CR 95-55 Presentation Nine Mile Creek "( y 0 \ V .... m e 'l Go Council Report #95-55 March 29,1995 o P K \ ~ PRESENTATION BY NINE MILE CREEK WATERSHED DISTRICT AND RESOLUTION OF SUPPORT Proposed Action staff recommends approval of the following: Move that Council adopt Resolution 95-23. Resolution Reaffirmina the Cooperative Relationship Between Nine Mile Creek Watershed District and the City of Hookins. Overview Council at its April 2, 1991 meeting adopted a resolution outlining the city's position concerning the state Board of Water and Soil Resources (BWSR) promulgation of new water quality regulations. In summary the resolution recorded the city's concern regarding BWSR draft rules and their negative impact on cooperative relations between it and its water management districts (e.g. Nine Mile Creek Watershed Distr ict) . Further, the resolution stated opposition to proposals and programs assumed to be funded by local government and placing a . financial burden on its citizens. Recently the Nine Mile Creek Watershed Board of Managers has submitted a draft watershed management plan for BWSR approval. BWSR staff is still intent on requiring certain measures that the Nine Mile managers view as intrusive upon the cooperative relationship between them and Hopkins. Nine Mile managers also point to BWSR's proposal eliminating municipal involvement in project and financing decisions. Representatives of Nine Mile Creek Watershed District will appear before Council for a short presentation. Primary Issues to Consider · Watershed Board presentation . Watershed Board presentation Aileen Kulak, Watershed District Board Chair, will provide introductions. Paul Haik, attorney representing the district in negotiations with BWSR, will cover the following issues: 1. The framework for watershed district planning and project financing. 2. What impact does the watershed district have on the city's financial picture? 3. Overview of issues with BWSR, i.e. project planning process, establishing uniform rules for water quality. . Resolution 95-23 Staff recommends adoption of the resolution in support of the Nine Mile Creek Watershed District efforts to retain project financing . through the Watershed Act, Chapter 103D and to retain state mandated rules rather than unique, free standing controls in administering water quality standards. . -- ~- - - CITY OF HOPKINS 4It Hennepin County, Minnesota RESOLUTION 95-23 RESOLUTION REAFFIRMING THE COOPERATIVE RELATIONSHIP BETWEEN NINE MILE CREEK WATERSHED DISTRICT AND THE CITY OF HOPKINS WHEREAS, the City of Hopkins is within the Nile Mile Creek Watershed District and is preparing and implementing a local water management plan pursuant to the Watershed Management Plan of Nine Mile Creek Watershed District, and WHEREAS, the Nine Mile Creek Watershed District, in cooperation with the City, has completed millions of dollars of watershed improvements, including box culvert and flood management improvements and creek bed maintenance improvements on Nile Mile Creek, and WHEREAS, such projects were initiated by a petition of the City of Hopkins within the Nine Mile Creek Watershed District and will be financed through Minn. Stat. 103D.905,Subd. 3, and WHEREAS, the Board of Water and Soil Resources is recommending . that Nine Mile Creek Watershed District finance projects using Minn. Stat. 103B.241, Subd.l, which does not require a municipal petition, as opposed to continued use of the Watershed Act, Chapter 103D, and WHEREAS, the city of Hopkins does not want its involvement in project and financing decisions altered, NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: 1. The city urges the Board of Water and Soil Resources to continue to support use of the Watershed Act, Chapter 103D, for the purpose of financing projects or improvements within the Nine Mile Creek Watershed District and to abandon mandating use of Minn.Stat. 103B.241, Subd.l. 2. The Council of the City of Hopkins supports the intention of the Board of Water and Soil Resources to allow for adoption by reference of guidelines or best management practices previously published by state agencies or departments and opposes the promulgation by the Nine Mile Creek Watershed District of unique, free standing rules and ordinances more restrictive than state statutes or rules governing water resources. e 3. The city Clerk shall transmit copies of this resolution to . the Chair of the Board of Water and Soil Resources, the Mayor and Council of the several cities within the watershed district, the Board of Managers of Nine Mile Creek Watershed District and the Board of Commissioners of Hennepin County, as well as other executive and legislative officials.
