolution of an existing encroachment situation.

WHEREAS, the City Council of Hopkins, Minnesota, has approved plans for the reconstruction
of C.S.A.H. 3 from 9th Avenue to Shady Oak Road, and
WHEREAS, the plans call for widening of the existing County rights -of -way to accommodate
roadway, sidewalk and trail construction, and
WHEREAS, certain City property and right -of -way is affected by such widening and identified
as Parcels 19, 31, 31A, 32 and 32A in the County roadway plans, and
WHEREAS, Hennepin County has requested the granting of permanent roadway easements over
the above described parcels,
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS,
MINNESOTA:
1. The City hereby grants the requested roadway easements.
2. The Mayor and City Clerk are authorized to sign conveyance documents on
behalf of the City.
