License Agreement Hennepin County Digitized Data
Proposed Action
Staff recommends adoption of the following motion: "Move that Council adopt
Resolution No. 2009 -009, authorizing the City to enter into an agreement with
Hennepin County for the use of its geographical digitized data."
Overview
Currently the City is actively involved in the retrieval and storage of City records
in a digitized mode. Hennepin County has developed electronic forms of certain
databases including an electronic geographical digitized database, which the City
can use to meet its communication goals. The County requires the City to renew
its license agreement for the use of proprietary information. The agreement
provides Hennepin County copyright protection of its material and ensures that
users do not inappropriately use or sell the data.

Hennepin County desires to extend the above referenced EPDB Conditional Use License
Agreement through December 31, 2009. If you as a Government Unit, Consultant/Third
Party or Private Corporation, desire to extend the above - reference Agreement, the
following requirements must be satisfied as they pertain to your entity. Please return the
required information to Hennepin County, Attention: Robert Moulder (at the address
stated at the top of this page).
A.) GOVERNMENTAL UNIT MUST FURNISH TO THE COUNTY A COPY OF
THE ACTION OF USER'S GOVERNING BODY AUTHORIZING THIS
AGREEMENT EXTENSION. HOWEVER, IF AN OFFICIAL OF USER IS
AUTHORIZED BY STATUTE OR CHARTER TO APPROVE AN
AGREEMENT OF THIS NATURE THEN THIS ORIGINAL LETTER SIGNED
BY SUCH OFFICIAL AUTHORIZING THE EXTENSION MUST BE
RETURNED TO THE COUNTY. NOTE. SUCH OFFICIAL MUST ATTACH TO THIS .
LETTER A COPY OF THEIR STATUTORY OR CHARTER A UTHORITYTO APPROVE THE
AGREEMENTS.
B.) CONSULTANT /THIRD PARTY MUST PROVIDE THE COUNTY A COPY
OF AFFIRMATION BY GOVERNMENTAL UNIT THAT YOU WILL
CONTINUE AS CONSULTANT AS STATED IN AGREEMENT NO.
THROUGH THE YEAR 2009. IN ADDITION,
CONSULTANT /THIRD PARTY MUST SIGN THE ATTACHED SIGNATURE
PAGE AND ACKOWLEDGEMENT AND RETURN ORIGINALS,OF BOTH
TO THE COUNTY.
C.) PRIVATE CORPORATION MUST SIGN THE ATTACHED SIGNATURE
PAGE AND ACKNOWLEDGEMENT AND RETURN ORIGINALS OF BOTH

RESOLUTION 2009 -009
RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF HOPKINS AND
HENNEPIN COUNTY AND ITS TAXPAYER SERVICES DEPARTMENT FOR
ELECTRONIC DIGITIZED DATA
WHEREAS, the City of Hopkins wishes to maintain a Geographic Information System
database, and
WHEREAS, a current electronic geographical digitized database is needed to maintain
such a system, and
WHEREAS, Hennepin County Department of Taxpayer Services has the necessary
electronic geographical digitized database, and
WHEREAS, Hennepin County has a proprietary interest in the electronic geographical
digitized database, and
WHEREAS, Hennepin County and the City of Hopkins have entered into a previous
license agreement regarding the County's proprietary interest, Agreement #Al 2109 dated
February 16, 1999 and subsequently renewed this agreement through 2008, and
WHEREAS, Hennepin County proposes have this agreement extend through December
31, 2009, unless terminated sooner.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Hopkins,
Minnesota, that the Mayor and City Manager are hereby authorized to sign and execute an
agreement with Hennepin County for the use of its geographical digitized data through
December 31, 2009, unless terminated sooner.
Adopted by the City Council of the City of Hopkins, Minnesota, this 17 day of February 2009.
